दिनांक 14 नवम्बर, 2018

संख्या 2/10/2018-आर- II.- हरियाणा नगर निगम अधिनियम, 1994 (1994 का 16) की धारा 32 की उप-धारा (1) द्वारा प्रदत षक्तियों का प्रयोग करत े हएु राज्य निर्वाचन आयोग के परामर्ष से, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा नगर निगम निर्वाचन नियम, 1994 का े आगे संषोधित करन े के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. ये नियम हरियाणा नगर निगम निर्वाचन (संषोधन) नियम, 2018, कहे जा सकते हैं।

2. हरियाणा नगर निगम निर्वाचन नियम, 1994 (जिन्ह,ें इसमें, इसके बाद, उक्त नियम कहा गया है) में, प्रस्तावना म,ें ''सदस्या'ें ' षब्द के स्थान पर, ''महापौर तथा सदस्या'ें ' षब्द प्रतिस्थापित किये जाएंगे।

3. उक्त नियमों में, नियम 2 में, खण्ड (ज) म ें ''जिसके सदस्य''श्षब्द के स्थान पर ''जिसका महापौर और सदस्य'' षब्द प्रतिस्थापित किये जाएंगे।

4. उक्त नियमों में, नियम 23 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जायेगा, अर्थात्‌ : -

''23. मेयर और सदस्या ें की अयोग्यताएं .- (1) कोई व्यक्ति निगम का महापौर और सदस्य इस प्रकार चुने जाने के लिए अयोग्य होगा, यदि उसमं े धारा 8 म ें यथा वर्णित अयोग्यताआ ें में से कोई पाई जाती है।

(2) कोई भी व्यक्ति निगम के महापौर और सदस्य के रूप में चुनाव के लिए पात्र नहीं होगा जा े अनुसूचित जातिया,ें पिछ़डे वर्गों अथवा महिलाओं के लिए आरक्षित स्थान की दषा में, इनमे से किन्ही भी पव्र र्गों का सदस्य नहीं है।''श्

(i) उप-नियम (1) मं,े ''सदस्यता के लिये अपात्र'' षब्दा ें के स्थान पर ''महापौर या सदस्यता के लिये अपात्र'' षब्द प्रतिस्थापित किये जाएंगे;

(ii) उप-नियम (4) मं,े ''उसी निवार्च न क्षेत्र में चुनाव के लिए'' षब्दा ें के स्थान पर, ''उसी वार्ड मं े महापौर और सदस्य के निर्वाचन के लिए चुनाव'' षब्द प्रतिस्थापित किये जाएंगे; तथा

(iii) उप-नियम (4) म,ें परन्तुक में ''उसी वार्ड के चुनाव के लिए'' षब्दा ें के स्थान पर ''उसी वार्ड मं े महापौर या सदस्य के चुनाव क ेे लिए'' षब्द प्रतिस्थापित किये जाएंगे।

6. उक्त नियमों में, नियम 25 मेें,-

(i) उप नियम (1) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''(1) किसी उम्मीदवार के नामांकन पत्र का े तब तक विधिवत्‌ दिया गया नहीं समझा जायेगा, जब तक कि नियम 24 के अधीन उसे देते समय उम्मीदवार द्वारा नीचे दी गई तालिका में दर्षाई गई राषि उपायुक्त के पास नकद जमा नहीं करवा दी जाती अथवा जमा नहीं करवाता, अथवा नामांकन पत्र के साथ यह दर्षात े हुये रसीद संलग्न नहीं करता है कि उक्त राषि खजाने में जमा करवा दी है या उस दिन के बाजार मूल्य के बराबर सरकारी प्रनोट संलग्न नहीं करता :-

परन्तु जहां किसी उम्मीदवार द्वारा उसी वार्ड मं े महापौर और सदस्य के लिये निर्वाचन के लिए एक से अधिक नामांकन पत्र भरे गये हैं, तो इस उपनियम के अधीन उससे एक से अधिक बार राषि जमा करवाने की अपेक्षा नहीं की जायेगी।''श्

