Resettlement Act, 2013) (30 of 2013)

No: AM-M-2026-1024-LBR-172026-542-GH:- Whereas it appears to the Government of Gujarat that the land specified in the SCHEDULE annexed hereto, is likely to be required for the public purpose of construction of infrastructure project of "Flood Protection Embankment on Left bank of Narmada River for Bhadbhut Barrage and approach road works across river Narmada" (here in after referred to as "The public purpose Project")

1. Now whereas, the Government of Gujarat, Revenue Department has, in exercise of the powers conferred, by section-10(A) (inserted by section 3 of The Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Gujarat Amendment) Act, 2016 (Gujarat Act No. 12 of 2016) of The Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as " The Act") exempted, in public interest, by Notification No.AM-M-2026-277- LBR-172026-542-GH Dated.23.03.2026 published in the extra- ordinary Gazette of Gujarat Government the Below mentioned Scheduled area of land, to be acquired for the infrastructure project of "Flood Protection Embankment on Left bank of Narmada River for Bhadbhut Barrage and approach road works across river Narmada" form the application of the provisions of chapter II and III of The Act, and

Now whereas, in exercise of the powers, conferred by sub-section (1) of section-43 of The Act, The Government of Gujarat has appointed, by Notification No.AM-M-2026-352-LBR-172026-542-GH Dated.06.04.2026 Special Land Acquisition Officer, Bharuch as the Administrator of Rehabilitation and Resettlement in respect of the scheduled land to be acquired for construction of the captioned infrastructure project, and

3. Now Whereas, in exercise of the powers conferred by sub- section (1) of section 11 of "The Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act. 2013 (30 of 2013) (hereinafter referred to as The Act), the Government of Gujarat, has notified, vide Notification No. AM-M-2026- 352-LBR-172026-542-GH Dated.06.04.2026 that the said Scheduled land is required for the public purpose specified here above,

4. And Whereas, the Government of Gujarat is satisfied after considering the report made by The District Collector, Bharuch under sub-section (2) of section 15 of the Act, that the said land is needed to be acquired for "The public purpose project" specified in the scheduled hereto, and

5. Now therefore, in exercise of the power conferred by sub-section (1) of section 19 The Act, the Government of Gujarat hereby declares that the said scheduled lands is required for the public purpose specified in the schedule hereto.

6. In exercise of the powers conferred by clause(g) of section - 3 of The Act, the Government of Gujarat hereby appoints, The Special Land Acquisition Officer, Bharuch to perform all the functions of the Collector under the said act, in respect of the aforesaid lands, except the powers conferred under sections 17(1) and 17(2) of the Act.

7. The plans, of scheduled lands can be inspected at the office of The Special Land Acquisition Officer, Bharuch.

8. Now whereas, it appears to the Government of Gujarat, that below mentioned lands indicated serial numberof SHEDULE appended with Government Notification No. AM-M-2026-352-LBR-172026-542-GH Dated.06.04.2026, are not required for the aforesaid Public Purpose Project, The Government of Gujarat hereby, abandons acquisition of these lands for the aforesaid " Public Purpose Project" and notifies cancellation of the captioned Notification in Context to the below mentioned serial numbered lands. ક્રર્માં: અમ-મ-૨૦૨૬-૧૦૨૪-જભર-૧૭૨૦૨૬-૫૪૨-ઘ:- જમીન સંપાદન, પુનઃસ્થાપન અને પુનનવસનમાં વાજબી વળતર અને પારદશિનતા અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) ની ર્લમ-૧૧ ની પેટા ર્લમ-(૧) (હવે પછી તેનો ઉલ્લેખ "અધિનિયમ" તર્રીે ર્રવામાં આવશે) ગુજરાત સર્રાર આથી જાહેર ર્રે છે ર્ે, આ સાથે પરરશિષ્ટમાં બતાવવામાં આવેલ જમીનની જાહેર હેતુ "નમનદા નદી પર ભરૂચ તાર્લુાના ભાડભુત ગામપાસે બેરેજ યોજનાના બાંર્ધામ માટે જરૂરી નમનદા નદીના ડાબાર્ ાંઠા પર પૂર સંરક્ષણ પાળાની પથરેખા" માટે જરૂર છે.

૧. હવે જ્યારે ગુજરાત સર્રારના અસાધારણ રાજ્યપત્રમાં પ્રસિદ્ધ થયેલ મહેસૂલ વિભાગના જાહેરનામા ક્રર્માં:અમ-મ-૨૦૨૬-૨૭૭- જભર-૧૭૨૦૨૬-૫૪૫૪૨-ઘ તા.૨૩.૦૩.૨૦૨૬થી, ગુજરાત સર્રારે જમીન સંપાદન, પુન:સ્થાપન અને પુન:વસનમાં વ્યાજબી વળતર અને પારદશિનતા અર્ધિાર અધિનિયમ, ૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહુ અધિનિયમ" તેમ ઉલ્લેખ ર્રવામાં આવેલ છે તે) નીર્ લમ-૧૦(એ) (૨૦૧૬ ના ગુજરાત અધિનિયમ નં. ૧૨ ની ર્ લમ-૩થી દાખલર્ રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રારે જાહેર હિતમાં "નમનદા નદી પર ભરૂચ તાર્લુાના ભાડભુત ગામ પાસે બેરેજ યોજનાના બાંર્ધામ માટે જરૂરી નમનદા નદીના ડાબા ર્ાંઠા પર પૂર સંરક્ષણ પાળાની પથરેખા" માટેના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન ર્રવાની નીચે જણાવેલ અનુસૂચિત ક્ષેત્રફળની જમીનને, "સદરહુ અધિનિયમ" ના પ્ર્રરણ ૨ અને ૩ ની જોગવાઇઓની અમલવારીમાંથી મુચિ આપેલ છે અને

