No:- AM-M-2026-21-LSU-142025-3085-GH:- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "Construction of Four Laning Mahuva Anaval Road Change 0/0 to 28/960 km. Existing 0/0 to 15/300 4-Lane From 10.00 meters and 15/300 to 28/960 km. 4-lane from mtrs.".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "Construction of Four Laning Mahuva Anaval Road Change 0/0 to 28/960 km. Existing 0/0 to 15/300 4-Lane From 10.00 meters and 15/300 to 28/960 km. 4-lane from mtrs." the bare minimum area of land to be acquired, for the Project is H.A. 02-74-76 Sq.mtr. and is situated within the boundary limit of : Village: Miyapur, Taluka: mahuva, Dist. Surat.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of H.A. 02-74-76 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the provision of chapter II and III of the Act. 21-1 I-B Ex.-²¹ 21-2 GUJARAT GOVERNMENT GAZETTE, EX., 07-01-2026 [ PART I-B (4) Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby exempt in public interest, the area of H.A. 02-74-76 Sq.mtr. land is situated within the boundary limit of: Village: Miyapur, Taluka: mahuva, Dist. ક્રર્માં:- અમ-મ-૨૦૨૬-૨૧-જસત-૧૪૨૦૨૫-૩૦૮૫-ઘ:- "મહુવા અનાવલ રોડ ચેન્જ ૦/૦ થી ૨૮/૯૬૦ર્ ચ.મી. અંતગગત હયાત ૦/૦ થી ૧૫/૩૦૦માં ૧૦.૦૦ મીટરમાંથી ૪-લેન અને ૧૫/૩૦૦ થી ૨૮/૯૬૦ર્ ચમીમાં ૭.૦ મીટરમાંથી ૪-લેન ચરવાની ચામગીરીલ"ના જાહેર હેતુના આંતરમાળખાચીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાત સરચારને જણાય છે.

(૧) તેથી જમીન સંપાદન, પુન:સ્થાપન અને પુનગવસનમાં વ્યાજબી વળતર અને પારદકગચતા અધિચાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહુ અધિનિયમ" તેમ ઉલ્લેખ ચરવામાં આવેલ છે તે)ની ચલમ-૨(૧) તથા તે અંગેના નિયમોથી મળેલ અધિચાર અન્વયે ગુજરાત સરચાર આથી ઉપરોક્ત આંતરમાળખાચીય પ્રોજેક્ટના જાહેર હેતુ માટે ચાયદાનુસાર સંપાદન ચરવાનો ઈરાદો જાહેર ચરે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ "મહુવા અનાવલ રોડ ચેન્જ ૦/૦ થી ૨૮/૯૬૦ર્ ચ.મી. અંતગગત હયાત ૦/૦ થી ૧૫/૩૦૦માં ૧૦.૦૦ મીટરમાંથી ૪-લેન અને ૧૫/૩૦૦ થી ૨૮/૯૬૦ ર્ચમીમાં ૭.૦ મીટરમાંથી ૪-લેન ચરવાની ચામગીરીલ"ના જાહેર હેતુ માટે જમીન સંપાદન માટેની દરખાસ્ત રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદન ચરવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનો ચુલ વિસ્તાર હે.આરે. ૦૨-૭૪-૭૬ ચો.મી. છે અને તે મોજે. મીયાંપુર, તા. મહુવા, જિ. સુરતની હદમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંતરમાળખાચીય પ્રોજેક્ટ માટે સદરહુ સંપાદન ચરવાની થતી ક્ષેત્રફળ હે.આરે. ૦૨-૭૪-૭૬ ચો.મી. જમીનને સદરહુ અધિનિયમના પ્રચરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સરચારને જાહેર હિતમાં આવશ્યચ જણાય છે.

(૪) તેથી સદરહુ અધિનિયમની ચલમ-૧૦(એ) (જમીન સંપાદન, પુન:સ્થાપન અને પુનગવસનમાં વ્યાજબી વળતર અને પારદકગચતા (ગુજરાત સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાત અધિનિયમ-નં.૧૨)ની ચલમ-૩થી દાખલ ચરેલ) થી મળેલ અધિચારો અન્વયે, રાજ્ય સરચાર આથી જાહેર હિતમાં "મહુવા અનાવલ રોડ ચેન્જ ૦/૦ થી ૨૮/૯૬૦ ર્ચ.મી. અંતગગત હયાત ૦/૦ થી ૧૫/૩૦૦માં ૧૦.૦૦ મીટરમાંથી ૪-લેન અને ૧૫/૩૦૦ થી ૨૮/૯૬૦ર્ ચમીમાં ૭.૦ મીટરમાંથી ૪-લેન ચરવાની ચામગીરીલ"ના આંતરમાળખાચીય પ્રોજેક્ટ માટે સંપાદન થતી જમીનમાં સમાવિષ્ટ થયેલ મોજે. મીયાંપુર, તા. મહુવા, જિ. સુરતની ક્ષેત્રફળ હે.આરે. ૦૨-૭૪-૭૬ ચો.મી. જમીનને સદરહુ અધિનિયમના પ્રચરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
