No. AM-M-2025-904-LSK-1425-792-CH: Whereas it appears to the Government of Gujarat that, the land specified in the SCHEDULE annexed hereto, is likely to be required to "Executive Engineer, Road and Building (State) Division, Himmatnagar" (hereinafter referred to as "The Requiring Body") for the public purpose for construction of infrastructure project of "Connstruction of Six Lane Bridge on Sabarmati River on Mehsana-Himmatnagar Road (SH-55) at K.m. Ch. 146/700" (hereinafter referred to as "The Public Purpose Project").

Now whereas, the Government of Gujarat, Revenue Department has, in exercise of the powers conferred, by section 10A [inserted by section 3 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Gujarat Amendment) Act, 2016(Gujarat Act No. 12 of 2016)] of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as "The Act") exempted, in public interest, by Notification No.AM-M-2025-461- LSK-1425-792-CH, dated:21/07/2025, published in the Extraordinary Gazette of Gujarat Government, the below mentioned Scheduled area of land, to be acquired for the infrastructure project of the construction of "Connstruction of Six Lane Bridge on Sabarmati River on Mehsana-Himmatnagar Road (SH-55) at K.m. Ch. 146/700" from the application of the provisions of Chapter II and III of The Act, and

2. Now whereas, in exercise of the powers, conferred by sub-section (1) of section 43 of The Act, The Government of Gujarat has appointed, Special Land Acquisition Officer, Sabarkantha, Himatnagar as the officer of Rehabilitation and Resettlement in respect of the scheduled land to be acquired for construction of the captioned infrastructure project, and

3. Now whereas, in exercise of the powers conferred by sub-section (1) of section 11 of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as The Act), the Government of Gujarat, has notified, vide Notification No. AM-M-2025- 610-LSK-1425-792-CH, dated:03/09/2025 that the said scheduled land is required for the public purpose specified here above,

4. And whereas, the Government of Gujarat is satisfied after considering the report made by Special Land Acquisition Officer, Sabarkantha, Himatnagar under sub-section (2) of section 15 of The Act, that the said land is needed to be acquired for "The Public Purpose Project" specified in the schedule hereto, and

5. Now therefore, in exercise of the powers conferred by sub-section (1) of section 19 of The Act, the Government of Gujarat hereby declares that the said scheduled lands is required for the public purpose specified in the schedule hereto.

6. In exercise of the powers conferred by clause (g) of section -3 of The Act, the Government of Gujarat hereby appoints, Special Land Acquisition Officer, Sabarkantha, Himatnagar to perform the functions of a Collector, for all proceeding hereinafter to be carried out under The Act, in respect of the said scheduled lands.

7. The Plans of scheduled lands can be inspected at the Office of Special Land Acquisition Officer, Sabarkantha, Himatnagar.

ક્રર્માંઃ અમ-મ-૨૦૨૫-૯૦૪-જસબ-૧૪૨૫-૭૯૨-:િ- આ સાથે સામેલ અનુસૂચિમાં દકાાવવામાં આવેલ જમીનની જાહેર હેતુ માટે એટલે ર્ે, "મહેસાણા-હિચંમતનગર રોચ (SH-55) ર્ડ.મી.૧૪૬/૭૦૦ પર સાબરમતી નદી ઉપર નવીન છ માગીય બ્રીજ બનાવવા" (જેનો આમાં હવે પછી જાહેર હેતુની યોજના એમ ઉલ્લેખર્ રવામાં આવેલ છે તે) ના આંતરમાળર્ખાીય પ્રોજેક્ટના બાંર્ધામ માટેર્ ાયાપાર્લ ઈજનેરશ્રી, માગા અને

ં ર્માન (રાજ્ય) વિભાગ, હિચંમતનગર (જેનો આમાં હવે પછી સંપાર્દ સંસ્થા એમ ઉલ્લેખર્ રવામાં આવેલ છે તે) ને જરૂર પચવાનો સંભવ છે એવુ ગુજરાત સર્રારને જણાય છે.

