Resettlement Act, 2013) (30 of 2013)

No. AM-M-2026-86-LSU-232025-790-GH:- Whereas it appears to the Government of Gujarat that, the land specified in the SCHEDULE annexed hereto, is likely to be needed for the public purpose of Construction of infrastructure project of "Surat Railway Station Redevelopment Multi Model Transport Hub (MMTH) Project" (hereinafter referred to as "the Public Purpose Project") .

1. Now whereas, the Government of Gujarat, Revenue Department has, in exercise of the powers conferred, by section 10A [inserted by section 3 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Gujarat Amendment) Act, 2016 (Gujarat Act No. 12 of 2016)] of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as "The Act") exempted, in public interest, by Notification No. AM-M-2025-282-LSU- 232025-790-GH, Dated: 03/05/2025, the below mentioned Scheduled area of land, to be acquired for the infrastructure project of The "Surat Railway Station Redevelopment Multi Model Transport Hub (MMTH) Project" from the application of the provisions of Chapter II and III of The Act, and

Now whereas, in exercise of the power conferred by sub-section (1) of section 43 of the Act, The Government of Gujarat has appointed by Notification no. AM-M-2025-520-LSU-232025-790-GH, Dated: 01/08/2025, Special Land Acquisition officer Branch No. 4, Surat as the Administrator of Rehabilitation and Resettlement in respect of the schedule land to be acquired for construction of the captioned infrastructure project and,

3. Now whereas, in exercise of the powers conferred by sub-section (1) of section 11 of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as The Act), the Government of Gujarat, has notified, vide their Notification No. AM-M- 2025-520-LSU-232025-790-GH, Dated: 01/08/2025, that the said scheduled land is required for the public purpose specified here above,

4. And whereas, the Government of Gujarat is satisfied after considering the report made by The Collector, Surat under sub-section (2) of section 15 of The Act, that the said land is needed to be acquired for "The Public Purpose Project" specified in the schedule hereto, and

5. Now therefore, in exercise of the powers conferred by sub-section (1) of section 19 of The Act, the Government of Gujarat hereby declares that the said scheduled lands is required for the public purpose specified in the schedule hereto.

6. In exercise of the powers conferred by clause (g) of section-3 of The Act, the Government of Gujarat hereby appoints, Special Land Acquisition Officer Branch No. 4, Surat to perform the functions of a Collector, for all proceeding hereinafter to be carried out under The Act, in respect of the said scheduled lands.

7. The Plans of scheduled lands can be inspected at the Office of the Special Land Acquisition Officer Branch No. 4, M.S. Building, Nanpura Surat.

ક્રર્માંઃ અમ-મ-૨૦૨૬-૮૬-જસત-૨૩૨૦૨૫-૭૯૦-ઘ:- આ સાથે સામેલ અનુસૂચિમાં દકાાવેલ જમીનોની જાહેર હેતુ માટે એટલેર્ ે, સુરત રેલ્વે સ્ટેકન રીડેવલપમેન્ટ મલ્ટી મોડલ ટ્રાન્સપોટટ હબ (MMTH) પ્રોજેક્ટ ની ર્ામગીરી (જેનો આમાં હવે પછી જાહેર હેતુની યોજના એમ ઉલ્લેખર્ રવામાં આવેલ છે તે) માટે જરૂર પડવાનો સંભવ છે એવુ ં ગુજરાત સર્રારને જણાય છે.

