BOMBAY PRIMARY EDUCATION ACT , 1947 .
No.KSH/ 15 /KHPSH/ 1004/ 1421 /CH.-- The following draft notification which is proposed to be issued under sub - section ( 1 ) of section 63 of the Bombay Primary Education Act , 1947 (Bom . LXI of 1947 ) , is published as required by sub - section (3 ) of the said section 63 for the information of all persons likely to be affected there by and notice is hereby given that the said draft will be taken into consideration by the Government of Gujarat on or after the expiry of thirty days from the date of publication of this notification in the Official Gazette .
2.Any objection or suggestion which maymay be received by the Secretary to Government of Gujarat (Primary Education) Education Department , Sachivalaya , Gandhinagar from any person with respect to the said draft notification on or before the expiry of the aforesaid period will be considered by the Government.
Draft Notification
No.KSH/ 15 / KHPSH / 1004 / 1421 / CH .-- In exercise of the powers conferred by section 63 of the Bombay Primary Education Act , 1947 ( Bom . LXI of 1947 ) the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules , 1949 , namely: -
1. These rules may be called the Bombay Primary Education (Gujarat Amendment ) Rules , 2005.
2. In the Bombay Primary Education Rules , 1949 , in SCHEDULE- F, for the condition 5, the following shall be substituted , namely: -

"5. Closure of school or reduction in the total number of classes : -No Management of recognized private primary school shall reduce the total number of classes in its school or close down the school without the prior permission in writing of the Authorised Officer. For this purpose the management shall have to make an application to the Authorised Officer at least six months before the date from which it intends to reduce the number of classes or close down the school. On receipt of such application , the Authorised Officer may in such manner as may be deemed. necessary, make such inquiry as it may appear to be necessary and shall decide whether the application shall be granted or refused either in whole or in part "

ક્રમાંકઃકેએસએચ/૧૫/કેએચપીએસએચ/૧૦૦૪/૧૪૨૧-ચઃ- મુંબઈપ્રાથમિક શિક્ષણ અધિનિયમ, ૧૯૪૭ (સન ૧૯૪૭ના મુંબઈના ૬૧ મા)ની કલમ ૬૩નીપેટા-કલમ (૧ ) હેઠળ કાઢવા ધારેલા જાહેરનામાનો નીચેનો મુસદો, સદરહું કલમ ૬૩ની પેટા- કલમ ( ૩) થી ઠરાવ્યા પ્રમાણે, તેનાથી અસર થવાનો સંભવ હોય તેવી તમામ વ્યક્તિઓની જાણ સારૂ પ્રસિધ્ધ કરવામાં આવે છે અને આથી નોટિસ આપવામાં આવે છે કે આ જાહેરનામું રાજપત્રમાં પ્રસિધ્ધ થયાની તારીખથી ત્રીસ દિવસ પૂરા થયે અથવા તે પછી, ગુજરાત સરકાર, સદરહુ મુસદો વિચારણામાં લેશે .
૨. ઉપર્યુક્ત મુદત પૂરી થયે અથવા તે પહેલાં જાહેરનામાના સદરહું મુસદાના સંબંધમાં, સરકારના સચિવ, (પ્રાથમિક શિક્ષણ) શિક્ષણ વિભાગ , સચિવાલય, ગાંધીનગરને કોઈપણ વ્યક્તિ તરફથી જે કાંઈ વાંધા અથવા સૂચનો મળશે તેને સરકાર વિચારણામાં લેશે.
જાહેરનામાનો મુસદો
ક્રમાંકઃકેએસએચ/૧૫/કેએચપીએસએચ/૧૦૦૪/૧૪૨૧-ચ -મુંબઈપ્રાથમિક શિક્ષણ અધિનિયમ , ૧૯૪૭ (સન ૧૯૪૭ના મુંબઈના ૬૧ મા)ની કલમ ૬૩થી મળેલી સત્તાની રૂએ, ગુજરાત સરકાર, આથી મુંબઈ પ્રાથમિક શિક્ષણ નિયમો, ૧૯૪૯ વધુ સુધારવા નીચેના નિયમો કરે છે :-
૧. આ નિયમો "મુંબઈ પ્રાથમિક શિક્ષણ (ગુજરાત સુધારા ) નિયમો , ૨૦૦૫ " કહેવાશે..
૨. મુંબઈ પ્રાથમિક શિક્ષણ નિયમો, ૧૯૪૯માં, અનુસૂચિ -છમાં, શરત પને બદલે, નીચેનો મજકૂર મૂકવો:-
"૫. શાળા બંધ કરવા અથવા વર્ગોની કુલ સંખ્યા ઘટાડવા બાબત :-કોઈપણ માન્ય ખાનગી પ્રાથમિક શાળાનું સંચાલક મંડળ અધિકૃત અધિકારીની લેખિતમાં પૂર્વમંજૂરીમેળવ્યા સિવાય પોતાની શાળાના વર્ગોનીકુલ સંખ્યામાં ઘટાડો કરી શકશે નહિ અથવા શાળા બંધ કરી શકશે નહિ . આ હેતુ માટે, સંચાલક મંડળે, પોતે જે તારીખથી વર્ગોની સંખ્યા ઘટાડવા અથવા શાળા બંધ કરવા ધારતું હોય તે તારીખથી ઓછામાં ઓછા છ મહિના પહેલાં અધિકૃત અધિકારીને અરજી કરવાની રહેશે. આવી અરજી મળ્યે , અધિકૃત અધિકારી, પોતે જરૂરી ગણે તે રીતે , પોતાને જરૂરી લાગે તેવી તપાસ કરી શકશે અને અરજીને પૂર્ણતઃ અથવા અંશતઃ મંજૂર કરવાનો અથવા નામંજૂર કરવાનો નિર્ણય કરશે."

