(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation

and Resettlement Act, 2013) (30 of 2013)

District :- Ahmedabad

No:- AM-M-2025-893-LAM-1225-1174-CH: 1. In exercise of the powers conferred by sub-section (1) of section-11 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as "The Act") the Government of Gujarat hereby declares that the land/lands mentioned in the Schedule annexed hereto is/are required for the purpose of "Bhimnath-Dholera Rail Line Project";

2. It is notified that,

1. The area of land/lands required for the above project is 1929 Sq.mtr. and is at- Sodhi Village of Dholera Taluka of Ahmedabad District;

2. The public purpose involved in the above project is construction of infrastructure of "Bhimnath-Dholera Rail Line Project".

3. The reasons necessitating the displacement of the affected persons are:

Under Section 10A of the Act, inserted by the Gujarat Act of 12 of 2016, exemption is given vide Government of Gujarat, Revenue Department Notification No.AM-M-2025-736-LAM-1225-1174-CH, Date:07/10/2025 that, it is not required the Social Impact Assessment Study Report.

5. The Particulars of the Administrator appointment under section 43 of the act are as under – Additional Special Land Acquisition Officer, Ahmedabad.

3. All the persons interested in these lands are hereby notified not to obstruct and disturb any Surveyor of other staff to enter upon and survey the land Any transactions in respect of whole or part of these lands in whatsoever manner including by sale, lease, mortgage, change of name, exchange entered into after the date of this Notification made without permission of the Collector shall not be taken into consideration by the officer assessing the compensation under section 27 of the Act for a particular portion of the land as may be finally acquired.

4. The Government of Gujarat, if satisfied about acquisition of the land for aforesaid public purpose, may publish final declaration under section 19 of the Act in this regard in the manner and timeframe so prescribed under the Act. In case the acquisition is dropped partially or entirely, such fact shall be notified in a proper manner as provided under the Act.

5. Read with Gujarat Government Extra Ordinary Gazette Part-IV dated 12 August, 2016 The Gujarat Act No.12 of 2016 and Under Clause-1 of Section-3G of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) the Government of Gujarat pleased to appoint Additional Special Land Acquisition Officer, Ahmedabad who may for the time being in Charge of Dholera Taluka to Perform the function of a Collector in respect of the said lands.

6. Objection to the acquisition, if any may be field by the person interested within 60 (sixty Days) from the date of publication of this notification as provided under section-15 of the ACT before the Additional Special Land Acquisition Officer, Ahmedabad.

વ્યાજબી વળતર અને પારદકર્નતા અર્ધિાર અધિનિયમ-ર૦૧૩ (ર૦૧૩નો ૩૦મો) (હવે ૫છી તેનો ઉલ્લેખ ''અધિનિયમ'' તર્રીે ર્રવામાં

આવકે) ની ર્લમ-૧૧ ની પેટા ર્લમ (૧) હેઠળ મળેલ સત્તાનો ઉ૫યોગ ર્રીને ગુજરાત સર્રાર આથી જાહેર ર્રે છે ર્ે, આ સાથે જોચેલ

અનુસૂચિમાં દકાનવવામાં આવેલ જમીનની જાહેર હિતમાં, "ભીમનાથ-ધોલેરા રેલ લાઇન પ્રોજેક્ટ"ના જાહેર હેતુ માટે સંપાડદતર્ રવાની જરૂર છે.

ર. આથી જાહેરર્ રવામાં આવે છેર્ ે,

(૧) ઉ૫ર જણાવેલ પ્રોજેક્ટ માટે જરૂરી જમીન ૧૯૨૯ ચો.મી. છે. અને તે અમદાવાદ જિલ્લાના ધોલેરા તાર્લુાના સોઢી ગામમાં

આવેલ છે.

(ર) ઉ૫ર જણાવેલ પ્રોર્જેટમાં નીચે મુજબના જાહેર હિતનો સમાવેક થાય છે.

''ભીમનાથ-ધોલેરા રેલ લાઇન પ્રોજેક્ટ''

(૩) અસરગ્રસ્ત વ્યચિઓને ખસેચવાની જરૂરનાર્ ારણો નીચે મુજબ છે.