૧. હવે જ્યારે, ગુજરાત સર્રારના અસાધારણ રાજપત્રમાં પ્રસિદ્ધ થયેલ મહેસૂલ વિભાગના જાહેરનામા ક્રર્માંઃ અમ-મ-૨૦૨૫-૨૮૨-જસત- ૨૩૨૦૨૫-૭૯૦-ઘ, તા.૦૩/૦૫/૨૦૨૫ થી ગુજરાત સર્રારે જમીન સંપાદન, પુનઃસ્થાપન અને પુનવાસનમાં વ્યાજબી વળતર અને પારદકિાતા અર્ધિાર અધિનિયમ, ૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહુ અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે) નીર્ લમ-૧૦એ [(જમીન સંપાદન, પુનઃસ્થાપન અને પુનવાસનમાં વ્યાજબી વળતર અને પારદકિાતા અર્ધિાર (ગુજરાત સુધારો) અધિનિયમ, ૨૦૧૬) (૨૦૧૬ ના ગુજરાત અધિનિયમ નં-૧૨ ની ર્લમ-૩ થી દાખલ ર્રેલ)] થી મળેલ અર્ધિારો અન્વયે, રાજ્યCENTRAL SECTION ] GUJARAT GOVERNMENT GAZETTE, EX., 17-01-2026 88-3 સર્રારે, જાહેર હિતમાં "સુરત રેલ્વે સ્ટેકન રીડેવલપમેન્ટ મલ્ટી મોડલ ટ્રાન્સપોટટ હબ (MMTH) પ્રોજેક્ટ ર્ામગીરી' માટે સંપાદન ર્રવાની નીચે જણાવેલ અનુસૂચિત ક્ષેત્રફળની જમીનને, "સદરહુ અધિનિયમ"ના પ્ર્રરણ-૨ અને ૩ની જોગવાઇઓની અમલવારીમાંથી મુચિ આપેલ છે, અને

૨. હવે જ્યારે, રાજ્ય સર્રારે, "સદરહું અધિનિયમ"ની ર્લમ-૪૩ની પેટા ર્લમ-(૧)થી મળેલ અર્ધિારોની રૂએ જાહેરનામા ક્રર્માં:

અમ-મ-૨૦૨૫-૫૨૦-જસત-૨૩૨૦૨૫-૭૯૦-ઘ તા.૦૧/૦૮/૨૦૨૫ થી ખાસ જમીન સંપાદન અર્ધિારીશ્રી, કાખા નં. ૪, સુરતને ઉલ્લેખિત આંતરમાળર્ખાીય પ્રોજેક્ટના બાંર્ધામ માટેની અનુસૂચિત વિસ્તારના જમીનના સંપાદનના સંબંધમાં પુન:સ્થાપન અને પુન:વસનના વહીવટદાર તર્રીે નિમર્ણૂર્ રેલ છે, અને

૩. હવે જ્યારે જમીન સંપાદન, પુનઃસ્થાપન અને પુનઃવસનમાં વ્યાજબી વળતર અને પારદકિાતા અર્ધિાર અધિનિયમ, ૨૦૧૩) (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહુ અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે) નીર્ લમ-૧૧ ની પેટાર્ લમ-(૧) થી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રારે જાહેરનામા ક્રર્માંઃ અમ-મ-૨૦૨૫-૫૨૦-જસત-૨૩૨૦૨૫-૭૯૦-ઘ તા.૦૧/૦૮/૨૦૨૫ થી ઉચ જમીનો, ઉપરોચ સાવાજર્નિ હેતુ માટે જરૂરી છે, તેમ જાહેરર્ રેલ છે, અને

૪. હવે જ્યારે, "સદરહુ અધિનિયમ"ની ર્લમ-૧૫ની પેટા ર્લમ-૨ નીચેના ર્લેક્ટર, સુરતના અહેવાલને વિચારણામાં લીધા બાદ, રાજ્ય સર્રારને એવો સંતોષ થયેલ છેર્ ે, સદરહુ અનુસૂચિત જમીનો સદરહુ "જાહેર હેતુની યોજના" માટે જરૂરી છે, અને

૫. તેથી હવે, "સદરહુ અધિનિયમ"નીર્ લમ- ૧૯(૧) થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રાર આથી જાહેરર્ રે છેર્ ે, સદરહુ અનુસૂચિત જમીનો સદરહુ "જાહેર હેતુની યોજના" માટે જરૂરી છે.

૬. ગુજરાત સર્રાર, "સદરહુ અધિનિયમ"નીર્ લમ- ૩(જ) થી મળેલ સત્તા અન્વયે, ઉચ જમીનોના સંબંધમાં, "સદરહુ અધિનિયમ" નીચે હવે પછીર્ લેક્ટર તર્રીેર્ રવાના તમામર્ ાયો બજાવવા માટે ખાસ જમીન સંપાદન અર્ધિારીશ્રી, કાખા નં. ૪, સુરતની નિમર્ણૂર્ રે છે.

૭. સદરહુ અનુસૂચિત જમીનોના ર્નકા, ખાસ જમીન સંપાદન અર્ધિારીશ્રી, કાખા નં. ૪, બહુમાળી ર્માન, નાનપુરા, સુરતનીર્ ચેરી ખાતે તપાસી ર્કકે.
