(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

District: Porbandar

No. AM-M-2026-79-LPB-172025-1545-CH:- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "DEVELOPMENT OF KARLI RECHARGE RESERVIOR (MOKAR SAGAR) PROJECT".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "DEVELOPMENT OF KARLI RECHARGE RESERVIOR (MOKAR SAGAR) PROJECT" the bare minimum area of land to be acquired, for the Project is H.A. 00-22-07 Sq.mtr. and is situated within the boundary limit of: Village: Odadar, Taluka: Porbandar, Dist. Porbandar.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of H.A. 00-22-07 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the provision of chapter II and III of the Act. 81-1 I-B Ex.-⁸¹ 81-2 GUJARAT GOVERNMENT GAZETTE, EX., 16-01-2026 [ PART I-B (4) Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby exempt in public interest, the area of H.A. 00-22-07 Sq.mtr. land is situated within the boundary limit of: Village: Odadar, Taluka: Porbandar, Dist. Porbandar to be acquired for the "DEVELOPMENT OF KARLI

RECHARGE RESERVIOR (MOKAR SAGAR) PROJECT" from the application of the provision of chapter II and III of The Act.

ક્રર્માંઃ અમ-મ-૨૦૨૬-૭૯-જપબ-૧૭૨૦૨૫-૧૫૪૫-િ:- "ડેવલો૫મેન્ટ ઓફ ર્લી રરચાકજ કળાશય (ર્મોર સાગર)"ના જાહેર હેતુના આંતરમાળર્ખાીય પ્રોકેક્ટ માટે કમીનની કરૂર પડવાનો સંભવ છે, એવુ ં ગુકરાત સર્રારને કણાય છે.

(૧) તેથી કમીન સંપાદન, પુન:સ્થાપન અને પુનજવસનમાં વ્યાકબી વળતર અને પારદશર્જતા અર્ધિાર અધિનિયમ-૨૦૧૩) (૨૦૧૩નો ૩૦ મો) (કેનો આમાં હવે પછી "સદરહં અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે) નીર્ લમ-૨(૧) તથા તે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુકરાત સર્રાર આથી ઉપરોક્ત આંતરમાળર્ખાીય પ્રોકેક્ટના જાહેર હેતુ માટેર્ ાયદાનુસાર સંપાદનર્ રવાનો ઈરાદો જાહેરર્ રે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોકેક્ટ "ડેવલો૫મેન્ટ ઓફર્ લી રરચાકજ કળાશય (ર્મોર સાગર)"ના જાહેર હેતુ માટે કમીન સંપાદન માટેની દરખાસ્ત રકૂ થયેલ છે, ત્યારે આ પ્રોકેક્ટ માટે સંપાદન ર્રવાની થતી ઉપરોક્ત ઓછામાં ઓછી કમીનનો ર્ુલ વિસ્તાર હે.આરે. ૦૦-૨૨-૦૭ ચો.મી. છે અને તે મોકે. ઓડદર, તા. પોરબંદર, કિ. પોરબંદરની હદમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંતરમાળર્ખાીય પ્રોકેક્ટ માટે સદરહં સંપાદન ર્રવાની થતી ક્ષેત્રફળ હે.આરે.૦૦-૨૨-૦૭ ચો.મી. કમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિતમાં આવશ્ર્ય કણાય છે.

(૪) તેથી સદરહં અધિનિયમનીર્ લમ-૧૦(એ) (કમીન સંપાદન, પુન:સ્થાપન અને પુનજવસનમાં વ્યાકબી વળતર અને પારદશર્જતા (ગુકરાત સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુકરાત અધિનિયમ-નં.૧૨)નીર્ લમ-૩થી દાખલર્ રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિતમાં "ડેવલો૫મેન્ટ ઓફર્ લી રરચાકજ કળાશય (ર્મોર સાગર)" ના આંતરમાળર્ખાીય પ્રોકેક્ટ માટે સંપાદન થતી કમીનમાં સમાવિષ્ટ થયેલ મોકે. ઓડદર, તા. પોરબંદર, કિ. પોરબંદરની ક્ષેત્રફળ હે.આરે.૦૦-૨૨-૦૭ ચો.મી. કમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
