(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

No. AM-M-2026-1043-LSU-142026-1476-GH :- Whereas it appears to the Government of Gujarat, that the land is likely to be needed for public purpose viz. for the purpose of construction of the infrastructure project of "Construction of Six (6-Lane) Road under Surat Sachin Navsari Road Km.13/4 to 21/4 High Speed Corridor from Moje kapletha, Ta Chorasi, District Surat".

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of "The Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (herein after referred to as "The Act") and the Rules made there-under, it is hereby notified that the Government of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of "Construction of Six (6-Lane) Road under Surat Sachin Navsari Road Km.13/4 to 21/4 High Speed Corridor from Moje kapletha, Ta Chorasi, District Surat" the bare minimum area of land to be acquired, for the Project is 00-70-51 Sq.mtr. and is situated within the boundary limit of Village: Kapletha, Taluka: Chorasi, Dist. Surat.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of 00-70-51 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the provision of chapter II and III of the Act. 1143-1 I-B Ex.-¹¹⁴³ 1143-2 GUJARAT GOVERNMENT GAZETTE, EX., 05-10-2026 [ PART I-B (4) Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby exempt in public interest, the area of 00-70-51 H.Are.Sq.mtr. land is situated within the boundary limit of Village: Kapletha, Taluka: Chorasi, Dist. Surat to be acquired for the "Construction of Six (6-Lane) Road under

Surat Sachin Navsari Road Km.13/4 to 21/4 High Speed Corridor from Moje kapletha, Ta Chorasi, District Surat" from the application of the provision of chapter II and III of The Act.

ક્રર્માં: અમ-મ-૨૦૨૬-૧૦૪૩-જસત-૧૪૨૦૨૬-૧૪૭૬-ઘ:- મોજેર્.પ્લેથા, તા.ચોરાસી, જિ.સુરત ખાતેથી થતાં સુરત સચીન નવસારી રોડ ર્ી.મી.૧૩/૪ થી ૨૧/૪ હાઈ સ્પીડર્ ોરરડોર અંતગગત સિક્સ (૬-લેન) રોડ બનાવવાનાર્ ામગીરી ના જાહેર હેતુના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સંભવ છે, એવુ ં ગુજરાત સર્રારને જણાય છે.

(૧) તેથી જમીન સંપાદન, પુન:સ્થાપન અને પુનગવસનમાં વ્યાજબી વળતર અને પારદકર્ગતા અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો આમાં હવે પછી "સદરહં અધિનિયમ" તેમ ઉલ્લેખર્ રવામાં આવેલ છે તે) નીર્ લમ-૨(૧) તથા તે અંગેના નિયમોથી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રાર આથી ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટના જાહેર હેતુ માટેર્ ાયદાનુસાર સંપાદનર્ રવાનો ઈરાદો જાહેરર્ રે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ મોજેર્.પ્લેથા, તા.ચોરાસી, જિ.સુરત ખાતેથી થતાં સુરત સચીન નવસારી રોડર્ ી.મી.૧૩/૪ થી ૨૧/૪ હાઈ સ્પીડર્ ોરરડોર અંતગગત સિક્સ (૬-લેન) રોડ બનાવવાનાર્ ામગીરીના જાહેર હેતુ માટે જમીન સંપાદન માટેની દરખાસ્ત રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદનર્ રવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનોર્ ુલ વિસ્તાર ૦૦-૭૦-૫૧ ચો.મી. છે અને તે મોજે.ર્ પ્લેથા, તા. ચોરાસી, જિ. સુરતની હદમાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સદરહં સંપાદન ર્રવાની થતી ક્ષેત્રફળ ૦૦-૭૦-૫૧ ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનુ ં રાજ્ય સર્રારને જાહેર હિતમાં આવશ્ર્ય જણાય છે.

(૪) તેથી સદરહં અધિનિયમનીર્ લમ-૧૦(એ) (જમીન સંપાદન, પુનઃસ્થાપન અને પુનગવસનમાં વ્યાજબી વળતર અને પારદકર્ગતા (ગુજરાત સુધારા) અધિનિયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાત અધિનિયમ-નં.૧૨)નીર્ લમ-૩થી દાખલર્ રેલ) થી મળેલ અર્ધિારો અન્વયે, રાજ્ય સર્રાર આથી જાહેર હિતમાં મોજેર્.પ્લેથા, તા.ચોરાસી, જિ.સુરત ખાતેથી થતાં સુરત સચીન નવસારી રોડર્ ી.મી.૧૩/૪ થી ૨૧/૪ હાઈ સ્પીડર્ ોરરડોર અંતગગત સિક્સ (૬-લેન) રોડ બનાવવાનાર્ ામગીરી ના આંતરમાળર્ખાીય પ્રોજેક્ટ માટે સંપાદન થતી જમીનમાં સમાવિષ્ટ થયેલ મોજે. ર્પ્લેથા, તા. ચોરાસી, જિ.સુરતની ક્ષેત્રફળ ૦૦-૭૦-૫૧ હે.આરે.ચો.મી. જમીનને સદરહં અધિનિયમના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે.
