(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

No:- AM-M-2025-418-LKH-142025-852-CH:- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "CONSTRUTION OF RAILWAY OVER BRIDGE ON L.C.NO-56 GAROD-ANTISAR-DANADARA K.M.0/000 TO 14/000 ROAD".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "CONSTRUTION OF RAILWAY OVER BRIDGE ON L.C.NO-56 GAROD-ANTISAR-DANADARA K.M.0/000 TO 14/000 ROAD" the bare minimum area of land to be acquired, for the Project is H.A. 01-69-76 Sq.mtr. and is situated within the boundary limit of : Village: Kapadvanj, Taluka: Kapadvanj, Dist. Kheda.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of H.A. 01-69-76 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the provision of chapter II and III of the Act. I-B Ex.- 616 616-1 616-2 GUJARAT GOVERNMENT GAZETTE, EX., 24-06-2025 [ PART I-B (4) Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby exempt in public interest, the area of H.A. 01-69-76 Sq.mtr. land is situated within the boundary limit of : Village: Kapadvanj, Taluka: Kapadvanj, Dist. Kheda to be acquired for the "CONSTRUTION OF RAILWAY OVER

BRIDGE ON L.C.NO-56 GAROD-ANTISAR-DANADARA K.M.0/000 TO 14/000 ROAD" from the application of the provision of chapter II and III of The Act.

ક્રર્માં: અમ-મ-૨૦૨૫-૪૧૮-જખડ-૧૪૨૦૨૫-૮૫૨-:િ- "ગરોડ-અંચિસર-દનાદરા રોડ ર્ી.મી. ૦/૦૦૦ થી ૧૪/૦૦૦ રોડ ઉપર એલ.સી:૫૬ ઉપર રેલ્વે ઓવર ચિજ"ના જાહેર હેચુના આંચરમાળર્ખાીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાચ સર્રારને જણાય છે.

(૧) ચેથી જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળચર અને પારદકર્નચા અર્ધિાર અધિનિયમ-૨૦૧૩) (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહં અધિનિયમ" ચેમ ઉલ્લેખર્ રવામાં આવેલ છે ચે) નીર્ લમ-૨(૧) ચથા ચે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુજરાચ સર્રાર આથી ઉપરોક્ત આંચરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેચુ માટેર્ ાયદાનુસાર સંપાદનર્ રવાનો ઈરાદો જાહેરર્ રે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિચ પ્રોજેક્ટ "ગરોડ-અંચિસર-દનાદરા રોડર્ ી.મી. ૦/૦૦૦ થી ૧૪/૦૦૦ રોડ ઉપર એલ.સી:૫૬ ઉપર રેલ્વે ઓવર ચિજ"ના જાહેર હેચુ માટે જમીન સંપાદન માટેની દરખાસ્ચ રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદનર્ રવાની થચી ઉપરોક્ત ઓછામાં ઓછી જમીનનોર્ ુલ વિસ્ચાર હે.આરે. ૦૧-૬૯-૭૬ ચો.મી. છે અને ચે મોજે.ર્ પડવંજ, ચા.ર્ પડવંજ, જિ. ખેડાની હદમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંચરમાળર્ખાીય પ્રોજેક્ટ માટે સદરહં સંપાદનર્ રવાની થચી ક્ષેત્રફળ હે.આરે. ૦૧-૬૯-૭૬ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિચમાં આવશ્ર્ય જણાય છે.

(૪) ચેથી સદરહં અધિનિયમનીર્ લમ-૧૦(એ) (જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળચર અને પારદકર્નચા (ગુજરાચ સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાચ અધિનિયમ-નં.૧૨)નીર્ લમ-૩થી દાખલર્ રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિચમાં "ગરોડ-અંચિસર-દનાદરા રોડર્ ી.મી. ૦/૦૦૦ થી ૧૪/૦૦૦ રોડ ઉપર એલ.સી:૫૬ ઉપર રેલ્વે ઓવર ચિજ" ના આંચરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન થચી જમીનમાં સમાવિષ્ટ થયેલ મોજે.ર્ પડવંજ, ચા.ર્ પડવંજ, જિ.ખેડા ની ક્ષેત્રફળ હે.આરે. ૦૧-૬૯-૭૬ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