(ii) ''उप-नियम (4) में,े विद्यमान परन्तुक के स्थान पर, निम्नलिखित परन्तुक प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''परन्तु यदि किसी उम्मीद्‌वार द्वारा एक से अधिक वार्डों मं े महापौर अथवा सदस्य के चुनाव के लिए नामांकन पत्र भरे गये हैं, तो उसकी ओर से या उसके निमित्त जमा करवाई गई राषिया ें में से एक से अधिक नहींं लौटाइर् जाएगी तथा षेष राषि सरकार द्वारा जब्त कर ली जायेगी।''श्

7. उक्त नियमों में, नियम 32 में, उप-नियम (1) मं े ''यदि किसी वार्ड मं े केवल एक उम्मीदवार है'' षब्दों के स्थान पर ''यदि वाडर् में महापौर अथवा सदस्य के लिए केवल एक उम्मीदवार है'' षब्द प्रतिस्थापित किये जाएंगे।श्

8. उक्त नियमों में, नियम 33 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''33. मतदान करवाया जाना, यदि उम्मीदवारा ें की संख्या रिक्तियों की संख्या से अधिक है .- यदि किसी वार्ड में महापौर अथवा सदस्य के चुनाव के लिए उम्मीदवारा ें की संख्या एक से अधिक है, तो मतदान करवाया जायेगा।''श् 9. उक्त नियमों में, नियम 34 मेंं ''वार्ड या वाडाेंर् की जिनम ें वह उम्मीदवार था, उसमें चुनाव के निर्देष में सभी कार्यवाहियां '' षब्दों तथा चिह्‌न के स्थान पर, ''वार्ड या वार्डों में महापौर; या सदस्य के चुनाव के सन्दर्भ में सभी कायर्व ाहियां, जिनमें वह उम्मीदवार था'' शब्द तथा चिह्‌न प्रतिस्थापित किये जाएंगे।

10. उक्त नियमों में, नियम 63 म,ेंं ''यदि उस वार्ड में काइे र् भी मतदान करवाना आवष्यक न हो'' षब्दा ें के स्थान पर, ''यदि महापौर; या सदस्य के लिए उस वार्ड में कोई भी मतदान करवाना आवष्यक न हो'' षब्द प्रतिस्थापित किये जाएंगे। 11. उक्त नियमों में, नियम 71 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''71. महापौर तथा सदस्या ें के पद के लिए राज्यनिष्ठा की षपथ और महापौर, वरिष्ठ उप महापौर और उप महापौर इत्यादि की पदावधि .- (1) मण्डलीय आयुक्त द्वारा निगम के निर्वाचित महापौर और सदस्या ें के नामों की अधिसूचना के तीस दिन की अवधि के भीतर, निर्वाचित महापौर और सदस्यो के सामान्य निवास स्थान पर अड़तालीस घण्टे का नोटिस देत े हुए नवगठित निगम की प्रथम बैठक बुलायेगा और अध्यक्षता करेगा । नोटिस मं े स्पष्ट रूप से उल्लेख किया जायेगा कि उपस्थित महापौर और सदस्यों को राज्यनिष्ठा की षपथ दिलाई जायेगी।HARYANA GOVT. (EXTRA.), NOV. 14 , 2018 (KRTK. 23, 1940 SAKA) 3585 (2) आयुक्त, निगम के लिए निर्वाचित महापौर तथा सदस्या ें के नामों की अधिसूचना के साठ दिन की अवधि के भीतर, महापौर और सदस्यों के सामान्य निवास स्थान पर अड़तालीस घण्टे का नोटिस भेजकर बैठक बुलायेगा। नोटिस में स्पष्ट रूप से उल्लेख किया जायेगा कि वरिष्ठ उप महापौर और उप महापौर के चुनाव, आयुक्त की उपस्थिति में महापौर द्वारा अध्यक्षता की जाने वाली इस बैठक में आयोजित किए जाएं।

