The Right to Fair Compensation and transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013

No. AM-M-2025-899-LMS-1425-1104-CH: 1. In exercise of the powers conferred by sub-section (1) of section-11 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as "The Act") the Government of Gujarat hereby declares that the land/lands mentioned in the Schedule annexed hereto is/are required for the purpose of "Construction of the Godhra-Lunawada- Santrampur Conneccting State Highway to be converted into Santrampur Bypass (four-lane) Road".

2. It is notified that,

(1) The area of land/lands required for the above project is 3318 Sq.Mtr. and is at- Malanpur Village of Santrampur Taluka of Mahisagar District;

(2) The public purpose involved in the above project is construction of infrastructure of:

"Construction of the Godhra-Lunawada-Santrampur Conneccting State Highway to be converted into Santrampur Bypass (four-lane) Road "

(3) The reasons necessitating the displacement of the affected persons are:

1163-11163-2 GUJARAT GOVERNMENT GAZETTE, EX., 23-12-2025 [ PART I-B (4) Under Section 10A of the Act, inserted by the Gujarat Act of 12 of 2016, exemption is given vide Government of Gujarat, Revenue Department Notification No.AM-M-2025-662-LMS-1425-1104-CH, Date:15/09/2025 that, it is not required the Social Impact Assessment Study Report.

(5) The Particulars of the Administrator appointment under section 43 of the act are as under– Special Land Acquisition Officer, Mahisagar Lunawada.

3. All the persons interested in these lands are hereby notified not to obstruct and disturb any Surveyor of other staff to enter upon and survey the land Any transactions in respect of whole or part of these lands in whatsoever manner including by sale, lease, mortgage, change of name, exchange entered into after the date of this Notification made without permission of the Collector shall not be taken into consideration by the officer assessing the compensation under section 27 of the Act for a particular portion of the land as may be finally acquired.

4. The Government of Gujarat, if satisfied about acquisition of the land for aforesaid public purpose, may publish final declaration under section 19 of the Act in this regard in the manner and timeframe so prescribed under the Act. In case the acquisition is dropped partially or entirely, such fact shall be notified in a proper manner as provided under the Act.

5. Read with Gujarat Government Extra Ordinary Gazette Part-IV dated 12 August, 2016 The Gujarat Act No.12 of 2016 and Under Clause-1 of Section-3G of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) the Government of Gujarat pleased to appoint Special Land Acquisition Officer, Mahisagar Lunawada who may for the time being in Charge of Santrampur Taluka to Perform the function of a Collector in respect of the said lands.

6. Objection to the acquisition, if any may be field by the person interested within 60 (sixty Days) from the date of publication of this notification as provided under section-15 of the ACT before the Special Land Acquisition Officer, Mahisagar Lunawada.

પેટાર્ લમ (૧) હેઠળ મળેલ સત્તાનો ઉ૫યોગર્ રીને ગુજરાત સર્રાર આથી જાહેરર્ રે છેર્ ે, આ સાથે જોચેલ અનુસૂચિમાં દકાનવવામાં આવેલ

જમીનની જાહેર હિતમાં, ર્"ન્સ્ટસ્ર્રકન ઑફ ગોધરા-લુણાવાચા–સંતરામપૂરને જોચતા રાજ્ય ધોરીમાગનને સંતરામપૂર બાયપાસ (ચાર માગીય) રોચ

બનાવવા" ના જાહેર હેતુ માટે સંપાડદતર્ રવાની જરૂર છે.

ર. આથી જાહેરર્ રવામાં આવે છેર્ ે,

(૧) ઉ૫ર જણાવેલ પ્રોજેક્ટ માટે જરૂરી જમીન ૩૩૧૮ ચો.મી. છે. અને તે મહીસાગર જિલ્લાના સંતરામપૂર તાર્લુાના માલણપૂર ગામમાં આવેલ છે.

(ર) ઉ૫ર જણાવેલ પ્રોજેક્ટમાં નીચે મુજબના જાહેર હિતનો સમાવેક થાય છે.

ર્"ન્સ્ટસ્ર્રકન ઑફ ગોધરા-લુણાવાચા–મોચાસાને જોચતા રાજ્ય ધોરીમાગનને લુણાવાચા બાયપાસ (ચાર માગીય) રોચ બનાવવા'' (૩) અસરગ્રસ્ત વ્યચિઓને ખસેચવાની જરૂરનાર્ ારણો નીચે મુજબ છે :

લાગુ ૫ચતુ નથી.

