संख्या पी०एफ०-69/2018/31430.— हरियाणा नगरीय क्षेत्र विकास तथा विनियमन नियम, 1976, को आगे संषोधित करने के लिए नियमों का निम्नलिखित प्रारूप, जिसे हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा नगरीय क्षेत्र विकास तथा विनियमन अधिनियम, 1975 (1975 का 8) की धारा 24 की उपधारा (2) के साथ पठित उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बनाने का प्रस्ताव करते है, उक्त धारा की उपधारा (1) के द्वारा यथा अपेक्षित ऐसे व्यक्तियों की जानकारी के लिए प्रकाशित करते है, जिनके इसके द्वारा प्रभावित होने की सम्भावना है।
इसके द्वारा नोटिस दिया जाता है कि इस अधिसूचना के राजपत्र में प्रकाषन की तिथि से तीस दिन की अवधि की समाप्ति पर अथवा इसके पष्चात् सरकार, नियमों के प्रारूप पर, ऐसे आक्षेपों और सुझावों सहित, यदि कोई हों, जो प्रधान सचिव, हरियाणा सरकार, नगर तथा ग्राम आयोजना विभाग, चण्डीगढ़ द्वारा लिखित रूप में किसी व्यक्ति से नियमों के प्रारूप के सम्बन्ध में इस प्रकार विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त हाें, विचार करेगी।
प्रारूप नियम
1. ये नियम हरियाणा नगरीय क्षेत्र विकास तथा विनियमन (संषोधन) नियम, 2018, कहे जा सकते हैं। 2. हरियाणा नगरीय क्षेत्र विकास तथा विनियमन नियम, 1976 म,ें नियम 12क के बाद, निम्नलिखित नियम रखा जाएगा, अर्थात।
"12ख. बाहय विकास प्रभारों के लिए लेखे का रखरखाव, (धारा 3(3) (क) (ii))ः-
(1) बाहय विकास प्रभार प्राप्त करने वाला निदेषक या कोई अन्य सरकारी अभिकरण या स्थानीय प्राधिकरण ऐसी सभी प्राप्तियों के लिए विकास योजना-वार लेखा विवरणी का रख रखाव करेगा। विकास योजना में दी गई किसी विषिष्ट परियोजना के लिए प्राप्त किए गऐ बाहय विकास प्रभार, उक्त विकास योजना क्षेत्र में बाहय विकास कार्यों के प्रबन्ध के लिए उपयोग किया जाएगें।
(2) यदि, निदेषक से भिन्न किसी सरकारी अभिकरण या स्थानीय प्राधिकरण द्वारा बाहय विकास प्रभारों के लिए राषि प्राप्त की गई है, तो ऐसे सरकारी अभिकरण या स्थानीय प्राधिकरण, उनके द्वारा प्राप्त की गई राषि के लिए विकास-योजना वार लेखा विवरणी का रख रखाव करने के लिए जिम्मेवार होगें।
(3) ऐसी लेखा विवरणी मासिक आधार पर अधतन की जाएगी तथा सभी सम्बन्धितों की जानकारी के प्रयोजन के लिए नगर तथा ग्राम आयोजना विभाग तथा सम्बद्ध सरकारी अभिकरण या स्थानीय प्राधिकरण की वैबसाइट पर रखी जाएगी।" 3548 HARYANA GOVT. GAZ. (EXTRA.), NOV. 13, 2018 (KRTK. 22, 1940 SAKA)

Notification

No. PF-69/2018/31430.— The following draft of rules further to amend the Haryana Development and Regulation of Urban Areas Rules, 1976, which the Governor of Haryana proposes to make in exercise of the powers conferred by sub-section (1) read with sub-section (2) of section 24 of the Haryana Development and Regulation of Urban Areas Act, 1975 (8 of 1975), is hereby published as required under sub-section (1) of the said section, for the information of persons likely to be affected thereby.
Notice is hereby given that the following draft of the rules shall be taken into consideration by the Government on or after the expiry of a period of thirty days from the date of publication of this notification in the Official Gazette, together with objections or suggestions, if any, which may be received in writing by the Principal Secretary to Government, Haryana, Town and Country Planning Department, Chandigarh from any person in respect to the draft of the rules before the expiry of the period so specified.
Draft Rules
1. These rules may be called the Haryana Development and Regulation of Urban Areas (Amendment) Rules, 2018.
2. In the Haryana Development and Regulation of Urban Areas Rules, 1976, after rule 12A, the following rule shall be inserted, namely:-
"12B. Maintenance of account for External Development Charges (Section 3(3)(a)(ii)):-
1. The Director or any other Government agency or local authority receiving external development charges shall maintain a development plan-wise account statement for all such receipts. The external development charges received against any specific project in a given development plan shall be utilised for provision of external development works in the said development plan area.
2. In case, the amount is received against external development charges by any Government agency or local authority other than the Director, it shall be the responsibility of such Government agency or local authority to maintain the development plan wise account statement for the amount received by them.
3. Such account statement shall be updated on monthly basis and hosted on the website of the Town and Country Planning Department and the concerned Government agency or local authority for the purpose of information of all concerned."
