संख्या 2/8/2015-2श्रम.- भवन और अन्य सन्निर्माण कर्मकार (नियोजन और सेवा शर्तें विनियमन) अधिनियम, 1996 (1996 का केन्द्रीय अधिनियम 27), की धारा 62 की उपधारा (2) के साथ पठित उपधारा (1) तथा धारा 40 की उपधारा (2) के साथ पठित उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्तें विनियमन) नियम, 2005, को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. ये नियम हरियाणा भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्तें विनियमन) तृृतीय संषोधन नियम, 2018 कहे जा सकते हैं।

2. हरियाणा भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्तें विनियमन) नियम, 2005 (जिसे, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 28 में, उप-नियम (3) में, खण्ड (iii) तथा उसके सामने प्रविष्टियों के स्थान पर, निम्नलिखित खण्ड तथा उसके सामने प्रविष्टियां प्रतिस्थापित की जायेंगी, अर्थात्‌ :-

''(iii) सात प्रतिष्ठित केन्द्रीय टे्रड यूनियन अर्थात ऑल इण्डिया युनाईटेड ट्रेड यूनियन सैन्टर, ऑल इण्डिया ट्रेड यूनियन कॉग्रेस, भारतीय मज़दूर संघ, सैन्टर ऑफ इण्डियन ट्रेड यूनियन्स, हिन्द मज़दूर सभा, इण्डियन नैष्नल ट्रेड यूनियन कॉग्रेस तथा युनाईटेड ट्रेड यूनियन काँग्रेस से सहबद्ध सन्निमार्ण कर्मकार ट्रेड यूनियनों के प्रदेष अध्यक्ष तथा प्रदेष महासचिव ;''

3. उक्त नियमों में, नियम 55 में, ''रु. 5000/- (पाँच हजार रुपए)'' चिन्होें, अंकों, कोष्ठकों तथा षब्दों के स्थान पर, ''आठ हजार रुपए'' षब्द प्रतिस्थापित किए जाएंगे।

4. उक्त नियमों में, नियम 61 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

''61. धारा 62 शादी हेतु वित्तिय सहायता - निरन्तर एक वर्ष की सदस्यता रखने वाले भवन कर्मकार अपने सुपुत्र तथा सुपुत्री की षादी के लिए क्रमषः इक्कीस हजार रुपए तथा पचास हज़ार रुपए की वित्तिय सहायता प्राप्त करने के पात्र होंगे। इस निधि की महिला सदस्य भी अपनी स्वयं की षादी के लिए इस सहायता के लिए पात्र होंगी। यह सहायता हिताधिकारी के दो बच्चों की षादी के लिए स्वीकृत की जाएगी; बषर्तें लाभ उनके जन्म के अनुक्रम पर विचार किए बिना तीन सुपुत्रियों तक बढ़ाया जाएगा। प्रारूप XXIII में आवेदन पत्र ऐसे अन्य दस्तावेज़ों के साथ प्रस्तुत किया जाएगा, जो बोर्ड द्वारा विनिर्दिष्ट किए जाएं।''चण्डीगढ़ : दिनांक 27 अप्रैल, 2018 डॉ0 महावीर सिंह, प्रधान सचिव, हरियाणा सरकार, श्रम विभाग। (1757) 1758 HARYANA GOVT. No. 2/8/2015-2Lab.— In exercise of the powers conferred by Sub-section (1) read with Sub-section (2) of Section 62 and Sub-section (1) read with Sub-section (2) of Section 40 of the Building and Other Construction Workers' (Regulation of Employment and Conditions of Service) Act, 1996 (Central Act 27 of 1996), the Governor of Haryana hereby makes the following rules further to amend the Haryana Building and Other Construction Workers' (Regulation of Employment and Conditions of Service) Rules, 2005, namely:-

1. These rules may be called the Haryana Building and Other Construction Workers' (Regulation of Employment and Conditions of Service) Third Amendment Rules, 2018.

2. In the Haryana Building and Other Construction Workers' (Regulation of Employment and Conditions of Service) Rules, 2005 (hereinafter called the said rules), in rule 28, in sub-rule (3), for clause (iii), the following clause shall be substituted, namely:-

"(iii) State President and State General Secretary of the construction workers trade unions affiliated with the seven reputed Central Trade Unions, namely, All India United Trade Union Centre (AIUTUC), All India Trade Union Congress (AITUC), Bharatiya Mazdoor Sangh (BMS), Centre of Indian Trade Unions (CITU), Hind Mazdoor Sabha (HMS), Indian National Trade Union Congress (INTUC) and United Trade Union Congress (UTUC)."

3. In the said rules, in rule 55, for the words, figure, brackets and signs "Rs. 5,000/- (Five Thousand Rupees), the words "Eight Thousand Rupees" shall be substituted.

4. In the said rules, for rule 61, the following rule shall be substituted, namely:-

"61. The building workers having continuous membership for one year shall be eligible to get financial assistance of twenty one thousand rupees and fifty thousand rupees for the marriage of son and daughter respectively. A female member of this Fund shall also be eligible for this assistance for her own marriage. This assistance shall be sanctioned for the marriage of two children of the beneficiary provided that the benefits shall be extended upto three female children irrespective of the order of their birth. An application in form XXIII shall be submitted alongwith such other documents, as may be specified by the Board.
