The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013 (30 of 2013)

District : Panchmahal

No: AM-M-2026-60-LPN-1425-1475-CH:- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "PMGSY- Constg.

Dharola Chauhan Faliya Road".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "PMGSY- Constg. Dharola Chauhan Faliya Road" the bare minimum area of land to be acquired, for the Project is 6500 Sq.mtr. land and is situated within the boundary limit of Village: Dharola Khurd, Taluka: Shahera, Dist:

Panchmahal.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of 6500 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the provision of chapter II and III of the Act. 62-1 I-B Ex.-⁶² 62-2 GUJARAT GOVERNMENT GAZETTE, EX., 15-01-2026 [ PART I-B (4) Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby exempt in public interest, the area of 6500 Sq.mtr. land is situated within the boundary limit of Village: Dharola Khurd, Taluka: Shahera, Dist: Panchmahal to be acquired for the "PMGSY- Constg. Dharola Chauhan Faliya

Road" from the application of the provision of chapter II and III of The Act

ક્રર્માં: અમ-મ-૨૦૨૬-૬૦-જપ-િ૧૪૨૫-૧૪૭૫-:િ- "પ્રધાનમંત્રી ગ્રામ સર્ડ યોજના-ર્ ન્્ર.ધરોલા ચૌહાણ ફળીયા રોડ"ના જાહેર હેતુના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાત સર્રારને જણાય છે.

(૧) તેથી જમીન સંપાદન, પુન:્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારદકર્નતા અર્ધિાર અધિનિયમ-૨૦૧૩) (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહં અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે)નીર્ લમ-૨(૧) તથા તે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રાર આથી ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેતુ માટેર્ ાયદાનુસાર સંપાદનર્ રવાનો ઈરાદો જાહેરર્ રે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ "પ્રધાનમંત્રી ગ્રામ સર્ડ યોજના- ર્ન્્ર. ધરોલા ચૌહાણ ફળીયા રોડ"ના જાહેર હેતુમાટે જમીન સંપાદન માટેની દરખા્ત રજુ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદન ર્રવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનો ર્ુલ વ્તિાર ૬૫૦૦ ચો.મી. છે અને તે મોજે. ધરોલા ખુદિ, તા. કહેરા, જિ. પંચમહાલની હદમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સદરહં સંપાદન ર્રવાની થતી ક્ષેત્રફળ ૬૫૦૦ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિતમાં આવશ્ર્ય જણાય છે.

(૪) તેથી સદરહં અધિનિયમની ર્લમ-૧૦(એ) (જમીન સંપાદન, પુન:્થાપન અને પુનનવસનમાં વ્યાજબી વળતર અને પારદકર્નતા (ગુજરાત સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાત અધિનિયમ-નં.૧૨)ની ર્લમ-૩થી દાખલ ર્રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિતમાં "પ્રધાનમંત્રી ગ્રામ સર્ડ યોજનાર્-ન્્ર. ધરોલા ચૌહાણ ફળીયા રોડ"ના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન થતી જમીનમાં સમાવિષ્ટ થયેલ મોજે. ધરોલા ખુદિ, તા. કહેરા, જિ. પંચમહાલની ક્ષેત્રફળ ૬૫૦૦ ચો.મી.

જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
