(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

No:- AM-M-2026-1037-LPN-1725-278-CH:- Whereas, it appears to the Government of Gujarat that, the land specified in the 'SCHEDULE' annexed here to is likely to be required for the public purpose of infrastructure project of construction of "construction of Left Bank Main Canal of Panam High Level Canal Scheme" (Hereinafter referred to as "The Public Purpose Project")

(1) Now whereas the Government of Gujarat, Revenue Department has in exercise of the powers conferred by section-10(A) (inserted by section-3 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement(Gujarat Amendment) (Act, 2016 (Gujarat Act No.12 of 2016)) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (No.30 of 2013) (herein after referred to as "The Act") exempted, in public interest, by Notification No:- AM-M-2025-171- LPN-1725-278-CH Date:17/03/2025 published in the Extraordinary Gazette of Gujarat Government Date:

18/03/2025 the below mentioned Scheduled area of land, to be acquired for the infrastructure project of "construction of Left Bank Main Canal of Panam High Level Canal Scheme"; from the application of the provisions of chapter II and III of The Act, and

I-B Ex.-¹¹³⁷1137-2 GUJARAT GOVERNMENT GAZETTE, EX., 05-10-2026 [ PART I-B (2) Now whereas, in exercise of the powers, conferred by sub-section (1) of section 43 of the Act. The Government of Gujarat has appointed, The Deputy Collector Land Acquisition & Rehabilitation Kadana & other Project, Panchmahal, Godhra as the officer of Rehabilitation and Resettlement in respect of the scheduled land to be acquired for construction of the captioned infrastructure project, and

(3) Now whereas, in Exercise of the power conferred by sub-section (1) of section 11 of "Right to Fair Compensation and Transparency in Land Acquisition, Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as the Act.) The Government of Gujarat, has notified, vide their Notification. No. AM-M-2025-724-LPN- 1725-278-CH, Date: 06/10/2025 that the said scheduled land is required for the public purpose specified here above.

(4) And whereas, the Government of Gujarat is satisfied after considering the report made the Deputy Collector Land Acquisition & Rehabilitation Kadana & other Project, Panchmahal, Godhra under sub-section (2) of section-15 of The Act, that the said land is needed to be acquired for "The Public Purpose Project" specified in the schedule hereto, and

(5) Now there for, in exercise of the powers conferred by sub-section (1) of section-19 of The Act. The Government of Gujarat hereby declares that the said scheduled land is required for the public purpose specified in the schedule hereto.

(6) In exercise of the powers conferred by clause (g) of section-3 of The Act, the Government of Gujarat hereby appoints, The Deputy Collector Land Acquisition & Rehabilitation Kadana & other Project, Panchmahal, Godhra to perform the function of a collector, for all proceeding here in after to be carried out under The Act, in respect of the said scheduled Lands.

(7) The Plans of scheduled lands can be inspected at the Office of the Deputy Collector Land Acquisition & Rehabilitation Kadana & other Project, Panchmahal, Godhra.

ક્રર્માં: અમ-મ-૨૦૨૬-૧૦૩૭-જપ-િ૧૭૨૫-૨૭૮-:િ- આ સાથે સામેલ અનુસૂચિમાં દકાાવવામાં આવેલ જમીનની જાહેર હેતુ માટે એટલે ર્ે, "પાનમ હાઈલેવલ નહેર યોજનાની ડાબાર્ ાંઠા મુખ્ય નહેર" (જેનો આમાં હવે પછી જાહેર હેતુની યોજના એમ ઉલ્લેખર્ રવામાં આવેલ છે તે) ના બાંર્ધામ માટે જરૂર પડવાનો સંભવ છે એવુ ં ગુજરાત સર્રારને જણાય છે.