(૪) ગુજરાત અધિનિયમ-૧૨/૨૦૧૬ થી દાખલર્ રેલર્ લમ-૧૦(એ) હેઠળ મહેસૂલ વિભાગ, ગુજરાત સર્રારના જાહેરનામા ક્રર્માં: અમ-મ-૨૦૨૫-૬૬૨-જમસ-૧૪૨૫-૧૧૦૪-ચ તા.૧૫/૦૯/૨૦૨૫થી મુચિ આ૫વામાં આવેલ છે. આથી, ઉચ અધિનિયમનીર્ લમ-૧૦(એ) હેઠળ સામાર્જિ અસરોના મૂલર્યાંનનો સંચિપ્ત અહેવાલ આ૫વો જરૂરી નથી.

(પ) અધિનિયમનીર્ લમ-૪૩ હેઠળ નિર્યુતર્ રવામાં આવેલ વહીવટદારની વિગતો નીચે મુજબ છે :

ખાસ જમીન સંપાદન અર્ધિારીશ્રી, મહીસાગર લુણાવાચા.

ેૃ આ૫વી, ગીરવે ર્મૂવી, નામ બદલવુ ૩. આ જમીનોમાં હિત ધરાવતી તમામ વ્યચિઓને આથી જાણર્ રવામાં આવે છેર્ ે,ર્ ોઇ૫ણ સવેયરને અથવા અન્સ્ટયર્ મનચારીઓને આ ં બહાર ૫ચયા બાદ,ર્ લેક્ટરશ્રીની ૫રવાનગી વગર ં અથવા ં મૂલર્યાંનર્ રતી જમીન ૫ર દાખલ થવા અને જમીનનો સવેર્ રતા અર્ટાવવા નહિચં. આ જાહેરનામુ આ જમીનની ર્ે તેના ર્ોઇ ભાગની ર્ોઇ૫ણ સ્વરૂપે તબદીલી જેમાં વેચાણ, ભાચા૫ટે નોંધણીમાં ફેરફારર્ રવા નહીં. જો તેમર્ રવામાં આવે તો અધિનિયમનીર્ લમ-ર૭ હેઠળ જમીન સંપાદન વખતે વળતરનુ વખતે આવા ફેરફાર ૫ર વિચારણાર્ રવામાં નહીં આવે.

૪. ગુજરાત સર્રારને જો ઉ૫ર જણાવેલ જાહેર હેતુ માટે જમીન સંપાદન ર્રવા અંગે સંતોષ થકે તો, અધિનિયમની ર્લમ-૧૯ હેઠળ અધિનિયમમાં નિયત ર્રેલ સમયમયાનદાની અંદર અને તેમા જણાવેલી રીતે આખરી જાહેરનામુ ં ં બહાર પાચકે. જો સંપાદન ર્રવાનુ આંર્કિ રીતે અથવા પૂરેપૂરી રીતે રદર્ રવામાં આવે, તો આવી ર્ર્હીત, અધિનિયમની જોગવાઇ મુજબ યોગ્ય રીતે જાહેરર્ રવાની રહેકે.

૫. જમીન સંપાદન, પુન:સ્થા૫ન અને પુનનવસવાટ અધિનિયમમાં વ્યાજબી વળતર અને પારદકર્નતા અર્ધિાર અધિનિયમ-ર૦૧૩ (ર૦૧૩નો ૩૦મો) નીર્ લમ-૩(જ) હેઠળ મળેલ સત્તાની રૂએ, રાજ્ય સર્રાર, આ જમીનોના સંબંધમાં આ અધિનિયમની જોગવાઇઓ હેઠળ ર્ાયન ર્રવા અને ફરજો બજાવવા ખાસ જમીન સંપાદન અર્ધિારીશ્રી, મહીસાગર લુણાવાચાને સંતરામપૂર તાર્લુા માટે જમીન સંપાદન અર્ધિારી તર્રીે નીમે છે.

૬. આ જાહેરનામા પ્રસિચિની તારીખથી ૬૦ (સાઇઠ) ડદવસની અંદર આ અધિનિયમનીર્ લમ-૧૫ મુજબ સંપાદન બાબતે હિત ધરાવતી વ્યચિને જોર્ ોઇ વાંધો હોય તો તેઓર્ લમ-૧૫ હેઠળ ખાસ જમીન સંપાદન અર્ધિારીશ્રી, મહીસાગર લુણાવાચાને રજૂઆતર્ રી ર્કકે.