(૪) ગુજરાત અધિનિયમ-૧૨/૨૦૧૬ થી દાખલર્ રેલર્ લમ-૧૦(એ) હેઠળ મહેસૂલ વિભાગ, ગુજરાત સર્રારના જાહેરનામા ક્રર્માં : અમ-મ-૨૦૨૫-૭૩૬-જઅમ-૧૨૨૫-૧૧૭૪-ચ તા.૦૭/૧૦/૨૦૨૫ થી મુર્ડત આ૫વામાં આવેલ છે. આથી, ર્ઉત અધિનિયમનીર્ લમ-૧૦(એ) હેઠળ સામાર્જિ અસરોના મૂલર્યાંનનો સંચિપ્ત અહેવાલ આ૫વો જરૂરી નથી.

(પ) અધિનિયમનીર્ લમ-૪૩ હેઠળ નિર્યુતર્ રવામાં આવેલ વહીવટદારની વિગતો નીચે મુજબ છે.

વધારાના ખાસ જમીન સંપાદન અર્ધિારીશ્રી, અમદાવાદ

૩. આ જમીનોમાં હિત ધરાવતી તમામ વ્યચિઓને આથી જાણર્ રવામાં આવે છેર્ ે,ર્ ોઇ૫ણ સવેયરને અથવા અન્યર્ મનચારીઓને આ જમીન ૫ર દાખલ થવા અને જમીનનો સવેર્ રતા અર્ટાવવા નહિચં. આ જાહેરનામુ ં બહાર ૫ચયા બાદ,ર્ લેક્ટરશ્રીની ૫રવાનગી વગર આ જમીનની ર્ે તેના ર્ોઇ ભાગની ર્ોઇ૫ણ સ્વરૂપે તબદીલી જેમાં વેચાણ, ભાચા૫ટે ેૃ આ૫વી, ગીરવે ર્મૂવી, નામ બદલવુ ં અથવા નોંઘણીમાં ફેરફારર્ રવા નહીં. જો તેમર્ રવામાં આવે તો અધિનિયમનીર્ લમ-ર૭ હેઠળ જમીન સંપાદન વખતે વળતરનુ ં મૂલર્યાંનર્ રતી વખતે આવા ફેરફાર ૫ર વિચારણાર્ રવામાં નહીં આવે.

૪. ગુજરાત સર્રારને જો ઉ૫ર જણાવેલ જાહેર હેતુ માટે જમીન સંપાદન ર્રવા અંગે સંતોષ થકે તો, અધિનિયમની ર્લમ-૧૯ હેઠળ અધિનિયમમાં નિયત ર્રેલ સમયમયાનદાની અંદર અને તેમાં જણાવેલી રીતે આખરી જાહેરનામુ

ં ં બહાર પાચકે. જો સંપાદન ર્રવાનુ આંર્કિ રીતે અથવા પૂરેપૂરી રીતે રદર્ રવામાં આવે, તો આવી હર્ર્ડત, અધિનિયમની જોગવાઇ મુજબ યોગ્ય રીતે જાહેરર્ રવાની રહેકે.

૫. જમીન સંપાદન, પુન:સ્થા૫ન અને પુનનવસવાટ અધિનિયમમાં વ્યાજબી વળતર અને પારદકર્નતા અર્ધિાર અધિનિયમ-ર૦૧૩ (ર૦૧૩નો ૩૦મો) નીર્ લમ-૩(જ) હેઠળ મળેલ સત્તાની રૂએ, રાજ્ય સર્રાર, આ જમીનોના સબંઘમાં આ અધિનિયમની જોગવાઇઓ હેઠળ ર્ાયન ર્રવા અને ફરજો બજાવવા માટે વધારાના ખાસ જમીન સંપાદન અર્ધિારીશ્રી, અમદાવાદને ધોલેરા તાર્લુા માટે જમીન સંપાદન અર્ધિારી તર્રીે નીમે છે.

૬. આ જાહેરનામા પ્રસિચિની તારીખથી ૬૦ (સાઇઠ) ડદવસની અંદર આ અધિનિયમનીર્ લમ-૧૫ મુજબ સંપાદન બાબતે હિત ધરાવતી વ્યચિને જોર્ ોઇ વાંધો હોય તો તેઓર્ લમ-૧૫ હેઠળ વધારાના ખાસ જમીન સંપાદન અર્ધિારીશ્રી, અમદાવાદને રજૂઆતર્ રી ર્કકે.
