संख्या 11/50/2017-4श्रम.— भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा षर्तें विनियमन) अधिनियम, 1996 (1996 का केन्द्रीय अधिनियम 27), की धारा 62 की उपधारा (2) के साथ पठित उपधारा (1) तथा धारा 40 की उपधारा (2) के साथ पठित उपधारा (1) द्वारा प्रदत्त षक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा षर्तें विनियमन) नियम, 2005 को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्ः-
1. ये नियम हरियाणा भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा षर्तें विनियमन) द्वितीय संषोधन नियम, 2018 कहे जा सकते हैं।
2. हरियाणा भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा षर्तें विनियमन) नियम, 2005, में, नियम 47 के स्थान पर निम्नलिखित नियम प्रतिस्थापित किया जायेगा, अर्थात्ः-
''47. सचिव और अन्य अधिकारियों की नियुक्ति (धारा 19).
(1) श्रम आयुक्त, बोर्ड का सचिव होगा।
(2) बोर्ड श्रम विभाग, सामाजिक न्याय तथा अधिकारिता विभाग तथा अनुसूचित जातियां तथा पिछड़े वर्ग कल्याण विभाग के/कल्याण के क्षेत्र में कम से कम पांच वर्षाें का अनुभव रखने वाले श्रेणी-1 के अधिकारियों अथवा सेवानिवृत श्रेणी-1 के अधिकारियों से एक या अधिक संयुक्त सचिव की नियुक्ति कर सकता है।
(3) बोर्ड सरकार की पूर्व सहमति से, ऐसे अन्य अधिकारियों तथा कर्मचारियों को, जो वह अधिनियम के अधीन इसके कृत्यों के दक्ष निर्वहन में बोर्ड की सहायता के लिए आवष्यक समझे, नियुक्त कर सकता है''। 1144 HARYANA GOVT. GAZ. (EXTRA.), MAR. 16, 2018 (PHGN. 25, 1939 SAKA)

No. 11/50/2017-4Lab.— In exercise of the powers conferred by the sub-section (1) read with sub-section (2) of section 62 and sub-section (1) read with sub-section (2) of section 40 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 (Central Act 27 of 1996), the Governor of Haryana hereby makes the following rules further to amend the Haryana Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2005, namely:-
1. These rules may be called the Haryana Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Second Amendment Rules, 2018.
2. In the Haryana Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2005, for rule 47, the following rule shall be substituted, namely:-
"47. APPOINTMENT OF SECRETARY AND OTHER OFFICERS [SECTION 19]:-
(1) The Labour Commissioner shall be the Secretary of the Board.
(2) The Board may appoint one or more Joint Secretary from the Class-I Officers or retired Class-I Officers of the Labour Department, Social Justice and Empowerment Department and Welfare of Scheduled Castes and Backward Classes Department having at least five years' experience in the field of welfare.
(3) The Board may, with the prior concurrence of the Government, appoint such other officers and employees, as it considers necessary to assist the Board in the efficient discharge of its functions under the Act."
