Resettlement Act, 2013) (30 of 2013)

No: AM-M-2026-1027-LGS-1425-64-CH: Whereas it appears to the Government of Gujarat that, the land specified in the SCHEDULE annexed hereto, is likely to be required to "Executive Engineer, Road and Building (State) Division, Gir Somnath" (hereinafter referred to as "The Requiring Body") for the public purpose for construction of infrastructure project of "Widening Bypass of Majevadi-Bavana Pipalava-Malshram Road" (hereinafter referred to as "The Public Purpose Project").

1. Now whereas, the Government of Gujarat, Revenue Department has, in exercise of the powers conferred, by section 10A [inserted by section 3 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Gujarat Amendment) Act, 2016(Gujarat Act No. 12 of 2016)] of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as "The Act") exempted, in public interest, by Notification No.AM-M-2025-51-LGS-1425- 64-CH, Dated:05/02/2025, published in the Extraordinary Gazette of Gujarat Government, the below mentioned Scheduled area of land, to be acquired for the infrastructure project of the construction of "Widening Bypass of Majevadi-Bavana Pipalava-Malshram Road" from the application of the provisions of Chapter II and III of The Act, and

Now whereas, in exercise of the powers, conferred by sub-section (1) of section 43 of The Act, The Government of Gujarat has appointed, Deputy Collector, Una as the officer of Rehabilitation and Resettlement in respect of the scheduled land to be acquired for construction of the captioned infrastructure project, and

3. Now whereas, in exercise of the powers conferred by sub-section (1) of section 11 of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as The Act), the Government of Gujarat, has notified, vide Notification No.AM-M-2025- 311-LGS-1425-64-CH, Dated:19/05/2025 that the said scheduled land is required for the public purpose specified here above,

4. And whereas, the Government of Gujarat is satisfied after considering the report made by Deputy Collector, Una under sub-section (2) of section 15 of The Act, that the said land is needed to be acquired for "The Public Purpose Project" specified in the schedule hereto, and

5. Now therefore, in exercise of the powers conferred by sub-section (1) of section 19 of The Act, the Government of Gujarat hereby declares that the said scheduled land is required for the public purpose specified in the schedule hereto.

6. In exercise of the powers conferred by clause(g) of section - 3 of The Act, the Government of Gujarat hereby appoints, The Deputy Collector, Una to perform all the functions of the Collector under the said act, in respect of the aforesaid lands, except the powers conferred under sections 17(1) and 17(2) of the Act.

7. The Plans of scheduled lands can be inspected at the Office of the Deputy Collector, Una.

ક્રર્માંઃ અમ-મ-૨૦૨૬-૧૦૨૭-જગસ-૧૪૨૫-૬૪-:િ આ સાથે સામેલ અનુસૂચિમાં દકાાવવામાં આવેલ જમીનની જાહેર હેતુ માટે એટલેર્ ે, "બાયપાસ ઓફ મજેવડી-બાવાના પીપળવા-માલશ્રમ રોડ પહોળોર્ રવા" (જેનો આમાં હવે પછી જાહેર હેતુની યોજના એમ ઉલ્લેખર્ રવામાં આવેલ છે તે) ના આંતરમાળર્ખાીય પ્રોજેક્ટના બાંર્ધામ માટે ર્"ાયાપાર્લ ઇજનેરશ્રી, માગા અને ર્માન (રાજ્ય) વિભાગ, ગીર સોમનાથ" (જેનો આમાં હવે પછી સંપાર્દ સંસ્થા એમ ઉલ્લેખર્ રવામાં આવેલ છે તે) ને જરૂર પડવાનો સંભવ છે એવુ ં ગુજરાત સર્રારને જણાય છે.

