(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

District : Valsad

No. AM-M-2026-17-LBU-142025-3089-GH :- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "Construction of Tithal Valsad Dharampur Road Km 8/000 to 31/400".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "Construction of Tithal Valsad Dharampur Road Km 8/000 to 31/400 Road work" the bare minimum area of land to be acquired, for the Project is H.A. 0-90-17 Sq.mtr. and is situated within the boundary limit of Village: Vankal, Taluka:

Valsad, Dist. Valsad.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of H.A. 0-90-17 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the provision of chapter II and III of the Act. 17-1 I-B Ex.-¹⁷ 17-2 GUJARAT GOVERNMENT GAZETTE, EX., 07-01-2026 [ PART I-B (4) Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby exempt in public interest, the area of H.A. 0-90-17 Sq.mtr. land is situated within the boundary limit of

Village : Vankal, Taluka : Valsad, Dist. Valsad to be acquired for the "Construction of Tithal Valsad Dharampur Road Km 8/000 to 31/400" from the application of the provision of chapter II and III of The Act.

ક્રર્માં: અમ-મ-૨૦૨૬-૧૭-જચલ-૧૪૨૦૨૫-૩૦૮૯-ઘ:- "ચિથલ-વલસાડ-ધરમપુર ર્ી.મી. ૮/૦૦૦ થી ૩૧/૪૦૦ રોડનાં બાંર્ધામ"ના જાહેર હેચુના આંચરમાળર્ખાીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાચ સર્રારને જણાય છે.

(૧) ચેથી જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળચર અને પારદકર્નચા અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહુ અધિનિયમ" ચેમ ઉલ્લેખર્ રવામાં આવેલ છે ચે) નીર્ લમ-૨(૧) ચથા ચે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુજરાચ સર્રાર આથી ઉપરોક્ત આંચરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેચુ માટેર્ ાયદાનુસાર સંપાદનર્ રવાનો ઈરાદો જાહેરર્ રે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિચ પ્રોજેક્ટ "ચિથલ-વલસાડ-ધરમપુરર્ ી.મી. ૮/૦૦૦ થી ૩૧/૪૦૦ રોડનાં બાંર્ધામ"ના જાહેર હેચુ માટે જમીન સંપાદન માટેની દરખાસ્ચ રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદનર્ રવાની થચી ઉપરોક્ત ઓછામાં ઓછી જમીનનોર્ ુલ વિસ્ચાર હે.આરે. ૦-૯૦-૧૭ ચો.મી. છે અને ચે મોજે. ર્વાંલ, ચા. વલસાડ, જિ. વલસાડની હદમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંચરમાળર્ખાીય પ્રોજેક્ટ માટે સદરહુ સંપાદનર્ રવાની થચી ક્ષેત્રફળ હે.આરે. ૦-૯૦-૧૭ ચો.મી. જમીનને સદરહુ અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિચમાં આવશ્ર્ય જણાય છે.

(૪) ચેથી સદરહુ અધિનિયમનીર્ લમ-૧૦(એ) (જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળચર અને પારદકર્નચા (ગુજરાચ સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાચ અધિનિયમ-નં.૧૨)નીર્ લમ-૩થી દાખલર્ રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિચમાં "ચિથલ-વલસાડ-ધરમપુરર્ ી.મી. ૮/૦૦૦ થી ૩૧/૪૦૦ રોડનાં બાંર્ધામ"ના આંચરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન થચી જમીનમાં સમાવિષ્ટ થયેલ મોજે. ર્વાંલ, ચા. વલસાડ, જિ. વલસાડની ક્ષેત્રફળ હે.આરે. ૦-૯૦-૧૭ ચો.મી. જમીનને સદરહુ અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
