संख्या 16/27/2017-4 प्रोटोकॉल.- हरियाणा के राज्यपाल, हरियाणा के ऐसे निवासियों, जिन्होंने 25-6-1975 से 21-3-1977 तक आपातकाल की अवधि के दौरान सक्रिय रूप से भाग लिया और उन्हें एम०आई०एस०ए० अधिनियम, 1971 और/या भारत के प्रतिरक्षा अधिनियम, 1962 तथा इसके तहत बनाए गए नियमों के तहत कारावास जाना पड़ा, को 10,000 रुपये मासिक पेंषन देने हेतु निम्नलिखित योजना को स्वीकृति प्रदान करते हैंः
1. लघु शीर्षक ः इस योजना को 'हरियाणा राज्य शुभ्र ज्योत्सना पेंषन और अन्य सविधाएं योजना, 2018' कहा जा सकता है।
2. प्रासंगिकता : ये योजना 1-11-2017 से लागू होंगी। 3. प्रात्रता :
(क) ये स्कीम हरियाणा के ऐसे निवासियों के लिए लागू होंगी, जिन्होंने आपातकाल की अवधि के दौरान सक्रिय रूप से भाग लिया और संघर्ष किया तथा चाहे उन्हें एम०आई०एस०ए० अधिनियम, 1971 और/या भारत के प्रतिरक्षा अधिनियम, 1962 तथा इसके तहत बनाए गए नियमों के तहत एक दिन के लिए कारावास जाना पड़ा हो। ये योजना ऐसे व्यक्तियों की विधवाओं के लिए भी लागू होंगी।
(ख) वह हरियाणा राज्य का निवासी होना चाहिए और उसे आपातकालीन अवधि के दौरान अर्थात 25.06.1975 से 21.03.1977 तक किसी भी अवधि के लिए कारावास जाना पड़ा हो। उसे इसके लिए सम्बन्धित जेल अधीक्षक द्वारा जारी और जिला मजिस्ट्रेट द्वारा प्रतिहस्ताक्षरित जेल प्रमाणपत्र प्रस्तुत करना होगा।
(ग) यदि कोई व्यक्ति रिकॉर्ड गुम होने या अनुपलब्ध होने के कारण जेल के प्रमाण पत्र प्रस्तुत नहीं कर सकता, तो वह दो सह-कैदियों से प्रमाणपत्र प्रस्तुत कर सकता है। सह-कैदियों का ऐसा प्रमाणपत्र संबंधित जिले के विधायक या सांसद द्वारा प्रमाणित होना चाहिए।
4. नियम और शतें :
(क) लाभार्थी आपातकालीन पीड़ितों को अपने बैंक खातों में पेंशन की राशि हस्तांंतरित करने के लिए किसी भी राष्ट्रीय—त बैंक में आधार से जुड़ा बचत बैंक खाता खोलना होगा और प्रत्येक वर्ष जनवरी माह में 'जीवित-प्रमाणपत्र' देना होगा, जैसाकि अन्य पेंशनधारकों के मामले में किया जा रहा है।

(EXTRA.), APR. 16, 2018 (CHTR. 26, 1940 SAKA) (ख) किसी अन्य राज्य सरकार से पेंशन या किसी भी तरह का मानदेय लेने वाले आपातकालीन पीड़ित भी पात्र होंगे। हालांकि, यदि कोई अन्यथा पात्र आपातकालीन पीड़ित इसी उद्देश्य के लिए 10,000 रुपये प्रतिमाह से कम राषि प्राप्त कर रहा है तो इस स्कीम के तहत पेंशन की पात्रता उस राषि तक कम हो जाएगी। (ग) इस स्कीम के तहत व्यय राज्य सरकार द्वारा वहन किया जाएगा। इस विभाग के प्रशासनिक सचिव द्वारा स्वीकृृति के बाद, पेंशन की राशि लाभार्थी आपातकालीन पीड़ितों के बैंक खाते में जमा करवाई जाएगी। (घ) किसी आपातकालीन पीड़ित के निधन के मामले में, मासिक पेंशन उसकी जीवित पत्नी/पति को दी जाएगी। (ड़) आवेदन मुख्य सचिव, हरियाणा को संबोधित किए जाएंगे। इन नियमों के तहत पेंशन की स्वीकृृति के लिए आवेदन फार्म इन नियमों के साथ संलग्न परिशिष्ट-क में दिए गए प्रपत्र में जमा करवाना होगा। (च) सभी जिलों के संबंधित उपायुक्तों की अध्यक्षता में पहले से ही गठित समितियां, प्राप्त होने वाले नए आवेदनों की समीक्षा करेंगी तथा राज्य सरकार को अपनी सिफारिशें भेजेंगी, जिसका निर्णय अंतिम होगा।
(छ) संबंधित उपायुक्त की सिफारिश पर इन नियमों के तहत पेंशन स्वीकृृत करने के लिए मुख्य सचिव सक्षम प्राधिकारी होंगे।
(ज) सरकार का निर्णय अंतिम माना जाएगा।
(झ) यदि आवेदक राज्य सरकार से कोई अन्य पेंशन प्राप्त कर रहा है, तो पेंशन का वह भाग शुभ्र ज्योत्स्ना पेंशन से घटा दिया जाएगा, केवल वृृद्धावस्था पेंषन अपवाद होगी।
(ण) यदि लाभार्थी (पति या पत्नी, जैसा भी मामला हो), की मृृत्यु हो है तो पेेंषन उसकी जीवित पत्नी या पति को दी जाएगी।
(ट) यदि लाभार्थी राज्य से कोई अन्य मानदेय/वेतन प्राप्त कर रहा है तो वह इस पेंषन के लिए पात्र नहीं होगा/ होगी।
(ठ) आवेदक केवल एक ही जिले से आवेदन कर सकता है और उसे इस आषय का शपथ पत्र जमा करवाना होगा कि उसने किसी अन्य जिले से आवेदन नहीं किया है।
(ड) सक्षम प्राधिकारी द्वारा पेंशन की सिफारिश के बाद, पेंशन कोषाध्यक्ष, चेरिटेबल एंडॉमेंट्स, हरियाणा चंडीगढ़ (एजीओटी) द्वारा सीधे पेंशनभोगी के बैंक खाते में हस्तांतरित की जाएगी।
(ढ) योजना का लाभ उन व्यक्तियों को भी प्रदान किया जाएगा जो अन्य राज्यों के निवासी थे लेकिन उन्हें हरियाणा राज्य में गिरफ्तार कर हरियाणा राज्य की जेलों में भेज दिया गया था।
5. पेंशन :
हरियाणा के निवासियों, जो इस योजना के तहत पात्र हैं, को 1.11.2017 से 10,000/- (दस हजार रुपये केवल) की मासिक पेंशन दी जाएगी।
6. पेंशन का निरस्तीकरण : निम्नलिखित परिस्थितियों में पेंशन रद्द की जा सकती है :
(क) नैतिक पतन के आरोपों पर न्यायालय द्वारा सजा।
(ख) झूठी जानकारी या शपथपत्र देना।

No. 16/27/2017-4Protocol.— The Government of Haryana is pleased to approve the following scheme for providing monthly pension of Rs.10,000/- to the residents of Haryana who participated actively during the period of emergency i.e. 25.06.1975 to 21.03.1977 and faced imprisonment under MISA Act, 1971 and/or Defence of India Act, 1962 and Rules framed there under.
