No: AM-M-2025-898-LGS-1424-820-CH: Whereas it appears to the Government of Gujarat that, the land specified in the SCHEDULE annexed hereto, is likely to be required to "Executive Engineer, Road and Building (State) Division, Veraval Gir Somnath" (hereinafter referred to as "The Requiring Body") for the public purpose for construction of infrastructure project of "Widening and Strengthening of Sutrapada-Dhamlej Road" (hereinafter referred to as "The Public Purpose Project").

1. Now whereas, the Government of Gujarat, Revenue Department has, in exercise of the powers conferred, by section 10A [inserted by section 3 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Gujarat Amendment) Act, 2016(Gujarat Act No. 12 of 2016)] of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as "The Act") exempted, in public interest, by Notification No.AM-M-2024-380-LGS-1424- 820-CH, dated:25/07/2024, published in the Extraordinary Gazette of Gujarat Government, the below mentioned Scheduled area of land, to be acquired for the infrastructure project of the construction of "Widening and Strengthening of Sutrapada-Dhamlej Road" from the application of the provisions of Chapter II and III of The Act, and

Now whereas, in exercise of the powers, conferred by sub-section (1) of section 43 of The Act, The Government of Gujarat has appointed, Deputy Collector, Veraval as the officer of Rehabilitation and Resettlement in respect of the scheduled land to be acquired for construction of the captioned infrastructure project, and

3. Now whereas, in exercise of the powers conferred by sub-section (1) of section 11 of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as The Act), the Government of Gujarat, has notified, vide Notification No. AM-M-2024- 724-LGS-1424-820-CH, dated:30/12/2024 that the said scheduled land is required for the public purpose specified here above,

4. And whereas, the Government of Gujarat is satisfied after considering the report made by Deputy Collector, Veraval under sub-section (2) of section 15 of The Act, that the said land is needed to be acquired for "The Public Purpose Project" specified in the schedule hereto, and

5. Now therefore, in exercise of the powers conferred by sub-section (1) of section 19 of The Act, the Government of Gujarat hereby declares that the said scheduled land is required for the public purpose specified in the schedule hereto.

6. In exercise of the powers conferred by clause (g) of section -3 of The Act, the Government of Gujarat hereby appoints, Deputy Collector, Veraval to perform the functions of a Collector, for all proceeding hereinafter to be carried out under The Act, in respect of the said scheduled lands.

7. The Plans of scheduled lands can be inspected at the Office of Deputy Collector, Veraval.

8. Now whereas, it appears to the Government of Gujarat, that below mentioned lands indicated against Serial Number of SCHEDULE appended with the Government Notification No AM-M-2024-724-LGS-1424-820-CH, dated:30/12/2024 are not required for the aforesaid Public Purpose Project, the Government of Gujarat hereby, abandons acquisition of these lands for the aforesaid "Public Purpose Project" and notifies cancellation of the captioned Notification in Context to the below mentioned serial numbered lands.

ક્રર્માં નં. અમ-મ-૨૦૨૫-૮૯૮-જગસ-૧૪૨૪-૮૨૦-:િ આ સાથે સામેલ અનુસૂચિમાં દકાાવવામાં આવેલ જમીનની જાહેર હેતુ માટે એટલે ર્ે, "સુત્રાપાચા-ધામળેજ રોચ પહોળો અને મજબૂત બનાવવા" (જેનો આમાં હવે પછી જાહેર હેતુની યોજના એમ ઉલ્લેખર્ રવામાં આવેલ છે તે) ના આંતરમાળર્ખાીય પ્રોજેક્ટના બાંર્ધામ માટે ર્"ાયાપાર્લ ઇજનેરશ્રી, માગા અને ર્માન (રાજ્ય) વિભાગ, વેરાવળ ગીર સોમનાથ" (જેનો આમાં હવે પછી સંપાર્દ સંસ્થા એમ ઉલ્લેખર્ રવામાં આવેલ છે તે) ને જરૂર પચવાનો સંભવ છે એવુ ં ગુજરાત સર્રારને જણાય છે.

