(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act, 2013) (30 of 2013)
District : Kachchh
No: AM-M-2025-406-LKU- 142025- 842-CH:- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "Deshalpar-Siracha road widening road".
(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.
(2) Now whereas a proposal is made for acquisition of the above-mentioned proposed project of "Deshalpar-Siracha road widening road" the bare minimum area of land to be acquired, for the Project is H.A. 1-96-14 Sq.mtr. and is situated within the boundary limit of: Village: Khakhar Moti, Taluka: Mundra, Dist. Kachchh.

Kachchh to be acquired for the "Deshalpar-Siracha road widening road"from the application of the provision of chapter II and III of The Act.

ક્રર્માં: અમ-મ-૨૦૨૫-૪૦૬-ર્જ-િ૧૪૨૦૨૫-૮૪૨-:િ- "દેશલપર-શિરાચા રોડ પહોળાર્ રવાનાર્ ામે"ના જાહેર હેતુના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાત સર્રારને જણાય છે.
(૧) તેથી જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારદશર્નતા અર્ધિાર અધિનિયમ-૨૦૧૩) (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહં અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે)નીર્ લમ-૨(૧) તથા તે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રાર આથી ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેતુ માટે ર્ાયદાનુસાર સંપાદન ર્રવાનો ઈરાદો જાહેર ર્રે છે.
(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ "દેશલપર-શિરાચા રોડ પહોળાર્ રવાનાર્ ામે"ના જાહેર હેતુ માટે જમીન સંપાદન માટેની દરખાસ્ત રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદનર્ રવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનોર્ ુલ વિસ્તાર હે. આરે. ૧-૯૬-૧૪ ચો. મી.
છે અને તે મોજે. ખાખર મોટી તા. મુન્રા જિ.ર્ ્િછની હદમાં આવેલ છે.
(૩) હવે જ્યારે ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સદરહં સંપાદનર્ રવાની થતી ક્ષેત્રફળ હે. આરે. ૧-૯૬-૧૪ ચો. મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિતમાં આવશ્ર્ય જણાય છે.
(૪) તેથી સદરહં અધિનિયમનીર્ લમ-૧૦(એ) (જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારદશર્નતા (ગુજરાત સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાત અધિનિયમ-નં.૧૨)ની ર્લમ-૩થી દાખલ ર્રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિતમાં "દેશલપર-શિરાચા રોડ પહોળા ર્રવાના ર્ામે"ના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન થતી જમીનમાં સમાવિષ્ટ થયેલ મોજે. ખાખર મોટી, તા. મુન્રા, જિ.ર્ ્િછની ક્ષેત્રફળ હે.આરે. ૧-૯૬-૧૪ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
