No. AM-M-2025-902-LBN-142024-1274-CH: Whereas, it appears to the Government of Gujarat that, the land specified in the 'SCHEDULE' annexed here to is likely to be required for the public purpose of infrastructure project of construction of "Palitana Bypass Road (from Malpara Village to the outskirt of Luvarvav Village, after Jamvali village by passing Kharo dam near moti paniyali village-SH-31)" (Hereinafter referred to as "The Requiring Body")

(1) Now whereas the Government of Gujarat, Revenue Department has in exercise of the powers conferred by section-10(A) (inserted by section-3 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement(Gujarat Amendment) (Act,2016 (Gujarat Act No.12 of 2016)) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act,2013 (No.30 of 2013) (herein after referred to as " The Act") exempted, in public interest, by Notification No:-AM-M-2024-616- LBN-142024-1274-CH Date:15/10/2024 published in the Extraordinary Gazette of Gujarat Government Date:

17/10/2024 the below mentioned Scheduled area of land, to be acquired for the infrastructure project of "Palitana Bypass Road (from Malpara Village to the outskirt of Luvarvav Village, after Jamvali village by passing Kharo dam near moti paniyali village-SH-31)"; from the application of the provisions of chapter II and III of The Act, and

1166-11166-2 GUJARAT GOVERNMENT GAZETTE, EX., 23-12-2025 [ PART I-B (2) Now whereas, in exercise of the powers, conferred by sub-section (1) of section 43 of the Act. The Government of Gujarat has appointed, The Land Acquisition officer & Deputy Collector Palitana as the officer of Rehabilitation and Resettlement in respect of the scheduled land to be acquired for construction of the captioned infrastructure project, and

(3) Now whereas, in Exercise of the power conferred by sub-section (1) of section 11 of "Right to Fair Compensation and Transparency in Land Acquisition, Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as the Act.) The Government of Gujarat, has notified, vide their Notification. No. AM-M-2024-720-LBN- 142024-1274-CH, Date: 24/12/2024 that the said scheduled land is required for the public purpose specified here above.

(4) And whereas, the Government of Gujarat is satisfied after considering the report made the Land Acquisition officer & Deputy Collector Palitana under sub-section (2) of section-15 of The Act, that the said land is needed to be acquired for "The Public Purpose Project" specified in the schedule hereto, and

(5) Now there for, in exercise of the powers conferred by sub-section (1) of section-19 of The Act. The Government of Gujarat hereby declares that the said scheduled land is required for the public purpose specified in the schedule hereto.

(6) In exercise of the powers conferred by clause (g) of section-3 of The Act, the Government of Gujarat hereby appoints, The Land Acquisition officer & Deputy Collector Palitana to perform the function of a collector, for all proceeding here in after to be carried out under The Act, in respect of the said scheduled Lands.

(7) The Plans of scheduled lands can be inspected at the Office of the Land Acquisition officer & Deputy Collector Palitana.

(8) Now Whereas, it appears to the Government of Gujarat, that below mentioned lands indicated against serial number of Schedule appended with the Government Notification No.AM-M-2024-720-LBN-142024-1274-CH dated 24/12/2024 are not required for the aforesaid public purpose Project, the Government of Gujarat hereby, abandons acquisition of these lands for the aforesaid "Public purpose Project"CENTRAL SECTION ] GUJARAT GOVERNMENT GAZETTE, EX., 23-12-2025 1166-3

ક્રર્માં: અમ-મ-૨૦૨૫-૯૦૨-જભચ-૧૪૨૦૨૪-૧૨૭૪-:િ આ સાથે સામેલ અનુસૂચિમાં દકાાવવામાં આવેલ જમીનની જાહેર હેતુ માટે એટલેર્ ે, "પાલીતાણા બાયપાસ (માલપરા ગામ પાસેથી લુવારવાવ ગામની બહાર થઈને જામવાળી ગામ બાદ ખારો ચેમને બાયપાસર્ રી મોટી પાણીયાળી ગામ પાસે) (એસ.એચ.૩૧) પ્રોજેક્ટ''(જેનો આમાં હવે પછી "જાહેર હેતુની યોજના" એમ ઉલ્લેખ ર્રવામાં આવેલ છે તે) ના બાંર્ધામ માટે જરૂર પચવાનો સંભવ છે એવુ ં ગુજરાત સર્રારને જણાય છે.

