THE GUJARAT SHOPS AND ESTABLISHMENTS (REGULATION OF EMPLOYMENT AND
CONDITIONS OF SERVICE) ACT, 2019.
No: GHR/2026/98/LED/TGS/e-file/11/2026/0921/M3: The following draft of rules, which is proposed to be issued under section 39 of the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2019 (Guj. 4 of 2019) is published as required under sub-section (2) of section 39 of the Act. for the information of all persons likely to be affected thereby and notice is hereby given that the said draft rules will be taken into consideration by the Government of Gujarat after the expiry of a period of thirty days from the date of publication of this rules in the Official Gazette.
Any objection or suggestion, which may be received by the Deputy Secretary, Labour, Skill Development and Employment Department, Block No.5, 6th Floor, New Sachivalaya, Gandhinagar or via e-mail id: ds-labour- [email protected] from any person with respect to the said draft rules before the expiry of the aforesaid period will be considered by the Government.

DRAFT NOTIFICATION
THE GUJARAT SHOPS AND ESTABLISHMENTS (REGULATION OF EMPLOYMENT AND
CONDITIONS OF SERVICE) ACT, 2019.
No. GHR/2026/98/LED/TGS/e-file/11/2026/0921/M3. In excise of the power conferred by section 39 of the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2019 (Guj. 4 of 2019), the Government of Gujarat hereby makes the following rules further to amend the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2020, namely:-
1. (1) These rules may be called the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) (Second Amendment) Rules, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2020, (hereinafter referred to as "the said rules"), in rule 3, for the word "ten", the word "twenty" shall be substituted.
3. In the said rules, in rule 4, for the word "ten" the word "twenty" shall be substituted.
4. In the said rules, for rule 5, the following rule shall be substituted, namely:-
"5. Manner of registration of Establishment.
On submission of application online or otherwise in Form-A, supported with all the required documents and the prescribed fee paid through e-payment or otherwise, the registration certificate shall be generated online or issued otherwise in Form-B. The particulars of every establishment so registered shall be entered in the Register of Establishments maintained in Form-C".
5. In the said Rules, in Rule 6, for the word "ten" the word "twenty" shall be substituted.
6. In the said rules, for rule 9, the following rule shall be substituted, namely :-
"9. Notice of change in the Registration Certificate:-
Where any change occurs in the particulars contained in the certificate of registration, the employer shall, within thirty days from the date on which such change occurs, apply online or otherwise in Form-G, in accordance with section 9 of the Act, accompanied by the documents specified in Part-C of the Schedule and the prescribed fee paid through e-payment or otherwise. On receipt of an application under sub-rule (1), accompanied by the required documents and the prescribed fee, the revised certificate of registration shall be generated online or issued otherwise, as the case may be. The fee payable along with the application in Form-G by an establishment employing twenty or more employees shall be as specified below:

7. In the said rules, in rule 10, wherever the word "ten" occurs, the word "twenty" shall be substituted.
