(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation

Resettlement Act, 2013 (30 of 2013)

No: AM-M-2025-390-JPT-142025-974-GH:- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "Construction of Four lane bridge on Banas river on Chanasma–Radhanpur Road (SH-55) at between KM Ch. 6/0 to 7/0.".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "Construction of Four lane bridge on Banas river on Chanasma–Radhanpur Road (SH-55) at between KM Ch. 6/0 to 7/0." the bare minimum area of land to be acquired, for the Project is H.A. 00-51-21 Sq.mtr. and is situated within the boundary limit of: Village: Sabdalpura, Taluka: Radhanpur, Dist. Patan.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of H.A. 00-51-21 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the provision of chapter II and III of the Act. Patan to be acquired for the "Construction of Four lane bridge on

Banas river on Chanasma – Radhanpur Road (SH-55) at between KM Ch. 6/0 to 7/0." from the application of the provision of chapter II and III of The Act.

ક્રર્માં : અમ-મ-૨૦૨૫-૩૯૦-જપટ-૧૪૨૦૨૫-૯૭૪-ઘ:- "ચાણસ્મા–રાધનપુર રોડ (એસ.એચ. ૫૫) પર ચેઈનેજર્ ી.મી ૬/૦ થી ૭/૦ બનાસ નદી ઉપર નવા ચારમાગીય ચિજનુ ં નિમાાણર્ ાયા માટે"ના જાહેર હેતુના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાત સર્રારને જણાય છે.

(૧) તેથી જમીન સંપાદન, પુન:સ્થાપન અને પુનાવસનમાં વ્યાજબી વળતર અને પારદર્કાતા અર્ધિાર અધિનિયમ-૨૦૧૩) (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહં અધિનિયમ" તેમ ઉલ્લેખ ર્રવામાં આવેલ છે તે)ની ર્લમ-૨(૧) તથા તે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રાર આથી ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેતુ માટેર્ ાયદાનુસાર સંપાદનર્ રવાનો ઈરાદો જાહેરર્ રે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ ચાણસ્મા–રાધનપુર રોડ (એસ.એચ. ૫૫) પર ચેઈનેજર્ ી.મી ૬/૦ થી ૭/૦ બનાસ નદી ઉપર નવા ચાર માગીય ચિજનુ ં નિમાાણર્ ાયા માટેના જાહેર હેતુ માટે જમીન સંપાદન માટેની દરખાસ્ત રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદન ર્રવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનોર્ ુલ વિસ્તાર હે.આરે. ૦૦-૫૧-૨૧ ચો.મી. છે અને તે મોજે. સબ્દલપુરા તા. રાધનપુર જિ. પાટણની હદમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સદરહં સંપાદન ર્રવાની થતી ક્ષેત્રફળ હે.આરે. ૦૦-૫૧-૨૧ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિતમાં આવશ્ર્ય જણાય છે.

(૪) તેથી સદરહં અધિનિયમનીર્ લમ-૧૦(એ) (જમીન સંપાદન, પુન:સ્થાપન અને પુનાવસનમાં વ્યાજબી વળતર અને પારદર્કાતા (ગુજરાત સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાત અધિનિયમ-નં.૧૨)ની ર્લમ-૩થી દાખલ ર્રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિતમાં "ચાણસ્મા–રાધનપુર રોડ (એસ.એચ. ૫૫) પર ચેઈનેજર્ ી.મી ૬/૦ થી ૭/૦ બનાસ નદી ઉપર નવા ચાર માગીય ચિજનુ ં નિમાાણર્ ાયા માટેના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન થતી જમીનમાં સમાવિષ્ટ થયેલ મોજે. સબ્દલપુરા, તા. રાધનપુર જી. પાટણની ક્ષેત્રફળ હે.આરે. ૦૦-૫૧-૨૧ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