(૧) હવે જ્યારે ગુજરાત સર્રારના અસાધારણ રાજ્યપત્રમાં પ્રસિદ્ધ થયેલ મહેસૂલ વિભાગના જાહેરનામા ક્રર્માંઃ-અમ-મ-૨૦૨૫-૫૧-જગસ- ૧૪૨૫-૬૪-ચ તા.૦૫/૦૨/૨૦૨૫થી ગુજરાત સર્રારે જમીન સંપાદન, પુનઃસ્થાપન અને પુનવાસનમાં વ્યાજબી વળતર અને પારદકિાતા અર્ધિાર અધિનિયમ-૨૦૧૩(૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી સદરહં અધિનિયમ તેમ ઉલ્લેખ ર્રવામાં આવેલ છે) તેની ર્લમ-૧૦(એ) [(જમીન સંપાદન, પુનઃસ્થાપન અને પુનવાસનમાં વાજબી વળતર અને પારદકિાતા અર્ધિાર (ગુજરાત સુધારો) અધિનિયમ-૨૦૧૬) (૨૦૧૬ના ગુજરાત અધિનિયમ નં-૧૨ નીર્ લમ-૩ થી દાખલર્ રેલ)] થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રારે જાહેર હિતમાં "બાયપાસ ઓફ મજેવડી-બાવાના પીપળવા-માલશ્રમ રોડ પહોળોર્ રવા"ના જાહેર હેતુ માટેના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન ર્રવાની નીચે જણાવેલ અનુસૂચિ ક્ષેત્રફળની જમીનને, 'સદરહં અધિનિયમ'ના પ્ર્રરણ-૨ અને ૩ જોગવાઈઓની અમલવારીમાંથી મુચિ આપેલ છે, અનેCENTRAL SECTION ] GUJARAT GOVERNMENT GAZETTE, EX., 05-10-2026 1127-3 (૨) હવે જ્યારે રાજ્ય સર્રારે સદરહં અધિનિયમની ર્લમ-૪૩(૧) મુજબ નાયબ ર્લેક્ટરશ્રી, ઉનાને ઉલ્લેખિત આંતરમાર્ળીય પ્રોજેક્ટના બાંર્ધામ માટેની અનુસૂચિત વિસ્તારની જમીનના સંપાદનના સંબંધમાં પુનઃસ્થાપન અને પુનઃવસનના અર્ધિારી તર્રીે નિમર્ણૂર્ રેલ છે, અને

(૩) હવે જ્યારે જમીન સંપાદન, પુનઃસ્થાપન અને પુનવાસનમાં વાજબી વળતર અને પારદકિાતા અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો હવે પછી સદરહં અધિનિયમ તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે) નીર્ લમ-૧૧ની પેટાર્ લમ-(૧) થી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રારે જાહેરનામા ક્રર્માં: અમ-મ-૨૦૨૫-૩૧૧-જગસ-૧૪૨૫-૬૪-ચ તા.૧૯/૦૫/૨૦૨૫થી ઉચ જમીન, ઉપરોચ સાવાજર્નિ હેતુ માટે જરૂરી છે, તેમ જાહેરર્ રેલ છે, અને

(૪) હવે જ્યારે સદરહં અધિનિયમનીર્ લમ-૧૫ની પેટાર્ લમ-૨ નીચેના નાયબર્ લેક્ટરશ્રી, ઉનાના અહેવાલને વિચારણામાં લીધા બાદ રાજ્ય સર્રારને એવો સંતોષ થયેલ છેર્ ે, સદરહં અનુસૂચિત જમીનો સદરહં જાહેર હેતુની યોજના માટે જરૂરી છે, અને

(૫) તેથી હવે, "સદરહં અધિનિયમ"નીર્ લમ-૧૯(૧) થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રાર આથી સત્તાવાર જાહેરાતર્ રે છેર્ ે, સદરહં અનુસૂચિત જમીનો સદરહં જાહેર હેતુની યોજના માટે જરૂરી છે.

(૬) ગુજરાત સર્રાર, "સદરહં અધિનિયમ"નીર્ લમ- ૩(જ) થી મળેલ સત્તા અન્વયે, ઉચ જમીનોના સંબંધમાં, "સદરહં અધિનિયમ" નીચે હવે પછીર્ લમ-૧૭(૧) અને ૧૭(૨) હેઠળની સત્તાઓ સિવાયર્ લેક્ટર તર્રીેર્ રવાના તમામર્ ાયો બજાવવા માટે નાયબર્ લેક્ટરશ્રી, ઉનાની નિમર્ણૂર્ રેલ છે.

(૭) સદરહં અનુસૂચિત જમીનના ર્નકા, નાયબર્ લેક્ટરશ્રી, ઉનાનીર્ ચેરી ખાતે તપાસી ર્કાકે.