(3) मण्डलीय आयुक्त धारा 33 में यथा विहित उपस्थित महापौर और सदस्यों को राजनिष्ठा की षपथ दिलाएगा।

(4) उप-नियम (3) के अधीन बुलाई गई बैठक म ें महापौर या सदस्य, जो उपस्थित नहीं होता ह ै अथवा आकस्मिक रिक्ति का े भरने के लिए निर्वाचित अथवा नामांकित हुये सदस्य को तत्पष्चात्‌ सत्यनिष्ठा की षपथ महापौर द्वारा दिलवाई जायेगी और महापौर के मामले म ें शपथ सम्बद्ध मण्डलीय आयुक्त द्वारा दिलवाई जायेगी। (5) महापौर के पद की अवधि पांच वर्ष या उसकी षेष पदावधि तक के लिये होगी।

(6) वरिष्ठ उप महापौर और उप महापौर की पदावधि, पांच वर्ष के लिये या सदस्य के रूप मं े उसकी षेष पदावधि, जो भी कम हो, तक होगी। वरिष्ठ उप महापौर और उप महापौर निगम के निर्वाचित सदस्यों मं े से चुने जाएंगे।

(7) निगम मं े महापौर का पद सामान्य श्रेणी, अनुसूचित जातिया,ें पिछड़े वर्गों से सम्बन्धित व्यक्तियों तथा महिलाआ ें में से निर्वाचकों द्वारा प्रत्यक्ष चुनाव द्वारा चक्रानक्रु म द्वारा भरे जाएगें े जो इस रीति में अवधारित की जाएगी कि राज्य में अनुसूचित जातियों तथा पिछड़े वगाेंर् के लिये आरक्षित महापौर के पदा ें की संख्या, निगम के ऐसे पदों की कुल संख्या ऐस े समरूप अनुपात में होगी जो राज्य की कुल जनसंख्या मं े अनुसूचित जातिया ें और पिछडे़ वर्गों की जनसंख्या का अनुपात है :

परन्तु निगमों मं े महापौर के पदों की कुल संख्या का कम से कम एक तिहाई, अनुसूचित जाति और पिछड े़ वर्ग की महिलाआ ें के लिए आरक्षित पदाें सहित महिलाआ ें के लिए आरक्षित होगी। महिलाओं के लिए पदों का आरक्षण अलग-अलग निगमों में बारी-बारी से होगा, जो निदेषक, शहरी स्थानीय निकाय विभाग, मण्डलीय आयुक्त तथा सम्बद्ध निगमों के आयुक्त से मिलकर बनने वाली समिति द्वारा ड्रा ऑफ लॉटस द्वारा अवधारित किया जायेगा :

परन्तु यह और कि अनुसूचित जातिया ें और पिछडे़ वगाेंर् के लिये महापौर के पदा ें की संख्या उनकी जनसंख्या के आधार पर अवधारित की जायेगी और पथ््र ामतः अनुसूचित जातियों की अधिकतम जनसंख्या वाले विभिन्न षेष निगमों में बारी-बारी से होगी, द्वितीयतः पिछड ़े वर्गों की अधिकतम जनसंख्या वाले शेष निगमों से होगी तथा इस तरह उनकी अगली अधिकतम आबादी वाले निगम के पदा ें की पष्चात्‌वतीर् अवधि में बारी-बारी से होगी। यदि दो निगमों में जनसंख्या की प्रतिषतता पिछड ़े वर्गों तथा अनुसूचित जातिया ें के सम्बन्ध में एक समान है, तो आरक्षण उपरोक्त परन्तुक में निर्दिष्ट समिति द्वारा ड्रा ऑफ लॉटस द्वारा अवधारित किया जाएगा।

12. उक्त नियमों में, नियम 72 में .-

(i) विद्यमान उपान्तिक षीर्ष के स्थान पर, निम्नलिखित उपान्तिक षीर्ष प्रतिस्थापित किया जाएगा, अर्थात्‌ : - ''वरिष्ठ उप महापौर तथा उप महापौर के चुनाव।''; तथा