૧) હવે જ્યારે તા.૧૭/૧૦/૨૦૨૪ના રોજ ગુજરાત સર્રારના અસાધારણ રાજ્યપત્રમાં પ્રસિદ્ધ થયેલ મહેસૂલ વિભાગના જાહેરનામાં ક્રર્માં:અમ-મ-૨૦૨૪-૬૧૬-જભવ-૧૪૨૦૨૪-૧૨૭૪-ચ, તા.૧૫/૧૦/૨૦૨૪ થી ગુજરાત સર્રારે "જમીન સંપાદન, પુન:સ્થાપન અને પુનવાસનમાં વ્યાજબી વળતર અને પારદકિાતા અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેમાં આમાં હવે પછી "સદરહં અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે) તેનીર્ લમ-૧૦(એ) ((જમીન સંપાદન, પુન:સ્થાપન અને પુનવાસનમાં વાજબી વળતર અને પારદકિાતા અર્ધિાર(ગુજરાત સુધારો) અધિનિયમ-૨૦૧૬) (૨૦૧૬ ના ગુજરાત અધિનિયમ નં.૧૨ ની ર્લમ-૩ થી દાખલ ર્રેલ)) થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રારે જાહેર હિતમાં પાલીતાણા બાયપાસ (માલપરા ગામ પાસેથી લુવારવાવ ગામની બહાર થઈને જામવાળી ગામ બાદ ખારો ચેમને બાયપાસર્ રી મોટી પાણીયાળી ગામ પાસે) (એસ.એચ.૩૧) પ્રોજેક્ટના બાંર્ધામ માટે સંપાદન ર્રવાની નીચે જણાવેલ અનુસૂચિ ક્ષેત્રફળની જમીનને, "સદરહ અધિનિયમ" ના પ્ર્રરણ-૨ અને ૩ જોગવાઈઓની અમલવારી માંથી મુર્ડત આપેલ છે, અને

૨) હવે જ્યારે રાજ્ય સર્રારે, "સદરહ અધિનિયમ" ની ર્ લમ ૪૩(૧) મુજબ જમીન સંપાદન અર્ધિારી અને નાયબર્ લેક્ટર પાલીતાણાને ઉલ્લેખિત આંતરમાળર્ખાીય પ્રોજેક્ટના બાંર્ધામ માટેની અનુસૂચિત વિસ્તારની જમીનના સંબંધમાં પુનઃસ્થાપન અને પુનઃવસાનના વહીવટદાર તર્રીે નિમર્ણૂર્ રેલ છે, અને

૩) હવે જ્યારે "સદરહ અધિનિયમ" નીર્ લમ-૧૧(૧) થી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રારે જાહેરનામા ક્રર્માં: અમ-મ-૨૦૨૪- ૭૨૦-જભવ-૧૪૨૦૨૪-૧૨૭૪-ચ, તા.૨૪/૧૨/૨૦૨૪ થી અનુસૂચિત જમીનોનો ઉપરોક્ત સાવાજર્નિ હેતુ માટે જરૂરી છે, તેમ જાહેર ર્રેલ છે, અને

૪) હવે જ્યારે "સદરહ અધિનિયમ" નીર્ લમ-૧૫ ની પેટાર્ લમ-૨ નીચેના જમીન સંપાદન અર્ધિારી અને નાયબર્ લેક્ટર પાલીતાણાના અહેવાલને વિચારણામાં લીધા બાદ રાજ્ય સર્રારને સંતોષ થયેલ છેર્ ે, સદરહ અનુસૂચિત જમીનો સદરહ "જાહેર હેતુ" યોજના માટે જરૂરી છે.

૫) તેથી હવે,"સદરહ અધિનિયમ" નીર્ લમ-૧૯(૧) થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રાર આથી જાહેરર્ રે છેર્ ે, સદરહ અનુસૂચિત જમીનો સદરહ "જાહેર હેતુ" ની યોજના માટે જરૂરી છે.

૬) ગુજરાત સર્રાર, "સદરહ અધિનિયમ" ની ર્લમ-૩(જ) થી મળેલ સત્તા અન્વયે, અનુસૂચિત જમીનોના સંબંધમાં "સદરહ અધિનિયમ" નીચેના હવે પછીર્ લેક્ટર તર્રીેર્ રવાનાર્ ાયો બજાવવા માટે, જમીન સંપાદન અર્ધિારી અને નાયબર્ લેક્ટર પાલીતાણાની નિમર્ણૂર્ રે છે.

૭) સદરહ અનુસૂચિત જમીનના ર્નકા, જમીન સંપાદન અર્ધિારી અને નાયબર્ લેક્ટર પાલીતાણાનીર્ ચેરી ખાતે તપાસી ર્કાકે.

૮) ગુજરાત સર્રારના તા.૨૪/૧૨/૨૦૨૪ના જાહેરનામા ક્રર્માં:અમ-મ-૨૦૨૪-૭૨૦-જભવ-૧૪૨૦૨૪-૧૨૭૪-ચ, સાથેની અનુસૂચિમાં નીચેની વિગતે દકાાવેલ જમીન સંપાદન ર્રવાનુ જરૂરી નથી તેમ સર્રારને આથી જણાય છે તેથી તે જમીનનુ સંપાદન આથી પચતુ ર્મુવામાં આવેલ છે.