(૧) હવે જયારે ગુજરાત સર્રારના અસાધારણ રાજ્યપત્રમાં પ્રસિધ્ધ થયેલ મહેસૂલ વિભાગના જાહેરનામા ક્રર્માંઃ-અમ-મ-૨૦૨૪-૩૮૦- જગસ-૧૪૨૪-૮૨૦-ચ તા.૨૫/૦૭/૨૦૨૪થી ગુજરાત સર્રારે જમીન સંપાદન પુન:સ્થાપન અને પુનવાસનમાં વ્યાજબી વળતર અને પારદકિાતા અર્ધિાર અધિનિયમ-૨૦૧૩(૨૦૧૩ નો ૩૦ મો) (જેનો આમાં હવે પછી સદરહુ અધિનિયમ તેમ ઉલ્લેખર્ રવામાં આવેલ છે) તેનીર્ લમ-૧૦(એ) [(જમીન સંપાદન પુનઃસ્થાપન અને પુનવાસનમાં વાજબી વળતર અને પારદકિાતા અર્ધિાર (ગુજરાત સુધારો) અધિનિયમ-૨૦૧૬) (૨૦૧૬ના ગુજરાત અધિનિયમ નં-૧૨ નીર્ લમ-૩ થી દાખલર્ રેલ)] થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રારે જાહેર હિતમાં "સુત્રાપાચા-ધામળેજ રોચ પહોળો અને મજબૂત બનાવવા"ના જાહેર હેતુ માટેના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન ર્રવાની નીચે જણાવેલ અનુસૂચિ ક્ષેત્રફળની જમીનને, 'સદરહુ અધિનિયમ'ના પ્ર્રરણ-૨ અને ૩ જોગવાઈઓની અમલવારી માંથી મુચિ આપેલ છે. અને

(૨) હવે જયારે રાજ્ય સર્રારે સદરહુ અધિનિયમનીર્ લમ-૪૩(૧) મુજબ નાયબર્ ર્લેટરશ્રી, વેરાવળને ઉલ્લેખિત આંતરમાળર્ડય પ્રોજેક્ટના બાંર્ધામ માટેની અનુસૂચિત વિસ્તારની જમીનના સંપાદનના સંબંધમાં પુનઃસ્થાપન અને પુનઃવસનના અર્ધિારી તર્રીે નિમર્ણૂર્ રેલ છે, અને

(૩) હવે જ્યારે જમીન સંપાદન પુનઃસ્થાપન અને પુનવાસનમાં વાજબી વળતર અને પારદકિાતા અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો હવે પછી સદરહુ અધિનિયમ તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે) નીર્ લમ-૧૧ ની પેટાર્ લમ-(૧) થી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રારે જાહેરનામા ક્રર્માં: અમ-મ-૨૦૨૪-૭૨૪-જગસ-૧૪૨૪-૮૨૦-ચ તા.૩૦/૧૨/૨૦૨૪ થી ઉચ જમીન, ઉપરોચ સાવાજર્નિ હેતુ માટે જરૂરી છે, તેમ જાહેરર્ રેલ છે, અને

(૪) હવે જયારે સદરહુ અધિનિયમનીર્ લમ-૧૫ની પેટાર્ લમ-૨ નીચેના નાયબર્ ર્લેટરશ્રી, વેરાવળના અહેવાલને વિચારણામાં લીધા બાદ રાજ્ય સર્રારને એવો સંતોષ થયેલ છેર્ ે, સદરહુ અનુસૂચિત જમીનો સદરહુ જાહેર હેતુની યોજના માટે જરૂરી છે, અને

(૫) તેથી હવે, "સદરહુ અધિનિયમ"નીર્ લમ-૧૯(૧) થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રાર આથી સત્તાવાર જાહેરાતર્ રે છેર્ ે, સદરહુ અનુસુચિત જમીનો સદરહુ જાહેર હેતુની યોજના માટે જરૂરી છે.

(૬) ગુજરાત સર્રાર સદરહુ અધિનિયમનીર્ લમ-૩(જ) થી મળેલ સત્તા અન્વયે, ઉચ જમીનના સંબંધમાં સદરહુ અધિનિયમ નીચે હવે પછી ર્ર્લેટર તર્રીેર્ રવાના તમામર્ ાયો બજાવવા માટે, નાયબર્ ર્લેટરશ્રી, વેરાવળની નિમર્ણૂર્ રેલ છે.

(૭) સદરહુ અનુસૂચિત જમીનના ર્નકા, નાયબર્ ર્લેટરશ્રી, વેરાવળનીર્ ચેરી ખાતે તપાસી ર્કાકે.

(૮) તા.૩૦/૧૨/૨૦૨૪ ના સર્રારી જાહેરનામા ક્રર્માં:અમ-મ-૨૦૨૪-૭૨૪-જગસ-૧૪૨૪-૮૨૦-ચ સાથેની અનુસૂચિમાં નીચેની વિગતે અનુક્રમ નંબર સામે દકાાવેલ જમીન, ઉપર જણાવેલ જાહેર હેતુ માટે જરૂરી નથી તેમ ગુજરાત સર્રારને આથી જણાય છે. તેથી તે જમીનોનુ ં ઉપર દકાાવેલ હેતુ માટેનુ સંપાદન આથી પચતુ ર્મુવામાં આવે છે. અને ગુજરાત સર્રાર એવુ ં ફરમાવે છેર્ ે ર્ઉત અનુક્રમવાળી નીચે દકાાવેલ જમીનના સંબંધમાં તત્પુરતુ જાહેરનામુ ં રદ થકે.