(ii) उप-नियम (1) में, ''महापौर,'' षब्द तथा चिह्‌न का लोप कर दिया जाएगा।

13. उक्त नियमों में, नियम 73 मेंं ''महापौर,'' षब्द तथा चिह्‌न, जहां कहीं भी आएंँ, का लोप कर दिया जाएगा। 14. उक्त नियमों में, नियम 75 में .-

(i) उपान्तिक षीर्ष में ''महापौर,'' षब्द तथा चिन्ह का लोप कर दिया जाएगा;

(ii) उप-नियम (2) में ''महापौर,'' षब्द तथा चिह्‌न का लोप कर दिया जाएगा; तथा

( iii) उप नियम (4) म,ें परन्तुक मे,ं ''महापौर या'' शब्दा ें का लोप कर दिया जाएगा।

15. उक्त नियमों में, नियम 78 मेें .-

(i) उप-नियम (1) में, ''सदस्य'' षब्द के स्थान पर ''महापौर या सदस्य'' षब्द प्रतिस्थापित किये जायगें े; तथा (ii) उप-नियम (2) में, ''महापौर, या'' षब्दा ें तथा चिह्‌न का लोप कर दिया जाएगा।

16. उक्त नियमों में, विद्यमान प्ररूप 1, 1ग, 1घ, 2, 2क, 2ख, 3, 4, 5, 6, 7, 8, 9, 10, 11, 13, 14, 15, 16 तथा 17 के स्थान पर, क्रमषः निम्नलिखित परू्र प प्रतिस्थापित किए जाएंगे, अर्थात्‌ :-

(क) आपको मतपत्र पर अपना मत अभिलिखित करने के पष्चात मतपत्र को इसके साथ भेजे गये ''क'' चिहि्‌नत छोटे लिफाफे में रखे। लिफाफे को बन्द कर दें और उसे मोहर लगाकर या अन्यथा सुरक्षित कर द।ें

(ख) इसके उपरान्त आप इसके साथ भेजी गई प्ररूप-13 में े घोषणा भी मजिस्ट्रटे या किसी अन्य अधिकारी जो आपके हस्ताक्षर सत्यापन करने में सक्षम हो (देि खए उपरोक्त हिदायतें 7) की उपस्थिति में हस्ताक्षर करने हैं। घोषणा ऐसे अधिकारी के पास ल े जाएं और उसकी आपकी पहचान के बार े में सन्तुष्टि होने के बाद उसकी उपस्थिति मं े इसे हस्ताक्षर कर।ें अधिकारी घोषणा पर आपके हस्ताक्षर सत्यापित करेगा तथा आपको लौटाएगा। आपको अपना मतपत्र तसदीक अधिकारी को ना तो दिखाना है और न ही उसे बताना है कि आपने किस प्रकार मत दिया है। (ग) यदि आप निक्षरता, अन्धेपन या अन्य अषक्तता के कारण उपरोक्त सूचित रीति मं े स्वयं मतपत्र चिहि्‌नत करने और अपनी घोषणा हस्ताक्षर करने मं े असमर्थ हं ै तो आप मद (ख) म ें निर्दिष्ट किसी अधिकारी द्वारा आपकी ओर से आपका मत चिहि्‌नत करने और घोषणा हस्ताक्षरित करने के लिये हकदार हैं। ऐसा अधिकारी आपकी प्रार्थना पर आपकी उपस्थित में और आपकी इच्छा के अनुसार मतपत्र को चिहि्‌नत करेगा। वह इस निमित आवष्यक प्रमाणपत्र भी पूरा करेगा।