1. Short Title :This scheme may be called "The Haryana State Shubhra Jyotsna Pension and other Facilities Scheme, 2018".
2. Applicability :This Policy shall be made applicable from 1.11.2017.
3. Eligibility:
(a) This scheme will be applicable to residents of Haryana who participated actively and struggled during the period of emergency and faced imprisonment even for one day, under MISA Act, 1971 and/or Defence of India Act, 1962 and Rules framed there under. The policy shall also be applicable to widows of such persons.
(b) He or She must be a resident of Haryana State and must have undergone imprisonment for any period, during the Emergency Period i.e. 25.06.1975 to 21.03.1977. He or She has to produce the jail certificate for the same issued by Jail Superintendent concerned and counter signed by District Magistrate.
(c) In case the person cannot produce the jail certificate due to record being missing or being unavailable, he may produce certificate from two co-prisoners. Such certificate of co-prisoners must be authenticated by an MLA or MP of the concerned district.
4. Terms & Conditions:
(a) The beneficiary Emergency Sufferers will have to open an Aadhar linked Saving Bank Account in any Nationalized Bank for transferring the amount of pension to their bank accounts and have to give a "live-certificate" in the month of January every year, as is being followed in the case of other pensioners.
(b) Emergency Sufferers, getting pension or honorarium of any kind from any other State Government will also be eligible. However, if an otherwise eligible Emergency Sufferer is getting pension from any other State Government for the same purpose of an amount less than Rs. 10,000/- per month, the entitlement of pension under this scheme would be reduced by that amount.
(c) The expenditure under this scheme will be borne by the State Government. After sanction by the Administrative Secretary of this department, the amount of pension will be deposited in the bank account of beneficiary Emergency Sufferers.
(d) In case of demise of any of the Emergency Sufferers, the monthly pension will continue to be given to his/her surviving wife.
(e) The applications shall be addressed to Chief Secretary, Haryana. The application form for sanction of pension under these scheme shall be submitted in pro-forma given in Appendix-A to the Rules.
(f) The Committees, already constituted under the Chairmanship of respective Deputy Commissioners of all the districts, will examine fresh applications, as and when receive, and send their recommendations to the State Government whose decision shall be final.
(g) Chief Secretary will be competent authority to sanction the pension under this scheme on the recommendation of Deputy Commissioner concerned.
(h) The decision of the Government will be considered as final.
HARYANA GOVT. GAZ. (EXTRA.), APR. 16, 2018 (CHTR. 26, 1940 SAKA) 1667(i) If the applicant is receiving any other pension from the State Government, this portion of pension will be subtracted from Shubhra Jyotsna Pension, the only exception being the old age pension.
(j) If the beneficiary had died (Husband or Wife as the case may be), the pension will be given to the living spouse.
(k) In case, beneficiary is receiving any Honorarium/Salary from State Government then he/she will not be eligible for this pension.
(l) Applicant can apply from only one district and he has to submit affidavit to that effect that he has not applied from any other district.
(m) After the recommendation of Pension by Competent Authority, pension will be transferred to the pensioner's Bank Account directly by The Treasurer, Charitable Endowments, Haryana Chandigarh (AGOT).
(n) The benefit of the scheme be also provided to those persons who are/were domicile of another State but were arrested and jailed in Haryana State.
5. Pension: - The residents of Haryana who are eligible under the scheme will be given a monthly pension of Rs. 10,000/- (Ten thousand only) with effect from 1.11.2017.
6. Cancellation of Pension: Pension is liable to be cancelled in the following circumstances:
(a) Conviction by the Court on charges of moral turpitude.
(b) Providing false information or affidavit.