No -KSH - 6 - KHPS - 1004/ 117/CH.- WHEREAS , the draft rules further to amend the Bombay Primary Education Rules , 1949 were published as required by Sub- section (3) of section 63 of the Bombay Primary Education Act , 1947 (Bom. LXI of 1947) , at page 28 of the Gujarat Government Gazette , Part- 1 - A, Central Section, dated the 22nd December, 2005 under Government Notification , Education Department No. K/SH/ 14 /KHPS/1004 / 117 /CH , dated the 3rd December, 2005 inviting objection and suggestion from all persons likely to be affected there by within thirty days from the date of publication of the said notification in the official gazette .
AND WHEREAS , no objections or suggestions have been received from the public on the said draft notificationby the Government .
NOW; THEREFORE, in exercise of the powers conferred by section 63 of the Bombay Primary. Education Act , 1947 (Bom . LXI of 1947) , the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules 1949 , namely: -
1. These rules may be called the Bombay Primary Education (Gujarat Amendment) Rules , 2006 .
2. Inthe BombayPrimary Education Rules , 1949 , in rule 106, in sub rule (A) , in clause (4) , after sub clause (XV), the following shall be inserted, namely: -
"(XVI) A person, who is discharging his duties on academic or non academic post in any Private Primary School recognized under section 40- A of the Act , shall not remain as trustee in his own trust or any other trust registered under the Bombay Public Trust Act , 1950 or under the Societies Registration Act, 1860 , for the purpose of imparting Primary Education " .

BOMBAY PRIMARY EDUCATION ACT , 1947 .
No.KSH/ 18 /KHPSH/ 1004/ 1421 /CH.-- The following draft notification which is proposed to be issued under sub - section ( 1 ) of section 63 of the Bombay Primary Education Act, 1947 (Bom . LXI of 1947 ) , is published as required by sub - section ( 3 ) of the said section 63 for the information of all persons likely to be affected there by and notice is hereby given that the said draft will be taken into consideration by the Government of Gujarat on or after the expiry of thirty days from the date of publication of this notification in the Official Gazette.
2. Any objection or suggestion which may be received by the Secretary to Government (Primary Education) Education Department , Sachivalaya, Gandhinagar from any person with respect to the said draft notification on or before the expiry of the aforesaid period will be considered by the Government.
Draft Notification
No.KSH/ 18 /KHPSH/ 1004 / 1421 /CH .-- In exercise of the powers conferred by section 63 of the Bombay Primary Education Act, 1947 ( Bom . LXI of 1947) the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules , 1949, namely : -
1. These rules may be called the Bombay Primary Education (Gujarat Second Amendment) Rules, 2006.

