संख्या 2/13/2009-1 विद्युत.- विद्युत अधिनियम, 2003 (2003 का केन्द्रीय अधिनियम 36), की धारा 180 की उपधारा (2) के खण्ड (घ) के साथ पठित धारा 89 की उपधारा (2) तथा आगे हरियाणा बिजली सुधार अधिनियम, 1997 (1997 का केन्द्रीय अधिनियम 10) की धारा 6 की उपधारा (2) के साथ पठित धारा 55 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा विद्युत विनियामक आयोग (अध्यक्ष तथा सदस्य सेवा षर्तें) नियम, 1998 को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः-
1. (1) ये नियम हरियाणा विद्युत विनियामक आयोग (अध्यक्ष तथा सदस्य सेवा षर्तें) संषोधन नियम, 2017 कहे जा सकते है।
(2) ये जनवरी, 2016 के प्रथम दिन से लागू हुए समझे जाएंगे।
2. हरियाणा विद्युत विनियामक आयोग (अध्यक्ष तथा सदस्य सेवा षर्तें) नियम, 1998 में, नियम 3 में, उप-नियम (ं1) के स्थान पर, निम्नलिखित उपनियम प्रतिस्थापित किया जाएगा, अर्थातः-
''(1) अध्यक्ष, वेतन मैट्रिक्स स्तर 17 (रु 80,000/- के वेतनमान के समरूप) में प्रति मास रु 2,25,000/- (नियत) वेतनमान में वेतन प्राप्त करेगा। सदस्यों का वेतन, वेतन मैट्रिक्स स्तर 16 (रु 75,500-80,000/- के वेतनमान के समरूप) में प्रति मास रु 2,05,400/- होगा और भारत सरकार, वित मन्त्रालय अधिसूचना संख्या 1-2/2016-आई. सी., दिनांक 25 जुलाई, 2016 के अनुसार लागू वेतन मैट्रिक्स स्तर 16 के अनुलम्ब सैल में यथा विनिर्दिष्ट वार्षिक वेतनवृद्धि प्राप्त करेंगेः
परन्तु अध्यक्ष तथा सदस्यों का वेतन, पेंषन के सरांषित भाग सहित पेंषन की सकल राषि, यदि पहले से प्राप्त कर रहे हों, की कटौती के अध्यधीन होगा''। 2298 HARYANA GOVT. GAZ. (EXTRA.), JULY 26, 2018 (SRVN. 4, 1940 SAKA)

No. 2/13/2009-1 Power.— In exercise of the powers conferred by Section 55 read with Sub-section (2) of Section 6 of the Haryana Electricity Reforms Act, 1997 (10 of 1998) and further read with Sub-section (2) of Section 89 read with clause (d) of Sub-section (2) of Section 180 of the Electricity Act, 2003 (Central Act 36 of 2003), the Governor of Haryana hereby makes the following rules further to amend the Haryana Electricity Regulatory Commission (Conditions of Service of Chairman and Members) Rules, 1998, namely:-
1. (1) These rules may be called the Haryana Electricity Regulatory Commission (Conditions of Service of Chairman and Members) Amendment Rules, 2017.
(2) They shall be deemed to have come into force on the 1st day of January, 2016.
2. In the Haryana Electricity Regulatory Commission (Conditions of Service of Chairman and Members) Rules, 1998, in rule 3, for sub rule (1), the following sub rule shall be substituted, namely :-
"(1) The Chairman shall receive a pay in the Apex scale Rs. 2,25,000/- (fixed) per month in the pay matrix level 17 (corresponding to the pay scale of Rs. 80,000/-). The pay of the members shall be Rs. 2,05,400/- per month in the pay matrix level 16 (corresponding to the pay scale of Rs. 75,500/- 80,000/-) and shall get an annual increment as specified in the vertical cell's of applicable pay matrix level 16 as per the Government of India, Ministry of India, (Department of Expenditure) Notification No. 1-2/2016-1C, dated the 25th July, 2016:
Provided that the pay of the Chairman and members shall be subject to deduction of the gross amount of pension including any commuted portion thereof if already getting".
