(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

No: AM-M-2026-58-LPN-1725-1473-CH:- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "for construction of Left Bank Main Canal Escape Channel of Panam High Level Canal Scheme".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "for construction of Left Bank Main Canal Escape Channel of Panam High Level Canal Scheme" the bare minimum area of land to be acquired, for the Project is 2731 Sq.mtr. land and is situated within the boundary limit of Village: Zoz, Taluka: Shahera, Dist: Panchmahal.

Channel of Panam High Level Canal Scheme" from the application of the provision of chapter II and III of The Act.

ક્રર્માં: અમ-મ-૨૦૨૬-૫૮-જપ-િ૧૭૨૫-૧૪૭૩-:િ- "પાનમ હાઇલેવલ નહેર યોજનાની ડાબા ર્ાંઠા મુખ્ય નહેરની એર્સ્ેપ ચેનલના બાંર્ધામ"ના જાહેર હેતુના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાત સર્રારને જણાય છે.

(૧) તેથી જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારદકર્નતા અર્ધિાર અધિનિયમ-૨૦૧૩) (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહં અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે)નીર્ લમ-૨(૧) તથા તે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રાર આથી ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેતુ માટેર્ ાયદાનુસાર સંપાદનર્ રવાનો ઈરાદો જાહેરર્ રે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ "પાનમ હાઇલેવલ નહેર યોજનાની ડાબાર્ ાંઠા મુખ્ય નહેરની એર્સ્ેપ ચેનલના બાંર્ધામ"ના જાહેર હેતુ માટે જમીન સંપાદન માટેની દરખાસ્ત રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદનર્ રવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનોર્ ુલ વિસ્તાર ૨૭૩૧ ચો.મી. છે અને તે મોજે. ઝોઝ, તા. કહેરા, જિ. પંચમહાલની હદમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સદરહં સંપાદન ર્રવાની થતી ક્ષેત્રફળ ૨૭૩૧ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિતમાં આવશ્ર્ય જણાય છે.

(૪) તેથી સદરહં અધિનિયમની ર્લમ-૧૦(એ) (જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારદકર્નતા (ગુજરાત સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાત અધિનિયમ-નં.૧૨)ની ર્લમ-૩થી દાખલ ર્રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિતમાં "પાનમ હાઇલેવલ નહેર યોજનાની ડાબા ર્ાંઠા મુખ્ય નહેરની એર્સ્ેપ ચેનલના બાંર્ધામ"ના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન થતી જમીનમાં સમાવિષ્ટ થયેલ મોજે. ઝોઝ, તા. કહેરા, જિ. પંચમહાલની ક્ષેત્રફળ ૨૭૩૧ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
