(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013 (30 of 2013)

No: AM-M-2026-02-LBT-142025-907-CH: In exercise of the powers conferred by sub-section (1) of section-11 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (here in after referred to as "The Act") the Government of Gujarat hereby declares that the land/lands mentioned in the Schedule annexed hereto is/are required for the purpose of Construction of four lanning for Barwala- Salangpur-Botad Road (SH-118 ) from Km. 0/00 to 22/500 under "Pravasi Path".

(1) It is notified that

1. The area of land/lands required for the above project is H.0-07-13 Sq.mt. and is situated within the boundary limit of Kundal village of Barwala Taluka of Botad District.

2. The public purpose involved in the above project is construction of infrastructure of Construction of four lanning for Barwala-Salangpur-Botad Road (SH-118) from Km. 0/00 to 22/500 under "Pravasi Path".

3. The reasons necessitating the displacement of the affected persons are: - Not applicable.

4. Under Section 10A of the Act, inserted by the Gujarat Act of 12 of 2016, exemption is given vide Government of Gujarat, Revenue Department Notification No.AM-M-2025-507-LBT-142025-907-CH, Date: 22/07/2025 that, it is not required the Social Impact Assessment Studies Report.

5. The Particulars of the Administrator appointment under section 43 of the act are as under – Land Acquisition Officer & Dy. Collector, Barwala.

I-B Ex.-²2-2 GUJARAT GOVERNMENT GAZETTE, EX., 05-01-2026 [ PART I-B (2) All the persons interested in these lands are hereby notified not to obstruct and disturb any Surveyor of other staff to enter upon and survey the land. Any transactions in respect of whole or part of these lands in whatsoever manner including by sale, lease, mortgage, change of name, exchange entered into after the date of this Notification made without permission of the Collector shall not be taken into consideration by the officer assessing the compensation under section 27 of the Act for a particular portion of the land as may be finally acquired.

(3) The Government of Gujarat, if satisfied about acquisition of the land for aforesaid public purpose, may publish final declaration under section 19 of the Act in this regard in the manner and timeframe so prescribed under the Act. In case the acquisition is dropped partially or entirely, such fact shall be notified in a proper manner as provided under the Act.

(4) In exercise of the power under Clause-1 of Section-3G of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) the Government of Gujarat pleased to appoint the Land Acquisition Office & Dy. Collector, Barwala who may for the time being in Charge of Barwala Taluka to Perform the function of a Collector in respect of the said lands.

(5) Objection to the acquisition, if any may be field by the person interested within 60 (sixty Days) from the date of publication of this notification as provided under section-15 of the ACT before Land Acquisition Officer & Dy. Collector, Barwala.

ક્રર્માં: અમ-મ-૨૦૨૬-૦૨-જબટ-૧૪૨૦૨૫-૯૦૭-:િ જમીન સંપાદન, પુનઃસ્થાપન અને પુનનવસવાટ અધિનિયમમાં વ્યાજબી વળતર અને પારદકર્નતા અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (હવે પછી તેનો ઉલ્લેખ "અધિનિયમ" તર્રીેર્ રવામાં આવકે) નીર્ લમ-૧૧ની પેટાર્ લમ(૧) હેઠળ મળેલ સત્તાનો ઉપયોગર્ રીને ગુજરાત સર્રાર આથી જાહેરર્ રે છેર્ ે, આ સાથે જોડેલ અનુસૂચિમાં દકાનવવામાં આવેલ જમીનની જાહેર હિતમાં, ર્"ન્સ્ર્રકન ઓફ ફોર લેનીંગ ફોર બરવાળા-સાળંગપુર-બોટાદ (એસ.એચ. ૧૧૮)ર્ ી.મી. ૦/૦ થી ૨૨/૫૦૦ "પ્રવાસી પથ" પ્રોજેક્ટ"ના જાહેર હેતુ માટે સંપાદિતર્ રવાની જરૂર છે.

(૧) આથી જાહેરર્ રવામાં આવે છેર્ ે,

૧. ઉપર જણાવેલ પ્રોજેક્ટ માટે જરૂરી જમીન હે. ૦-૦૭-૧૩ ચો.મી. અને તે બોટાદ જિલ્લાના બરવાળા તાર્લુાનાર્ ંડળ ગામની હદમાં આવેલ છે.

