(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

No: AM-M-2026-28-LNV-142025-3097-GH: Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "Reconstruction of Major Bridge at Eru Char Rasta Hansapor Abrama Amalsad Bilimora Road 4/8 to 26/0 K.m. on Ambika River".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "Reconstruction of Major Bridge at Eru Char Rasta Hansapor Abrama Amalsad Bilimora Road 4/8 to 26/0 K.m. on Ambika River" the bare minimum area of land to be acquired, for the Project is H.A. 00-05-15 Sq.mtr. and is situated within the boundary limit of: Village: Bhatha, Taluka: Gandevi, Dist. Navsari.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of H.A. 00-05-15 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the provision of chapter II and III of the Act. 28-1 I-B Ex.-²⁸ 28-2 GUJARAT GOVERNMENT GAZETTE, EX., 07-01-2026 [ PART I-B (4) Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby exempt in public interest, the area of H.A. 00-05-15 Sq.mtr. land is situated within the boundary limit of: Village: Bhatha, Taluka: Gandevi, Dist. Navsari to be acquired for the "Reconstruction of Major Bridge at Eru

Char Rasta Hansapor Abrama Amalsad Bilimora Road 4/8 to 26/0 K.m. on Ambika River" from the application of the provision of chapter II and III of The Act.

ક્રર્માં: અમ-મ-૨૦૨૬-૨૮-જનચ-૧૪૨૦૨૫-૩૦૯૭-ઘ: "ર્રીન્્ર્રશન ઓફ મેજર બ્રીજ એટ એરૂ ચાર કતા હાંસાપોર અબ્રામા અમલસાડ બીલીમોરા રોડર્ર્ .મી. ૪/૮ થી ૨૬/૦ ઓન અંર્બિા રીવર બનાવવાના"ના જાહેર હેતુના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાત સર્રારને જણાય છે.

(૧) તેથી જમીન સંપાદન, પુનઃ્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારદશર્નતા અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહુ અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે) નીર્ લમ-૨(૧) તથા તે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રાર આથી ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેતુ માટેર્ ાયદાનુસાર સંપાદનર્ રવાનો ઈરાદો જાહેરર્ રે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ "ર્રીન્્ર્રશન ઓફ મેજર બ્રીજ એટ એરૂ ચાર કતા હાંસાપોર અબ્રામા અમલસાડ બીલીમોરા રોડ ર્ર્.મી. ૪/૮ થી ૨૬/૦ ઓન અંર્બિા રીવર બનાવવાના"ના જાહેર હેતુ માટે જમીન સંપાદન માટેની દરખા્ત રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદન ર્રવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનો ર્ુલ વ્તિાર હે.આરે. ૦૦-૦૫-૧૫ ચો.મી. છે અને તે મોજે. ભાઠા, તા. ગણદેવી, જિ. નવસારીની હદમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સદરહુ સંપાદન ર્રવાની થતી ક્ષેત્રફળ હે.આરે. ૦૦-૦૫-૧૫ ચો.મી. જમીનને સદરહુ અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિતમાં આવશ્ર્ય જણાય છે.

(૪) તેથી સદરહુ અધિનિયમનીર્ લમ-૧૦(એ) (જમીન સંપાદન, પુનઃ્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારદશર્નતા (ગુજરાત સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાત અધિનિયમ-નં.૧૨)નીર્ લમ-૩થી દાખલર્ રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિતમાં "ર્રીન્્ર્રશન ઓફ મેજર બ્રીજ એટ એરૂ ચાર કતા હાંસાપોર અબ્રામા અમલસાડ બીલીમોરા રોડર્ર્ .મી. ૪/૮ થી ૨૬/૦ ઓન અંર્બિા રીવર બનાવવાના"ના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન થતી જમીનમાં સમાવિષ્ટ થયેલ મોજે. ભાઠા, તા. ગણદેવી, જિ. નવસારીની ક્ષેત્રફળ હે.આરે. ૦૦-૦૫-૧૫ ચો.મી. જમીનને સદરહુ અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