2. In the Bombay Primary Education Rules , 1949 , in SCHEDULE - F , for the condition 5, the following shall be substituted , namely
" 5. Closure of school or reduction in the total number of classes :-No Management of recognised private primary school shall reduce the total number of classes in its school or close down the school without the prior permission in writing of the Authorised Officer. For this purpose the management shall have to make an application to the Authorised Officer at least six months before the date from which it intends to reduce the number of classes or close down the school . On receipt of such application , the Authorised Officer may in such manner as may be deemed necessary, make such inquiry as it may appear to be necessary and shall decide whether the application shall be granted or refused either in whole or in part "

ક્રમાંકઃ કેએસએચ/૧૮/કેએચપીએસએચ/૧૦૦૪/૧૪૨૧/ ચ :-મુંબઈ પ્રાથમિક શિક્ષણ અધિનિયમ, ૧૯૪૭ (સન ૧૯૪૭ ના મુંબઈના ૬૧ મા) ની કલમ ૬૩ની પેટા- કલમ (૧) હેઠળ કાઢવા ધારેલા જાહેરનામાંનો નીચેનો મુસદો , સદરહું કલમ ૬૩ની પેટા-કલમ ( ૩ ) થી ઠરાવ્યા પ્રમાણે, તેનાથી અસર થવાનો સંભવ હોય તેવી તમામ વ્યકિતઓની જાણ સારુ પ્રસિધ્ધ કરવામાં આવે છે. અને આથી નોટિસ આપવામાં આવે છે કે, આ જાહેરનામું રાજપત્રમાં પ્રસિધ્ધ થયાની તારીથી ત્રીસ દિવસ પૂરા થયે અથવા તે પછી, ગુજરાત સરકાર, સદરહુંમુસદો વિચારણામાંલેશે.
૨.ઉપર્યુકત મુદત પૂરી થયે અથવા તે પહેલા જાહેરનામાના સદરહું મુસદાના સંબંધમાં, સરકારના સચિવ, (પ્રાથમિક શિક્ષણ) શિક્ષણ વિભાગ સચિવાલય , ગાંધીનગરને કોઈ પણ વ્યકિત તરફથી જે કાંઈ વાંધા અથવા સૂચનો મળશે તેને સરકાર વિચારણામાં લેશે.
જાહેરનામાનો મુસદો
ક્રમાંકઃ કેએસએચ/૧૮/કેએચપીએસએચ/૧૦૦૪/૧૪૨૧/ચ -મુંબઈ પ્રાથમિક શિક્ષણ અધિનિયમ, ૧૯૪૭ (સન ૧૯૪૭ના મુંબઈના ૬૧ મા) ની કલમ ૬૩થી મળેલી સત્તાની રૂએ, ગુજરાત સરકાર, આથી , મુંબઈ પ્રાથમિક શિક્ષણ નિયમો, ૧૯૪૯ વધુ સુધારવા નીચેના નિયમો કરે છે :–
৭. આ નિયમો "મુંબઈ પ્રાથમિક શિક્ષણ (ગુજરાત બીજો સુધારા ) નિયમો, ૨૦૦૬ " કહેવાશે.
२. મુંબઈ પ્રાથમિક શિક્ષણ નિયમો, ૧૯૪૯માં, અનુસૂચિ-છમાં, શરત પને બદલે, નીચેનો મજકૂર મૂકવો .
"૫. શાળા બંધ કરવા અથવા વર્ગોની કુલ સંખ્યા ઘટાડવા બાબતઃ- કોઈપણ માન્ય ખાનગી પ્રાથમિક શાળાનું સંચાલક મંડળ અધિકૃત અધિકારીની લેખિતમાં પૂર્વમંજૂરી મેળવ્યા સિવાય પોતાની શાળાના વર્ગોની કુલ સંખ્યામાં ઘટાડો કરી શકશે નહિ અથવા શાળા બંધ કરી શકશે નહિ . આ હેતુ માટે, સંચાલક મંડળે, પોતે જે તારીખથી વર્ગોની સંખ્યા ઘટાડવા અથવા શાળા બંધ કરવા ધારતું હોય તે તારીખથી ઓછામાં ઓછા છ મહિના પહેલાં અધિકૃત અધિકારીને અરજી કરવાની રહેશે. આવી અરજી મળ્યે, અધિકૃત અધિકારી, પોતે જરૂરી ગણે તે રીતે , પોતાને જરૂરી લાગે તેવી તપાસ કરી શકશે અને અરજીને પૂર્ણતઃ અથવા અંશતઃ મંજૂર કરવાનો અથવા નામંજૂર કરવાનો નિર્ણય કરશે."

