NOTIFICATION

(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

No: AM/NJ/2025/228/LAQ/2024/Kheda/235/M:- Whereas it appears to the Government of Gujarat that the land specified in the SCHEDULE annexed here to likely to be needed for public purpose viz for the purpose of Construction for Narmada Canal's of Shahpur Mainor Narmada Project.

(1) Now therefore in exercise of the powers conferred by sub-section (i) of section 2 of the "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act-2013(30 OF 2013) (here in after referred to as "THE ACT") it is hereby notified that the Government of Gujarat intends to acquire the said Land for the public purpose of Construction for Shahpur Mainor of Narmada Project.

(2) Now whereas a proposal is made for acquisition of the above mentioned scheduled land for the purpose of Construction for Shahpur Mainor of Narmada Project. The bare minimum area of land to be acquired as per SCHEDULE for the project is H.0-41-07 Sq.mtr of Village-Shahpur, Taluka- Kathlal, District-Kheda.

(4) Now therefore in exercise of the power conferred by section 10(A) of the Act inserted by section-3 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act-2013 (Gujarat Amendment Act-2016) (Gujarat Act No 12 OF 2016) The Government of Gujarat hereby exempt in public interest to the area of H.0-41-07 Sq.mtr. land comprised in below mentioned SCHEDULE to be for Construction of Shahpur Mainor of Dampat Mainor of Narmada Project from the application of the provision of chapter II and III of the Act.

ક્રર્કં: અક/નજ/૨૦૨૫/૨૨૮/જસં/૨૦૨૪/ખેડા/૨૩૫/કઃ આ સાથેની અનુસૂચિમાં દકાાવવામાં આવેલ જમીનોની જાહેર હેતુ માટે એટલેર્ ે, નમાદા યોજનાની કાહપુર માઈનોર નહેરના બાંર્ધામ માટે જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાત સર્રારને જણાય છે.

૧. તેથી જમીન સંપાદન, પુનઃસ્થાપન અને પુનવાસવાટમાં વાજબી વળતર અને પારદકિાતાનો અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩ નો ૩૦મો) (જેનો આમાં હવે પછી - સદરહુ અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે)નીર્ લમ-૨(૧) અન્વયે ગુજરાત સર્રાર આથી ઉક્ત જમીનો ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેતુ ં માટેર્ ાયદાનુસાર સંપાદનર્ રવાનો ઈરાદો જાહેરર્ રે છે.

૨. હવે જ્યારે ઉક્ત અનુસૂચિત જમીનમાં સુચિત પ્રોજેક્ટ નમાદા યોજનાનીર્ ાણીયેલ ડીસ્રીની કાહપુર માઈનોર નહેરના બાંર્ધામ માટે જમીન સંપાદન માટેની દરખાસ્ત રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદનર્ રવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનો અનુસૂચિ મુજબનો ર્ુલ વિસ્તાર હે. ૦-૪૧-૦૭ ચો. મી છે, અને તે ખેડા જિલ્લાનાર્ ઠલાલ તાર્લુાના ગામ કાહપુરની હદમાં આવેલ છે.

૩. હવે જ્યારે, ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સદરહું સંપાદનર્ રવાની થતી ક્ષેત્રફળ વિસ્તાર હે. ૦-૪૧-૦૭ ચો. મી. જમીનને સદરહુ અધિનિયમ" ના પ્ર્રરણ-૨ અને ૩ ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હીતમાં આવશ્ર્ય જણાય છે.

૪. તેથી "સદરહુ અધિનિયમ" નીર્ લમ-૧૦(એ) (જમીન સંપાદન, પુનઃસ્થાપન અને પુનવાસવાટમાં વાજબી વળતર અને પારદકિાતાનો અર્ધિાર અધિનિયમ-૨૦૧૩) (ગુજરાત સુધારા અધિનિયમ-૨૦૧૬) (૨૦૧૬ નો ગુજરાત અધિનિયમ નં.૧૨નીર્ લમ-૩ થી દાખલર્ રેલ) થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રાર આથી જાહેર હિતમાં નમાદા યોજનાની કાહપુર માઈનોર નહેરના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદનર્ રવાની થતી નીચે જણાવેલ અનુસૂચિમાં સમાવિષ્ટ થયેલ ક્ષેત્રફળ વિસ્તાર હે. ૦-૪૧-૦૭ ચો. મી. જમીનને "સદરહું અધિનિયમ" ના પ્ર્રરણ-૨ અને ૩ ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
