(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013 (No. 30 of 2013)

No: AM-M-2026-66-LAV-1725-1172-CH: In exercise of the powers conferred by sub-section (1) of section-11 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (here in after referred to as "The Act") the Government of Gujarat hereby declares that the land / lands mentioned in the Schedule annexed hereto is/are required for the purpose of "Watrak Yojana Right Bank Channel Tail Extension Distributory Channel 10530 to 10630 m.".

2. It is notified that-

1. The area of land/lands required for the above project is H.Are.0-31-78 Sqr.Mtr. and is at- Lalugam Village of Dhansura Taluka of Aravalli District;

2. The public purpose involved in the above project is construction of infrastructure of "Watrak Yojana Right Bank Channel Tail Extension Distributory Channel 10530 to 10630 m."

3. The reasons necessitating the displacement of the affected persons are: - Not applicable.

4. Under Section 10A of the Act, inserted by the Gujarat Act of 12 of 2016, exemption is given vide Government of Gujarat, Revenue Department Notification No. AM-M-2025-734-LAV-1725-1172-CH, Date:07/10/2025 that, it is not required the Social Impact Assessment Study Report.

5. The Particulars of the Administrator appointment under section 43 of the act are as under – Deputy Collector, Land Acquisition and Rehabilitation Dharoi, Vatrak & Other Projects, Himmatnagar.

All the persons interested in these lands are hereby notified not to obstruct and disturb any Surveyor of other staff to enter upon and survey the land. Any transactions in respect of whole or part of these lands in whatsoever manner including by sale, lease, mortgage, change of name, exchange entered into after the date of this Notification made without permission of the Collector shall not be taken into consideration by the officer assessing the compensation under section 27 of the Act for a particular portion of the land as may be finally acquired.

4. The Government of Gujarat, if satisfied about acquisition of the land for aforesaid public purpose, may publish final declaration under section 19 of the Act in this regard in the manner and timeframe so prescribed under the Act. In case the acquisition is dropped partially or entirely, such fact shall be notified in a proper manner as provided under the Act.

5. Read with Gujarat Government Extra Ordinary Gazette Part-IV dated 12 August, 2016 the Gujarat Act No.12 of 2016 and Under Clause-1 of Section-3G of the Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) the Government of Gujarat pleased to appoint Deputy Collector, Land Acquisition and Rehabilitation Dharoi, Vatrak & Other Projects, Himmatnagar who may for the time being in Charge of Dhansura Taluka to Perform the function of a Collector in respect of the said lands.

6. Objection to the acquisition, if any may be field by the person interested within 60(sixty Days) from the date of publication of this notification as provided under section-15 of the ACT before the Deputy Collector, Land Acquisition and Rehabilitation Dharoi, Vatrak & Other Projects, Himmatnagar.

ક્રર્માં: અમ-મ-૨૦૨૬-૬૬-જઅચ-૧૭૨૫-૧૧૭૨-:િ જમીન સંપાદન, પુનઃસ્થાપન અને પુનનવસવાટ અધિનિયમમાં વ્યાજબી વળતર અને પારદકર્નતા અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (હવે પછી તેનો ઉલ્લેખ "અધિનિયમ" તર્રીેર્ રવામાં આવકે)નીર્ લમ-૧૧ ની પેટાર્ લમ (૧) હેઠળ મળેલ સત્તાનો ઉપયોગર્ રીને ગુજરાત સર્રાર આથી જાહેરર્ રે છેર્ ે, આ સાથે જોડેલ અનુસૂચિમાં દકાનવવામાં આવેલ જમીનની જાહેર હિતમાં, "વાર્ત્ર યોજનાની જમણા ર્ાંઠાની નહેરની ટેઇલ એક્સટેન્કન ડીસ્રીબ્યુટરીની ર્સાંળ ૧૦૫૩૦ થી ૧૦૬૩૦ મી." પ્રોજેક્ટ માટે સંપાદિતર્ રવાની જરૂર છે.

૨. આથી જાહેરર્ રવામાં આવે છેર્ ે,

(૧) ઉપર જણાવેલ પ્રોજેક્ટ માટે જરૂરી જમીન હે.આરે.૦-૩૧-૭૮ ચો.મી. છે. અને તે અરવલ્લી જિલ્લાના ધનસુરા તાર્લુાના લાલુગામ ગામમાં આવેલ છે.

(૨) ઉપર જણાવેલ પ્રોજેક્ટમાં નીચે મુજબના જાહેર હિતનો સમાવેક થાય છે. - "વાર્ત્ર યોજનાની જમણાર્ ાંઠાની નહેરની ટેઇલ એક્સટેન્કન ડીસ્રીબ્યુટરીની ર્સાંળ ૧૦૫૩૦ થી ૧૦૬૩૦ મી."CENTRAL SECTION ] GUJARAT GOVERNMENT GAZETTE, EX., 15-01-2026 68-3 (૩) અસરગ્રસ્ત વ્યચિઓને ખસેડવાની જરૂરનાર્ ારણો નીચે મુજબ છે. - લાગુ પડતુ ં નથી.