(૧) હવે જ્યારે ગુજરાત સર્રારના અસાધારણ રાજ્યપત્રમાં પ્રસિદ્ધ થયેલ જાહેરનામા ક્રર્માંઃ-અમ-મ-૨૦૨૫-૪૬૧-જસબ-૧૪૨૫-૭૯૨-ચ તા.૨૧/૦૭/૨૦૨૫થી ગુજરાત સર્રારે જમીન સંપાદન, પુન:સ્થાપન અને પુનવાસનમાં વ્યાજબી વળતર અને પારદકિાતા અર્ધિાર અધિનિયમ-૨૦૧૩(૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી સદરહુ અધિનિયમ તેમ ઉલ્લેખ ર્રવામાં આવેલ છે) તેની ર્લમ- ૧૦(એ) [(જમીન સંપાદન, પુનઃસ્થાપન અને પુનવાસનમાં વાજબી વળતર અને પારદકિાતા અર્ધિાર (ગુજરાત સુધારો) અધિનિયમ- ૨૦૧૬) (૨૦૧૬ના ગુજરાત અધિનિયમ નં-૧૨ની ર્લમ-૩થી દાખલ ર્રેલ)] થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રારે જાહેર હિતમાં "મહેસાણા-હિચંમતનગર રોચ (SH-55) ર્ડ.મી.૧૪૬/૭૦૦ પર સાબરમતી નદી ઉપર નવીન છ માગીય બ્રીજ બનાવવા" બનાવવાના જાહેર હેતુ માટેના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદનર્ રવાની નીચે જણાવેલ અનુસૂચિ ક્ષેત્રફળની જમીનને, સદરહુ અધિનિયમના પ્ર્રરણ-૨ અને ૩ જોગવાઈઓની અમલવારી માંથી મુચિ આપેલ છે. અને

(૨) હવે જ્યારે રાજ્ય સર્રારે સદરહુ અધિનિયમની ર્લમ-૪૩(૧) મુજબ ખાસ જમીન સંપાદન અર્ધિારીશ્રી, સાબર્રાંઠા-હિચંમતનગરને ઉલ્લેખિત આંતરમાર્ળીય પ્રોજેક્ટના બાંર્ધામ માટેની અનુસૂચિત વિસ્તારની જમીનના સંપાદનના સંબંધમાં પુનઃસ્થાપન અને પુનઃવસનના અર્ધિારી તર્રીે નિમર્ણૂર્ રેલ છે, અને

(૩) હવે જ્યારે જમીન સંપાદન, પુનઃસ્થાપન અને પુનવાસનમાં વાજબી વળતર અને પારદકિાતા અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો હવે પછી સદરહુ અધિનિયમ તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે) નીર્ લમ-૧૧ની પેટાર્ લમ-(૧) થી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રારે જાહેરનામા ક્રર્માં: અમ-મ-૨૦૨૫-૬૧૦-જસબ-૧૪૨૫-૭૯૨-ચ તા.૦૩/૦૯/૨૦૨૫ થી ઉચ જમીન, ઉપરોચ સાવાજર્નિ હેતુ માટે જરૂરી છે, તેમ જાહેરર્ રેલ છે, અને

(૪) હવે જ્યારે સદરહુ અધિનિયમની ર્લમ-૧૫ની પેટા ર્લમ-૨ નીચેના ખાસ જમીન સંપાદન અર્ધિારીશ્રી, સાબર્રાંઠા-હિચંમતનગરના અહેવાલને વિચારણામાં લીધા બાદ રાજ્ય સર્રારને એવો સંતોષ થયેલ છેર્ ે, સદરહુ અનુસૂચિત જમીનો સદરહુ જાહેર હેતુની યોજના માટે જરૂરી છે, અને

(૫) તેથી હવે, સદરહુ અધિનિયમનીર્ લમ-૧૯(૧) થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રાર આથી સત્તાવાર જાહેરાતર્ રે છેર્ ે, સદરહુ અનુસૂચિત જમીનો સદરહુ જાહેર હેતુની યોજના માટે જરૂરી છે.

(૬) ગુજરાત સર્રાર સદરહુ અધિનિયમનીર્ લમ-૩(જ) થી મળેલ સત્તા અન્વયે, ઉચ જમીનના સંબંધમાં સદરહુ અધિનિયમ નીચે હવે પછી ર્લેક્ટર તર્રીેર્ રવાના તમામર્ ાયો બજાવવા માટે ખાસ જમીન સંપાદન અર્ધિારીશ્રી, સાબર્રાંઠા-હિચંમતનગરની નિમર્ણૂર્ રેલ છે.

(૭) સદરહુ અનુસૂચિત જમીનના ર્નકા, ખાસ જમીન સંપાદન અર્ધિારીશ્રી, સાબર્રાંઠા-હિચંમતનગરનીર્ ચેરી ખાતે તપાસી ર્કાકે.
