GUJARAT AERIAL ROPEWAY ACT, 1955.
No. GHE/2026/03/EPCD/RWA/e-file/20/2024/2268/K:- Wheareas M/s. Usha Breco Limited, Parsvnath Majestic Arcade, 3rd floor, 18 A Vaibhav Khand, Indirapuram, Ghaziabad, Uttar Pradesh-201014 (hereafter referred to as "the Promoter") has made a preliminary investigation for constructing an aerial Ropeway starting from the lower terminal near Tourist Facilities Centre to the boarding terminal of the existing ropeway at Ambaji Temple at Gabbar Hill in District Banaskantha.
AND WHEREAS, the Promoter has, after completing the preliminary investigation, applied to the State Government vide letters dated 19/06/2025 and 22/07/2025 under section 9 of the said Act to authorize the Promoter for the Construction of the Ropeway.
AND WHEREAS, the Government of Gujarat is satisfied that there is no objection for authorizing the construction of the Aerial Ropeway.
The following draft of the order, which the Government of Gujarat proposes to issue is hereby, published as required under sub-section (2) of section 9 of the Gujarat Aerial Ropeway Act, 1955 (3 of 1956) and amendments made from time to time for the information of all persons likely to be affected hereby and notice is hereby given that said draft will be taken into consideration on or after the expiry of a period of 90 days from the date of publication of this order in the Official Gazette.
Any objection or suggestion which may be received from any person with respect to the draft before the expiry of the period of 90 days specified will be considered by the Government.

DRAFT ORDER
NOW THEREFORE, in exercise of the powers conferred by sub-section 1 of section 9 of the Gujarat Aerial Ropeways Act, 1955, the Government of Gujarat hereby authorizes M/s. Usha Breco Limited, Parsvnath Majestic Arcade, 3rd floor, 18 A Vaibhav Khand, Indirapuram, Ghaziabad, Uttar Pradesh-201014, to construct an Aerial Ropeway with Monocable detachable system starting from the lower terminal near Tourist Facilities Centre to the boarding terminal of the existing ropeway at Ambaji Temple at Gabbar Hill in Banaskantha District for ca rriage of passengers subject to the following restrictions and conditions:
i. The capital required for the construction of the ropeways shall be raised before 30th November, 2026.
ii. The construction of the ropeway shall be commenced on or before 1st December, 2026.
iii. The construction of the ropeway shall be completed before 31th December, 2028.
iv. The facilities and concessions available to the promoter under section 15, 16 and 17 of the said Act shall be given after following the procedure prescribed under the said Act or the Rules made thereunder.
v. The State Government or the concerned Local authorities, or M/s. Ambaji Mata Temple Trust shall have the power to purchase the Ropeway as prescribed under Section 24 of the said Act.
vi. The Structural design, quality of materials, factor of safety, method of computing stresses and other technical parameters shall conform to the requirements of the relevant Bureau of Indian Standards and Codes and necessary test certificates in this regard shall be produced wherever called for.
vii. The necessary permission from the concerned authorities of the Central Government or the railway administration shall be obtained in respect of the crossing of the National Highway or the Railway.
viii. The promoter may, if the wishes, sell the ropeways or the ropeway shall be taken over by the State Government or a local authority or any other person at the price acceptable to the State Government or a local authority or any such person.
ix. The Electrical & Mechanical devices required would be as under:
a. Adequate power supply from the Uttar Gujarat Vij Co., Ltd.,
b. Stand by Diesel Generator Set of adequate capacity.
c. 400HP Motor with VVVF Drive
d. Emergency A.C. Motor of 50HP
e. Rescue Engine of 110HP
f. Transformer of 11 KV/440V-1000 kVA used of aforesaid motive power shall be subject to the following conditions:
i. Stand by diesel Generator Set shall be used only during the nonavailability of Power from the Uttar Gujarat Vij Co. Ltd.,
ii. Emergency A/c Motor shall be kept in up-to-date condition during the hours when the ropeway is in operation.
x. The Minimum Head way of 4 meters shall be maintained under different parts of the rope.
xi. The amount of security as fixed by the Government shall be deposited by the promoter.
xii. The traffic on the ropeway shall be managed in the following manner.
a. The nos. of passengers to be carried on each carriage shall not exceed eight.
b. The promoter shall not refuse to carry the passengers when the ropeway is in operation.
c. The promoter may refuse to carry the passenger who is
i. III.
ii. Carrying explosives, arms or highly inflammable materials, luggage.
iii. Below the age of twelve years and not accompanied by any adult person.