(घ) आपकी घोषणा हस्ताक्षरित किए जाने और आपके हस्ताक्षर मद (ख) या मद (ग) के अनुसार अनुप्रमाणित किए जाने के पष्चात प्ररूप-13 मं े घोषणा, मतपत्र अन्तर्विष्ट करने वाले ''क'' चिहि्‌नत छोटे लिफाफे, ''ख'' चिहि्‌नत बड ़े लिफाफे में रखे। बड़े लिफाफे को बंद करने के पष्चात उसे डाक द्वारा या संदेषवाहक द्वारा रिटर्निग अधिकारी को भेज दं।े आपका े चिहि्‌नत लिफाफे पर उपलब्ध स्थान पर पूरे हस्ताक्षर करने हैं। आप द्वारा कोई भी डाक टिकट लगानी आवष्यक नहीं है।

(ङ) आप सुनिष्चित कर लं े कि लिफाफा चुनाव अधिकारी के पास......................................** को................बजे से पूर्व पहुंच जाए।

(च) कृपया यह भी ध्यान रख ें कि :-

The 14th November, 2018

No. 2/10/20018-RII .— In exercise of the powers conferred by sub-section (1) of Section 32 of the Haryana Municipal Corporation Act, 1994 (16 of 1994) and in consultation with State Election Commission, the Governor of Haryana hereby makes the following rules further to amend the Haryana Municipal Corporation Election Rules, 1994, namely :-

1. These rules may be called the Haryana Municipal Corporation Election (Amendment) Rules, 2018.

2. In the Haryana Municipal Corporation Election Rules, 1994 (hereinafter called the said rules), in the Preamble, for the words ―holding election of the membersǁ, the words ―holding election of the Mayor and membersǁ shall be substituted.

3. In the said rules, in rule 2, in clause (h), for the words ―the membersǁ, the words ―the Mayor and membersǁ shall be substituted.

4. In the said rules, for rule 23, the following rule shall be substituted, namely:-

―23. Disqualifications for Mayor and members. - (1) A person shall be disqualified for being chosen as, and for being a Mayor and member of the Corporation, if he incurres any of the disqualification as mentioned in section 8.

(2) No person shall be eligible for election as a Mayor and member of the Corporation who, in the case of a seat reserved for Scheduled Castes, Backward Classes or woman, is not a member of any of these categories.''

5. In the said rules, in rule 24-,

(i) in sub-rule (1), for the words ―ineligible for membershipǁ, the words ―ineligible for Mayor or membershipǁ shall be substituted;

(ii) in sub-rule (4), for the words ― for election in the same wardǁ, the words ―for election of Mayor and member in the same wardǁ shall be substituted; and

(iii) in the proviso of sub-rule (4), for the words ―for election in the same wardǁ, the words ―for election of Mayor or member in the same wardǁ shall be substituted.

6. In the said rules, in rule 25,-

(i) for sub-rule (1), the following sub-rule shall be substituted, namely:-

―(1) The nomination paper of a candidate shall not be deemed to have been duly delivered unless at the time of delivery of the same under rule 24, the candidate has either deposited or causes to be deposited a sum shown in the table below with the Deputy Commissioner in cash or enclose with the nomination paper a receipt showing that the said sum has been deposited in the treasury, or Government promissory notes of equal value at the market rate of the day:-

Provided that where a candidate has filed more than one nomination paper for election of Mayor and member in the same ward, not more than one deposit shall be required by him under this sub-rule.ǁ3622 HARYANA GOVT. ―Provided that, if a candidate has filed a nomination paper at an election of Mayor or member in more than one ward, not more than one of the deposits made by him or on his behalf shall be returned and the remainder shall be forfeited by the Government.ǁ

7. In the said rules, in rule 32, in sub-rule (1), for the words ―one candidate in any ward,ǁ the words ―one candidate for Mayor or member in any ward,ǁ shall be substituted.

8. In the said rules, for rule 33, the following rule shall be substituted, namely.-

―33. Poll to be taken if number of candidate is more than number of vacancies.- If the number of contesting candidate for Mayor and for member in any ward is more than one, a poll shall be taken.ǁ 9. In the said rules, in rule 34, for the words ―member in the ward or wards in which he was a candidateǁ, the words ―Mayor or member in the ward or wards in which he was a candidateǁ shall be substituted.

