संख्या 41/16/2017-5पोल.- चूंकि, हरियाणा के राज्यपाल की संतुष्टि हो गई है कि स्नातकोत्तर आयुर्विज्ञान संस्थान, रोहतक और चिकित्सा षिक्षा तथा अनुसंधान विभाग, हरियाणा के अधीनस्थ संस्थान के अन्य संघटक चिकित्सा महाविद्यालयों में कार्यरत डाकटर, नर्सों अथवा अमलें के किसी अन्य प्रवर्ग द्वारा अनिष्चितकालीन की जा रही हड़ताल से सामुदायिक जीवन में स्वास्थ्य और आवष्यक सेवाएं गम्भीर रूप से प्रभावित होने की सम्भावना है। अतः उक्त संस्थान तथा संघटक चिकित्सा महाविद्यालयों में दाखिल गम्भीर बीमारी से ग्रस्त मरीजों तथा अन्य मरीजों की देख-रेख को सुनिष्चित करना अति आवष्यक हो गया है;
और चूंकि, हरियाणा के राज्यपाल की आगे संतुष्टि हो गई है कि स्नातकोत्तर आयुर्विज्ञान संस्थान, रोहतक तथा चिकित्सा षिक्षा तथा अनुसंधान विभाग, हरियाणा के अधीनस्थ विष्वविद्यालयों में दाखिल गम्भीर बीमारी से ग्रस्त मरीजों तथा अन्य मरीजों की देख-रेख सुनिष्चित करने हेतु उक्त संस्थान तथा संघटक चिकित्सा महाविद्यालयों में कार्यरत डाक्टर, नर्सों और अमलें के किसी अन्य प्रवर्ग द्वारा की जा रही अनिष्चित कालीन हड़ताल का प्रतिषेध करना लोक हित में है और हड़ताल का प्रतिषेध करना आवष्यक है;
इसलिए, अब, हरियाणा आवष्यक सेवा अनुरक्षण अधिनियम, 1974 (1974 का 40), की धारा 4 क की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, इस आदेष के राजपत्र में प्रकाषन की तिथि से छह मास की अवधि तक उपरोक्त संस्थान और संघटक चिकित्सा महाविद्यालयों में कार्यरत डाक्टर, नर्सों तथा अमलें के किसी अन्य प्रवर्ग द्वारा की जा रही अनिष्चितकालीन हड़ताल का प्रतिषेध करते हैं । 3432 HARYANA GOVT. No. 41/16/2017-5Pol.— Whereas, the Governor of Haryana is satisfied that to ensure patient care of the critical ill and other patients admitted at Post Graduate Institute of Medical Sciences, Rohtak and other constituent Colleges of the University working under the Medical Education and Research Department, Haryana, any strike by the Doctors, Nurses or any other category of staff shall gravely affect the health and essential services for the life of the community.
And whereas, the Governor of Haryana is further satisfied that the prohibition of strike by the Doctors, Nurses and other category of staff and to ensure patient care of the critical ill and other patients admitted at Post Graduate Institute of Medical Sciences, Rohtak and other constituent Colleges of the University working under the Medical Education and Research Department is in public interest and it is necessary to prohibit a strike;
Now, therefore, in exercise of powers conferred by Sub-section (1) of Section 4A of the Haryana Essential Services Maintenance Act, 1974 (40 of 1974), the Governor of Haryana hereby prohibits any strike by Doctors, Nurses and other category of staff to ensure patient care of the critical ill and other patients admitted at Post Graduate Institute of Medical Sciences, Rohtak and other constituent Colleges of the University working under the Medical Education and Research Department, Haryana for a period of six months from the date of publication of this order in the Official Gazette.