v. Under drunken stage or carrying alcohol or drugs.
xiii. The promoter shall erect the ropeway with the following conditions:
a. The said aerial ropeway shall be constructed in a proper and workmanlike manner, in accordance with the detailed plans and specifications previously approved by the Government, within the specified time limit.
b. The supporting pylons of the said aerial ropeway shall be erected only in such places as approved in the plan.
c. While exercising the liberty and power hereby granted will the promoter do as little damage as maybe to the said lands or the timber or other trees under wood, crop or vegetation roads, buildings , gates and fences thereon and will make good any damage to roads and buildings and will hand over to the Government all precious metals, materials, items or articles, from the land expressed to be generated in the course of an installation of aerial ropeway or otherwise.
d. To ensure that the environment, culture, landscapes, flora and fauna, and any other local feature of the place are not disturbed and are maintained.
e. On operational of the aerial ropeway without any delay, clear the way from the site of all surplus material, plant, temporary buildings, and other equipment, and shall remove all rubbish and leave the site in good order to the satisfaction of the Government.
f. To keep the said ropeway and other works and erection made or erected on the said land in pursuance of the rights and liberties hereby granted in good and substantial repair.
g. To provide safe, efficient, and properly coordinated aerial ropeway service for the carriage of passengers between two stations.
h. At all times to keep harmless and indemnified the Government from and against all action proceedings, claims, and demands in respect of any personal injury to or the death of any person whomsoever or any injury to or damage whatsoever to any property moveable or immoveable, arising out of or in the course of or by reasons of the construction, working use, conditions or existence of the said aerial ropeway and from and against all costs, charges and expenses of an incidental to any such actions, proceedings, claims and demands.
i. To effect and maintain a policy of insurance in the name of the promoter against any loss, liability, claim or proceedings incurred by or made or brought against the Government and promoter or either of them in respect of any personal injury or death of any person whomsoever or any injury or damage whatsoever arising out of or in the course of or by reason of the construction, working use, condition or existence of the said ropeway and to reproduce the policy and the receipt for the current premium thereon to the Government or the person authorized by the Government upon demand.
j. To effect and maintain in its own name a policy of Insurance against loss or damage by fire in respect or of all combustible materials, and the contents thereof on the stations or on the installations .
k. To make adequate arrangements of catering hotels, restaurants, restrooms and other amenities or facilities for the benefit of passengers, subject to the first option of the Government to run cafeteria, snack bar stalls and amusement centres for the entertainment of passengers. The Government will have the first option to cater to the aforesaid requirement in order to ensure that the minimum standards are maintained.
l. Train officers and other staff employed by the promoter in the matter connected with the a erial ropeway transport, so that in a situation of emergency, the promoter can maintain and operate the aerial ropeways.
m. To comply with all obligations imposed under or by virtue of any Act or Acts of Parliament or State Legislature or by any Rules, Regulations or Bye Laws for the time being in force and to do and execute or cause to be done and execute all such works acts, deeds matters and things as under or by virtue of any such act or acts are or shall be properly directed or necessary to be done or exe cuted in respect of1-4 GUJARAT GOVERNMENT GAZETTE, EX., 17-01-2026 [ PART IV-B the said land or which it shall use or occupy under the liberty in that behalf herein before granted and at all times to keep the Government indemnified against all claims, demand and liability in respect thereof.
n. To construct at its own costs all approach roads to a landing from ropeway stations and maintain the said roads in good condition.
o. To make available to the traffic suitable plots of land for parking or cars and buses in the vicinity of the station of the said aerial ropeway and construct at its own costs a suitable approach road for access to the parking places, and maintain such roads in good condition.