૨. હવે જ્યારે રાજ્ય સર્રારે, "સદરહુ અધિનિયમની ર્લમ-૪૩(૧) થી મળેલ અર્ધિારોની રૂએ જાહેરનામા ક્રર્માં: અમ-મ-૨૦૨૬- ૩૫૨-જભર-૧૭૨૦૨૬-૫૪૨-ઘ તા.૦૬.૦૪.૨૦૨૬થી ખાસ જમીન સંપાદન અર્ધિારીશ્રી, ભરૂચને ઉલ્લેખિત આંતરમાળર્ખાીય પ્રોજેક્ટના બાંર્ધામ માટેની અનુસૂચિત વિસ્તારની જમીનના સંપાદનના સંબંધમાં પુન:સ્થાપન અને પુન:વસનના વહીવટદાર તર્રીે નિમર્ણૂર્ રેલ છે, અને

૩. હવે જ્યારે જમીન સંપાદન, પુન:સ્થાપન અને પુન:વસનમાં વ્યાજબી વળતર અને પારદશિનતા અર્ધિાર, અધિનિયમ, ૨૦૧૩) (૨૦૧૩નો ૩૦મો) જેનો આમાં હવે પછી "સદરહુ અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તેનીર્ લમ-૧૧ ની પેટાર્ લમ-(૧) થી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રારે જાહેરનામા ક્રર્માં: અમ-મ-૨૦૨૬-૩૫૨-જભર-૧૭૨૦૨૬-૫૪૨-ઘ તા.૦૬.૦૪.૨૦૨૬થી ઉચ જમીનો, ઉપરોચ સાવનજર્નિ હેતુ માટે જરૂરી છે, તેમ જાહેરર્ રેલ છે, અને1124-4 GUJARAT GOVERNMENT GAZETTE, EX., 05-10-2026 [ PART I-B ૪. હવે જ્યારે સદરહુ અધિનિયમ નીર્ લમ-૧૫ની પેટાર્ લમ-૨ નીચેના જિલ્લાર્ લેક્ટર, ભરૂચનાં અહેવાલને વિચારણામાં લીધા, રાજ્ય સર્રારને એવો સંતોષ થયેલ છેર્ ે, સદરહુ "જાહેર હેતુની યોજના" માટે જરૂરી છે, અને

૫. તેથી હવે, "સદરહુ અધિનિયમ" ની ર્લમ-૧૯ થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રાર આથી સત્તાવાર જાહેરાત ર્રે છે, સદરહુ અનુસૂચિત જમીનો સદરહુ જાહેર હેતુની યોજના માટે જરૂરી છે.

૬. ગુજરાત સર્રાર, "સદરહુ અધિનિયમ"નીર્ લમ- ૩(જ) થી મળેલ સત્તા અન્વયે, ઉચ જમીનોના સંબંધમાં, "સદરહુ અધિનિયમ" નીચે હવે પછી ર્લમ-૧૭(૧) અને ૧૭(૨) હેઠળની સત્તાઓ સિવાય ર્લેક્ટર તર્રીે ર્રવાના તમામ ર્ાયો બજાવવા માટે ખાસ જમીન સંપાદન અર્ધિારીશ્રી, ભરૂચની નિમર્ણૂર્ રેલ છે.

૭. સદરહુ અનુસૂચિત જમીનોના ર્નશા ખાસ જમીન સંપાદન અર્ધિારીશ્રી, ભરૂચ ખાતે તપાસી ર્શશે.

૮. તા.૦૬.૦૪.૨૦૨૬ના સર્રારશ્રીના જાહેરનામા ક્રર્માંઃ અમ-મ-૨૦૨૬-૩૫૨-જભર-૧૭૨૦૨૬-૫૪૨-ઘ સાથેની અનુસૂચિમાં નીચેની વિગતે અનુક્રમ સામે દશાનવેલ જમીન ઉપર જણાવેલ જાહેર હેતુ માટે જરૂરી નથી તેમ ગુજરાત સર્રારને આથી જણાય છે. તેથી તે જમીન ઉપર દશાનવેલ હેતુ માટે જમીન સંપાદનમાંથી આથી પાછુ ર્મુવામાં આવે છે અને ગુજરાત સર્રાર દ્વારા એવુ ફરમાવવામાં આવે છેર્ ે ઉચ અનુક્રમવાળી નીચે દશાનવેલ જમીનના સંબંધમાં તત્પુરતુ જાહેરનામુ ં રદ થશે.