(૪) ગુજરાત અધિનિયમ-૧૨/૨૦૧૬ થી દાખલ ર્રેલ ર્લમ-૧૦(એ) હેઠળ મહેસૂલ વિભાગ, ગુજરાત સર્રારના જાહેરનામા ક્રર્માં: અમ-મ-૨૦૨૫-૭૩૪-જઅવ-૧૭૨૫-૧૧૭૨-ચ, તા.૦૭/૧૦/૨૦૨૫થી મુચિ આપવામાં આવેલ છે. આથી ઉચ અધિનિયમનીર્ લમ-૧૦(એ) હેઠળ સામાર્જિ અસરોના મૂલર્યાંનનો સંચિપ્ત અહેવાલ આપવો જરૂરી નથી.

(૫) અધિનિયમનીર્ લમ-૪૩ હેઠળ નિયુચર્ રવામાં આવેલ વહીવટદારની વિગતો નીચે મુજબ છે :- નાયબર્ લેક્ટરશ્રી, જમીન સંપાદન અને પુન: વસવાટ ધરોઇ, વાર્ત્ર અને અન્ય યોજનાઓ, હિચંમતનગર.

૩. આ જમીનોમાં હિત ધરાવતી તમામ વ્યચિઓને આથી જાણર્ રવામાં આવે છેર્ ે,ર્ ોઇપણ સવેયરને અથવા અન્યર્ મનચારીઓને આ જમીન પર દાખલ થવા અને જમીનનો સવેર્ રતા અર્ટાવવા નહિચં. આ જાહેરનામુ ં બહાર પડ્યા બાદ,ર્ લેક્ટરશ્રીની પરવાનગી વગર આ જમીનની ર્ે તેના ર્ોઇ ભાગની ર્ોઇપણ સ્વરૂપે તબદીલી જેમા વેચાણ, ભાડાપટ્ટે આપવી, ગીરવે ર્મૂવી, નામ બદલવુ ં અથવા નોંધણીમાં ફેરફાર ર્રવા નહીં. જો તેમ ર્રવામાં આવે તો અધિનિયમની ર્લમ-૨૭ હેઠળ જમીન સંપાદન વખતે વળતરનુ ં મૂલર્યાંન ર્રતી વખતે આવા ફેરફાર પર વિચારણાર્ રવામાં નહીં આવે.

૪. ગુજરાત સર્રારને જો ઉપર જણાવેલ જાહેર હેતુ માટે જમીન સંપાદન ર્રવા અંગે સંતોષ થકે તો, અધિનિયમની ર્લમ-૧૯ હેઠળ અધિનિયમમાં નિયત ર્રેલ સમયમયાનદાની અંદર અને તેમાં જણાવેલી રીતે આખરી જાહેરનામુ

ં ં બહાર પાડકે. જો સંપાદન ર્રવાનુ આંર્કિ રીતે અથવા પૂરેપૂરી રીતે રદર્ રવામાં આવે, તો આવી હર્ર્દત, અધિનિયમની જોગવાઇ મુજબ યોગ્ય રીતે જાહેરર્ રવાની રહેકે.

૫. જમીન સંપાદન, પુન:સ્થાપન અને પુનનવસવાટ અધિનિયમમાં વ્યાજબી વળતર અને પારદકર્નતા અર્ધિાર અધિનિયમ-૨૦૧૩(૨૦૧૩નો ૩૦મો)નીર્ લમ-૩(જ) હેઠળ મળેલી સત્તાની રૂએ, રાજ્ય સર્રાર, આ જમીનોના સંબંધમાં આ અધિનિયમની જોગવાઈઓ હેઠળર્ ાયન ર્રવા અને ફરજો બજાવવા માટે નાયબ ર્લેક્ટરશ્રી, જમીન સંપાદન અને પુન:વસવાટ ધરોઇ, વાર્ત્ર અને અન્ય યોજનાઓ, હિચંમતનગરને ધનસુરા તાર્લુા માટે જમીન સંપાદન અર્ધિારી તર્રીે નીમે છે.

૬. આ જાહેરનામા પ્રસિચિની તારીખથી ૬૦(સાઇઠ) દિવસની અંદર આ અધિનિયમનીર્ લમ-૧૫ મુજબ સંપાદન બાબતે હિત ધરાવતી વ્યચિને જોર્ ોઈ વાંધો હોય તો તેઓર્ લમ-૧૫ હેઠળ નાયબર્ લેક્ટરશ્રી, જમીન સંપાદન અને પુન: વસવાટ ધરોઇ, વાર્ત્ર અને અન્ય યોજનાઓ, હિચંમતનગરને રજૂઆતર્ રી ર્કકે.