BOMBAY PRIMARY EDUCATION ACT, 1947.
No. KSH/ 19 /KHPS / 102002 /88 /CH : -WHEREAS , certain draft rules further to amend the Bombay Primary Education Rules, 1949 were published as required by sub - section(3 ) of section 63 of the Bombay Primary Education Act, 1947 (Bom . LXI of 1947) at pages 8 to 9 of the Gujarat Government Gazette , Part- I-A, Central Section , dated the 11th May, 2006 under the Government Notification , Education Department No. KSH/ 10 /KHPSH/ 102002/ 88 /CH dated the 27th April , 2006 inviting objections or suggestions from all persons likely to be affected thereby within thirty days from the date of publication of the said notification in the Official Gazette.
AND WHEREAS , no objections or suggestions have been received by the Government with respect to the said draft notification;
NOW, THEREFORE, in exercise of the powers conferred by sub - section( 1 ) of section 63 of the Bombay Primary Education Act, 1947 (Bom . LXI of 1947) , the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules , 1949 , namely: - 2006 1. These rules may be called the Bombay Primary Education (Gujarat Second Amendment) Rules ,
2. In the Bombay Primary Education Rules , 1949 , in rule 106(A), in sub - rule (4) , for clause ( v) , the following clause shall be substituted, namely: -
"(V) The rates of tuition fees , the pay scales and allowances of the teaching staff of grant - in - aid recognised privatę primary school shall be such as may be approved by the Government from time to time " .

LXI of 1947) at page 17 and 18 of the Gujarat Government Gazette , Part- I -A Central Section , dated the 28th September , 2006 under the Government Notification , Education Department No. KSH/ 18/KHPSH / 1004/ 1421 /CH . dated the 18th September , 2006 inviting objections and . suggestions from all persons likely to be affected thereby within thirty days from the date of publication in the Official Gazette, AND WHEREAS no objections or suggestions have been received by Government in respect of the said draft notification;
NOW THERFORE , in exercise of the powers conferred by section 63 of the Bombay Primary Education Act, 1947 (Bom . LXI of 1947) , the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules, 1949, namely : -
1. These rules may be called the Bombay Primary Education (Gujarat third Amendment) Rules , 2006 ..
2. In the Bombay Primary Education rules , 1949 , in SCHEDULE- F , for the existing condition 5 , the following shall be substituted, namely:-
"5. Closure of school or reduction in the total number of classes : -No management of recognised private primary school shall reduce the total number of classes in its school or close down the school without the prior permission in writing of the Authorised Officer . For this purpose , the management shall have to make an application to the Authorised Officer at least six months before the date from which it intends to reduce the number of classes or close down the school .. On receipt of such application , the Authorised Officer may in such manner as may be deemed.. necessary, make such inquiry as it may appear to be necessary and shall decide whether the application may be granted or refused either in whole or in part "
