संख्या 16/139/2017-2IW.- हरियाणा नहर तथा जल-निकास नियम, 1976 को आगे संषोधित करने के लिए नियमों का निम्नलिखित प्रारुप, जिसे हरियाणा के राज्यपाल हरियाणा नहर तथा जल-निकास अधिनियम, 1974 (1974 का 29), की धारा 65 की उप-धारा (2) के साथ पठित उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करते है, इस के द्वारा, उन व्यक्तियों की जानकारी के लिए प्रकाषित किया जाता है, जिनको इससे प्रभावित होने की सम्भावना है। इसके द्वारा, नोटिस दिया जाता है कि सरकार इस अधिसूचना के राजपत्र में प्रकाषन की तिथि से पन्द्रह दिन की अवधि की समाप्ति पर या उसके पष्चात् नियमों के प्रारुप पर, ऐसे आक्षेपों यो सुझावों सहित, यदि कोई हों, जो प्रधान सचिव, हरियाणा सरकार, सिंचाई तथा जल संसाधन विभाग, चण्डीगढ़ द्वारा नियमों के प्रारुप के सम्बन्ध में किसी व्यक्ति से इस प्रकार विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त किये जाए, विचार करेगी।
प्रारुप नियम
1. ये नियम हरियाणा नहर तथा जल-निकास (संषोधन) नियम, 2018, कहे जा सकते हैं। 2. हरियाणा नहर तथा जल निकास नियम, 1976 (जिन्हें, इसमें, इसके बाद उक्त नियम कहा गया है) में, नियम 2 में, उपान्तिक शीर्ष में, ''परिभाषा'', षब्द के स्थान पर ''परिभाषाए'' षब्द प्रतिस्थापित किया जाएगा ।
3. उक्त नियमों में, नियम 7 में, ''तिथि जिस का'' षब्दों के बाद, ''तथा स्थान जहा'' षब्द रखे जाएंगे । 4. उक्त नियमों में, नियम 43 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात् :-
ग्रामीणों की मांग विवरणी (खतौनी) तक पहुच धारा 65.-
''43. ग्राम पटवारी के पास रखी मांग विवरणी (खतौनी), उन व्यक्तियों, जो जल प्रभारों के भुगतान के लिए दायी हैं, के निरीक्षण के लिए ऐसी तिथि, समय तथा स्थान पर, जो पटवारी द्वारा विनिर्दिष्ट किया जाए, खुली होगी। 5. उक्त नियमों में नियम 75 में, ''दो रुपये'' षब्दों के स्थान पर ''दो सौ रुपये'' षब्द प्रति स्थापित किए जाएंगे । 6. उक्त नियमों में नियम 109 में, ''तिथि तथा स्थान'' षब्दों के स्थान पर, ''तिथी, स्थान तथा समय'', षब्द तथा चिह्न प्रतिस्थापित किए जाएंगे ।
7. उक्त नियमों में, नियम 111 में, अन्त में, ''और समान के तामिल की पावती या तो लम्बरदार या चौकीदार इत्यादि से सत्यापित की जाएगी'' षब्द जोड़े, जोड़े जाएंगे ।
8. उक्त नियमों में प्ररूप IV में, ''19-से. 19-'' अंको, अक्षर तथा चिह्न के स्थान पर, ''20-से 20-'' अंक, अक्षर तथा 3338 HARYANA GOVT. GAZ. (EXTRA.), OCT. 9, 2018 (ASVN. 17, 1940 SAKA) 10. उक्त नियमों में, प्ररूप VI में ,-
(i) दो बार आने वाले ''19'' अंको के स्थान पर, ''20'' अंक प्रतिस्थापित किए जाएंगे; तथा
(ii) ''नहर स्टेषन'' षब्दों के स्थान पर ''मंडल नहर अधिकारी'' शब्द प्रतिस्थापित किए जाएंगे ।

Notification

No. 16/139/2017-2IW.— The following draft of the rules further to amend the Haryana Canal and Drainage Rules, 1976, which the Governor of Haryana proposes to make in exercise of the powers conferred by Sub-section (1) read with sub-section (2) of Section 65 of the Haryana Canal and Drainage Act, 1974 (29 of 1974), is hereby published for the information of persons likely to be affected thereby.
Notice is hereby given that the drafi of rules will be taken into consideration by the Government on or after the expiiy of aperiod of fifteen days from the date of publication of this notification in the Official Gazette together with objections or suggestions, if any, which may be received by the Principal Secretary to Government, Haryana, Irrigation and Waters Resources Department, Chandigarh, from any person with respect to the draft ofrules before the expiry of the period so specified.
Draft Rules
1. These rules may be called the Haryana Canal and Drainage (Amendment) Rules, 2018.
2. In the Haryana Canal and Drainage Rules, 1976 (hereinafter Called the said rules), in the rule 2, in the marginal heading, for the word "Definition", the words "Definitions" Shall be subsitituted.
3. In the said rules, in rule 7, in the fifth line, after the words "the date on which", the words "and the place where" shall be inserted.
4. In the said rules, for rule 43, the following rule shall be substituted, namely:-
"43. Demand statement (Khatauni) to be accessible to villagers. Section 65.– The demand statement (Khatauni) with the Patwari of the village shall be opened at such place, date and time as may be specified by the Patwari for inspection of the person who are liable to pay charges"."
5. In the said rules, in rule 75, for the words "two rupees", the words "two hundred rupees" shall be substituted.
6. ln the said rules, in rule 96, for the word "summons", wherever occurring, the word "summon" shall be substituted.
7. In the said rules, in rule 109, for the word "the date and place", the words and sign "the date, time and place" shall be substituted.
8. In the said rules, in rule 111, the following words shall be added at the end, namely:–
"and shall be attested either by Lamberdar or Chowkidar of the village"."
9. In the said rules, in Form IV, for the figure "19", occurring twice, the figure "20" shall be substituted.
10. In the said rules in Form V, for the figure "19", the figure "20" shall be substituted.
11. In the said rules, in Form VI,-
(i) for the figure "19", occurring twice, the figure "20" shall be substituted; and
(ii) for the words "Canal Station", the words "Divisional Canal Officer" shall be substituted.'
