(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

No: AM-M-2026-12-LTP-172025-3092-GH:- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "Constructing the Ukai Left Bank High Level Canal ch.18448 mtr. To 19050 mtr. At-Vazarda , ta-Songadh , Dist. Tapi".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "Constructing the Ukai Left Bank High Level Canal ch.18448 mtr. to 19050 mtr. At-Vazarda , ta-Songadh , Dist. Tapi" the bare minimum area of land to be acquired, for the Project is H.A. 2-09-25 Sq.mtr. and is situated within the boundary limit of: Village: Vazarda, Taluka: Songadh, Dist. Tapi.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of H.A. 2-09-25 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the provision of chapter II and III of the Act. 12-1 I-B Ex.-¹² 12-2 GUJARAT GOVERNMENT GAZETTE, EX., 06-01-2026 [ PART I-B (4) Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby exempt in public interest, the area of H.A. 2-09-25 Sq.mtr. land is situated within the boundary limit of: Village: Vazarda, Taluka: Songadh, Dist. ક્રર્માં : અમ-મ-૨૦૨૬-૧૨-જતપ-૧૭૨૦૨૫-૩૦૯૨-ઘ:- "મોજે- વાઝરડા, તા- સોનગઢ, જિ- તાપી ખાતે ર્ઉાઈ ડાબાર્ ાંઠા હાઈ લેવલ ર્ંટુરર્ ેનાલ ર્સાંળ-૧૮૪૪૮ મી. થી ૧૯૦૫૦ મી.નાંર્ ામે સંપાદચતર્ રવાનાલ"ના જાહેર હેતુના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાત સર્રારને જણાય છે.

(૧) તેથી જમીન સંપાચન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારચકર્નતા અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સચરહુ અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે)નીર્ લમ-૨(૧) તથા તે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રાર આથી ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેતુ માટેર્ ાયચાનુસાર સંપાચનર્ રવાનો ઈરાચો જાહેરર્ રે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ "મોજે-વાઝરડા, તા-સોનગઢ, જિ- તાપી ખાતે ર્ઉાઈ ડાબા ર્ાંઠા હાઈ લેવલ ર્ંટુર ર્ેનાલ ર્સાંળ- ૧૮૪૪૮ મી. થી ૧૯૦૫૦ મી.નાંર્ ામે સંપાદચતર્ રવાનાલ"ના જાહેર હેતુ માટે જમીન સંપાચન માટેની ચરખાસ્ત રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાચનર્ રવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનોર્ ુલ વિસ્તાર હે.આરે. ૨-૦૯-૨૫ ચો.મી. છે અને તે મોજે.

વાઝરડા, તા. સોનગઢ, જિ. તાપીની હચમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સચરહુ સંપાચનર્ રવાની થતી ક્ષેત્રફળ હે.આરે. ૨-૦૯-૨૫ ચો.મી. જમીનને સચરહુ અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિતમાં આવશ્ર્ય જણાય છે.

(૪) તેથી સચરહુ અધિનિયમનીર્ લમ-૧૦(એ) (જમીન સંપાચન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારચકર્નતા (ગુજરાત સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાત અધિનિયમ-નં.૧૨)નીર્ લમ-૩થી ચાખલર્ રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિતમાં "મોજે-વાઝરડા તા-સોનગઢ, જિ-તાપી ખાતે ર્ઉાઈ ડાબાર્ ાંઠા હાઈ લેવલર્ ંટુરર્ ેનાલ ર્સાંળ-૧૮૪૪૮ મી. થી ૧૯૦૫૦ મી.નાંર્ ામે સંપાદચતર્ રવાનાલ"ના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાચન થતી જમીનમાં સમાવિષ્ટ થયેલ મોજે.

વાઝરડા, તા. સોનગઢ, જિ. તાપીની ક્ષેત્રફળ હે.આરે. ૨-૦૯-૨૫ ચો.મી. જમીનને સચરહુ અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
