(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

No: AM-M-2025-395-LSU-2025-970-GH:- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "Construction of R.O.B. with approach in lieu of L.C. No.27 at railway between station Tarsada-Kadod-Bardoli-Sarbhon-Navsari Road Road (k.m.33/100 to 75/000) in Gujrat (L.C. No.27) Project.".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "Construction of R.O.B. with approach in lieu of L.C. No.27 at railway between station Tarsada-Kadod-Bardoli-Sarbhon-Navsari Road Road (k.m.33/100 to 75/000) in Gujrat (L.C. No.27) Project." the bare minimum area of land to be acquired, for the Project is H.A. 0-44-60 Sq.mtr. and is situated within the boundary limit of: Village: Astan, Taluka: Bardoli, Dist. Surat.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of H.A. 0-44-60 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the provision of chapter II and III of the Act. I-B Ex.- 593 593-1 593-2 GUJARAT GOVERNMENT GAZETTE, EX., 23-06-2025 [ PART I-B (4) Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby exempt in public interest, the area of H.A. 0-44-60 Sq.mtr. land is situated within the boundary limit of: Village: Astan, Taluka: Bardoli, Dist. Surat to be acquired for the "Construction of R.O.B. with approach in lieu of L.C.

No.27 at railway between station Tarsada-Kadod-Bardoli-Sarbhon-Navsari Road Road (k.m.33/100 to 75/000) in Gujrat (L.C. No.27) Project." from the application of the provision of chapter II and III of The Act.

ક્રર્માં: અમ-મ-૨૦૨૫-૩૯૫-જસત-૨૦૨૫-૯૭૦-ઘ :- "તરસાડાર્-ડોદ-બારડોલી-સરભોણ-નવસારી રોડર્ ી.મી. ૩૩/૧૦૦ થી ૭૫/૦૦૦ રોડ ઉપર એલ.સી.૨૭ ઉપર રેલ્વે ઓવરચિજ (ROB) ના બાંર્ધામ માટે"ના જાહેર હેતુના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાત સર્રારને જણાય છે.

(૧) તેથી જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારદકર્નતા અર્ધિાર અધિનિયમ-૨૦૧૩) (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહં અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે) નીર્ લમ-૨(૧) તથા તે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રાર આથી ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેતુ માટેર્ ાયદાનુસાર સંપાદનર્ રવાનો ઈરાદો જાહેરર્ રે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ તરસાડાર્-ડોદ-બારડોલી-સરભોણ-નવસારી રોડર્ ી.મી.૩૩/૧૦૦ થી ૭૫/૦૦૦ રોડ ઉપર એલ.સી.૨૭ ઉપર રેલ્વે ઓવરચિજ (ROB) ના બાંર્ધામ માટેના જાહેર હેતુ માટે જમીન સંપાદન માટેની દરખાસ્ત રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદનર્ રવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનોર્ ુલ વિસ્તાર હે.આરે. ૦-૪૪-૬૦ ચો.મી. છે અને તે મોજે.અસ્તાન તા.બારડોલી જિ. સુરતની હદમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સદરહં સંપાદનર્ રવાની થતી ક્ષેત્રફળ હે.આરે. ૦-૪૪-૬૦ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિતમાં આવશ્ર્ય જણાય છે.

(૪) તેથી સદરહં અધિનિયમનીર્ લમ-૧૦(એ) (જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારદકર્નતા (ગુજરાત સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬ નો ગુજરાત અધિનિયમ-નં.૧૨)ની ર્લમ-૩થી દાખલ ર્રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિતમાં "તરસાડાર્-ડોદ-બારડોલી-સરભોણ-નવસારી રોડ ર્ી.મી. ૩૩/૧૦૦ થી ૭૫/૦૦૦ રોડ ઉપર એલ.સી.૨૭ ઉપર રેલ્વે ઓવરચિજ (ROB) ના બાંર્ધામ માટે ના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન થતી જમીનમાં સમાવિષ્ટ થયેલ મોજે. અસ્તાન, તા.બારડોલી જિ.સુરતની ક્ષેત્રફળ હે.આરે. ૦-૪૪-૬૦ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