૧) હવે જ્યારે તા.૧૮/૦૩/૨૦૨૫ ના રોજ ગુજરાત સર્રારના અસાધારણ રાજ્યપત્રમાં પ્રસિદ્ધ થયેલ મહેસૂલ વિભાગના જાહેરનામાં ક્રર્માં: અમ-મ-૨૦૨૫-૧૭૧-જપચ-૧૭૨૫-૨૭૮-ચ, તા.૧૭/૦૩/૨૦૨૫ થી ગુજરાત સર્રારે "જમીન સંપાદન, પુન:સ્થાપન અને પુનવાસનમાં વ્યાજબી વળતર અને પારદકિાતા અર્ધિાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેમાં આમાં હવે પછી "સદરહુ અધિનિયમ'' તેમ ઉલ્લેખર્ રવામાં આવેલ છે) તેનીર્ લમ-૧૦(એ) ((જમીન સંપાદન, પુન:સ્થાપન અને પુનવાસનમાં વ્યાજબી વળતર અને પારદકિાતા અર્ધિાર (ગુજરાત સુધારો) અધિનિયમ-૨૦૧૬) (૨૦૧૬ના ગુજરાત અધિનિયમ નં.૧૨ની ર્લમ-૩ થી દાખલ ર્રેલ)) થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રારે જાહેર હિતમાં "પાનમ હાઈલેવલ નહેર યોજનાની ડાબાર્ ાંઠા મુખ્ય નહેર" ના જાહેર હેતુ માટે સંપાદનર્ રવાની નીચે જણાવેલ અનુસૂચિ ક્ષેત્રફળની જમીનને, "સદરહુ અધિનિયમ" ના પ્ર્રરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુચિ આપેલ છે, અનેCENTRAL SECTION ] GUJARAT GOVERNMENT GAZETTE, EX., 05-10-2026 1137-3 ૨) હવે જ્યારે રાજ્ય સર્રારે, "સદરહુ અધિનિયમ"નીર્ લમ ૪૩(૧) મુજબ નાયબર્ લેક્ટર જમીન સંપાદન પુન:વસવાટર્ ડાણા અને અન્ય યોજનાઓ, પંચમહાલ ગોધરાને ઉલ્લેખિત આંતરમાળર્ખાીય પ્રોજેક્ટના બાંર્ધામ માટેની અનુસૂચિત વિસ્તારની જમીનના સંબધમાં પુનઃસ્થાપન અને પુનઃવસાનના વહીવટદાર તર્રીે નિમર્ણૂર્ રેલ છે, અને

૩) હવે જ્યારે "સદરહુ અધિનિયમ" નીર્ લમ-૧૧(૧) થી મળેલ અર્ધિાર અન્વયે ગુજરાત સર્રારે જાહેરનામા ક્રર્માં: અમ-મ-૨૦૨૫- ૭૨૪-જપચ-૧૭૨૫-૨૭૮-ચ, તા.૦૬/૧૦/૨૦૨૫ થી અનુસૂચિત જમીનોનો ઉપરોચ સાવાજર્નિ હેતુ માટે જરૂરી છે, તેમ જાહેરર્ રેલ છે, અને

૪) હવે જ્યારે "સદરહુ અધિનિયમ" નીર્ લમ-૧૫ની પેટાર્ લમ-૨ નીચેના નાયબર્ લેક્ટર જમીન સંપાદન પુન:વસવાટર્ ડાણા અને અન્ય યોજનાઓ, પંચમહાલ ગોધરાના અહેવાલને વિચારણામાં લીધા બાદ રાજ્ય સર્રારને સંતોષ થયેલ છેર્ ે, સદરહુ અનુસૂચિત જમીનો સદરહુ "જાહેર હેતુ" યોજના માટે જરૂરી છે.

૫) તેથી હવે,"સદરહુ અધિનિયમ"નીર્ લમ-૧૯(૧) થી મળેલ અર્ધિારો અન્વયે રાજ્ય સર્રાર આથી જાહેરર્ રે છેર્ ે, સદરહુ અનુસૂચિત જમીનો સદરહુ "જાહેર હેતુ" ની યોજના માટે જરૂરી છે.

૬) ગુજરાત સર્રાર, "સદરહુ અધિનિયમ" નીર્ લમ-૩(જ) થી મળેલ સત્તા અન્વયે, અનુસૂચિત જમીનોના સંબંધમાં "સદરહુ અધિનિયમ" નીચેના હવે પછી ર્લેક્ટર તર્રીે ર્રવાના ર્ાયો બજાવવા માટે નાયબ ર્લેક્ટર જમીન સંપાદન પુન:વસવાટ ર્ડાણા અને અન્ય યોજનાઓ, પંચમહાલ ગોધરાની નિમર્ણૂર્ રે છે.

૭) સદરહુ અનુસૂચિત જમીનના ર્નકા, નાયબર્ લેક્ટર જમીન સંપાદન પુન:વસવાટર્ ડાણા અને અન્ય યોજનાઓ, પંચમહાલ ગોધરાની ર્ચેરી ખાતે તપાસી ર્કાકે.