૨. ઉપર જણાવેલ પ્રોજેક્ટમાં નીચે મુજબના જાહેર હિતનો સમાવેક થાય છે. -ર્ ન્સ્ર્રકન ઓફ ફોર લેનીંગ ફોર બરવાળા-સાળંગપુર- બોટાદ (એસ.એચ. ૧૧૮)ર્ ી.મી. ૦/૦ થી ૨૨/૫૦૦ "પ્રવાસી પથ" પ્રોજેક્ટનાર્ ામેCENTRAL SECTION ] GUJARAT GOVERNMENT GAZETTE, EX., 05-01-2026 2-3 ૩. ગુજરાત અધિનિયમ-૧૨/૨૦૧૬ થી દાખલર્ રેલર્ લમ-૧૦ એ હેઠળ મહેસૂલ વિભાગ, ગુજરાત સર્રારના તા.૨૨/૦૭/૨૦૨૫ના જાહેરનામા ક્રર્માં: અમ-મ-૨૦૨૫-૫૦૭-જબટ-૧૪૨૦૨૫-૯૦૭-ચ થી મુચિ આપવામાં આવેલ છે. આ ઉચ અધિનિયમની ર્લમ-૧૦એ હેઠળ સામાર્જિ અસરોના મૂલર્યાંનનો સંચિપ્ત અહેવાલ આપવો જરૂરી નથી.

૪. અધિનિયમનીર્ લમ-૪૩ હેઠળ નિયુચર્ રવામાં આવેલ વહીવટદારની વિગતો નીચે મુજબ છે: - જમીન સંપાદન અર્ધિારી અને નાયબર્ લેક્ટરશ્રી, બરવાળા

(૨) આ જમીનમાં હિત ધરાવતી તમામ વ્યચિઓને આથી જાણર્ રવામાં આવે છેર્ ે,ર્ ોઇપણ સવેયરને અથવા અન્યર્ મનચારીઓને આ જમીન પર દાખલ થવા અને જમીનનો સવે ર્રતા અર્ટાવવા નહિં. આ જાહેરનામુ ં બહાર પડ્યા બાદ, ર્લેક્ટરશ્રીની પરવાનગી વગર આ જમીનનીર્ ે તેનાર્ ોઇ ભાગની વેચાણ, ભાડાપટ્ટે આપવી, ગીરવે ર્મૂવી, નામ બદલવુ ં અથવા નોંધણીમાં ફેરફારર્ રવા સહિતર્ ોઇપણ સ્વરૂપેર્ રવામાં આવેલી લેવડદેવડને, જમીનના જે ચોક્કસ ભાગનુ ં આખરી સંપાદનર્ રવામાં આવે તેવુ ં, અધિનિયમનીર્ લમ-૨૭ હેઠળ વળતર ર્આારતી વખતે, સંબંધિત અર્ધિારી ધ્યાનમાં લેકે નહિં.

(૩) ગુજરાત સર્રારને જો ઉપર જણાવેલ જાહેર હેતુ માટે જમીન સંપાદન ર્રવા અંગે સંતોષ થકે તો, અધિનિયમની ર્લમ-૧૯ હેઠળ, અધિનિયમમાં નિયતર્ રેલ સમયમયાનદાની અંદર અને તેમાં જણાવેલી રીતે આખરી જાહેરનામુ ં બહાર પાડકે. જો સંપાદનર્ રવાનુ ં આંર્કિ રીતે અથવા પૂરેપૂરી રીતે રદ્દર્ રવામાં આવે, તો આવી ર્ર્હીત, અધિનિયમની જોગવાઇ મુજબ યોગ્ય રીતે જાહેરર્ રવાની રહેકે.

(૪) જમીન સંપાદન, પુનઃસ્થાપન અને પુનનવસવાટ અધિનિયમમાં વ્યાજબી વળતર અને પારદકર્નતા અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો)નીર્ લમ-૩(જી) હેઠળ મળેલી સત્તાની રૂએ, રાજ્ય સર્રાર, આ જમીનોના સંબંધમાં આ અધિનિયમની જોગવાઈઓ હેઠળર્ ાયન ર્રવા અને ફરજો બજાવવા માટે જમીન સંપાદન અર્ધિારી અને નાયબ ર્લેક્ટરશ્રી, બરવાળાને તળાજા તાર્લુા માટે જમીન સંપાદન અર્ધિારી તર્રીે નીમે છે.

(૫) આ જાહેરનામા પ્રસિચિની તારીખથી ૬૦ (સાઇઠ) દિવસની અંદર આ અધિનિયમની ર્લમ-૧૫ મુજબ સંપાદન બાબતે હિત ધરાવતી વ્યચિને જોર્ ોઈ વાંધો હોય તો તેઓર્ લમ-૧૫ હેઠળ જમીન સંપાદન અર્ધિારી અને નાયબર્ લેક્ટરશ્રી, બરવાળાનીર્ ચેરીને રજૂઆત ર્રી ર્કકે.