10. In the said rules, in rule 63, for the words ―if no fresh poll is required to be held in that wardǁ, the words ―if no fresh poll is required to be held for Mayor and for member in that wardǁ shall be substituted.

11. In the said rules, for rule 71, the following rule shall be substituted, namely:-

―71. Oath of allegiance of the office of Mayor and members, and term of the office of Mayor, Senior Deputy Mayor and Deputy Mayor etc.- (1) The Divisional Commissioner shall, within a period of thirty days of the notification of the names of the Mayor and members elected to the Corporation, convene and preside over the first meeting of the newly constituted Corporation at forty eight hours notice to be delivered at the ordinary place of residence of elected Mayor and members. The notice shall clearly state the Oath of allegiance shall be administered to the Mayor and members present.

(2) The Commissioner shall, within a period of sixty days of the notification of the names of the Mayor and members elected to the Corporation convene a meeting of the Corporation at forty eight hours notice to be delivered at the ordinary place of residence of Mayor and members. The notice shall clearly state that the election of Senior Deputy Mayor and Deputy Mayor shall be held in this meeting to be presided over by the Mayor in the presence of the Commissioner.

(3) The Divisional Commissioner shall administer the oath of allegiance to the Mayor and members present as prescribed in section 33.

(4) The oath of allegiance shall be administered to a Mayor and member who was not present at the meeting convened under sub-rule (3) or to a member elected or nominated to fill a casual vacancy, subsequently by the Mayor and in the case of Mayor by the Divisional Commissioner concerned.

(5) The term of the office of Mayor shall be for five years or the residue of the term of his office.

(6) The term of the office of Senior Deputy Mayor and Deputy Mayor shall be for five years or the residue of the term of his office as a member, whichever is less. The Senior Deputy Mayor and Deputy Mayor shall be elected from amongst the Members of the Corporation.

(7) The offices of the Mayor in the Corporations shall be filled through direct election by the electors from amongst the persons belonging to the General Category, Scheduled Castes, Backward Classes and Women by rotation which shall determined in the manner that the number of offices of the Mayor reserved for the Scheduled Castes and Backward Classes in the State shall bears as may be the same proportion to the total number of such the offices of the Corporation as the population of Scheduled Castes and Backward Classes in the State bears to the total population of the State:

Provided that not less than one third of the total number of offices of the Mayor in the Corporations shall be reserved for Women including the offices reserved for Scheduled Castes and Backward Classes Women. The reservation of offices for women shall rotate to different Corporations, which shall be determined by draw of lots, by a Committee consisting of Director, Urban Local Bodies Department, Divisional Commissioner and Commissioner of the concerned Corporation:

Provided further that number of offices of the Mayor for Scheduled Castes and Backwar d Classes shall be determined on the basis of their population and shall rotate to different remaining Corporation firstly, having largest population of Scheduled Castes, secondly, from the remaining Corporations having largest population of Backward Classes and they rotate in the subsequent terms of offices of the Corporation having their next largest population and so on. In case of percentage of population of two Corporations as regards Backward Classes and Scheduled Castes is the same, the reservation shall be determined by draw of lots to be conducted by a Committee referred in the above proviso.

12. In the said rules, in rule 72 .-

(i) in existing marginal heading, the following marginal heading shall be substituted, namely:-

―Election of Senior Deputy Mayor and Deputy Mayor.ǁ; and

(ii) in sub-rule (1), the word and sign ―Mayor,ǁ shall be omitted.

13. In the said rules, in rule 73, the word and sign ―Mayor,ǁ wherever occurring shall be omitted.

14. In the said rules, in rule 75 .-

(i) in the marginal heading, the word and sign ―Mayor,ǁ shall be omitted; and

(ii) in sub-rule (2) the words ―Mayor orǁ shall be omitted; and

(iii) in sub-rule (4), in proviso, the words ―Mayor orǁ, shall be omitted.

15. In the said rules, in rule 78 .-

(i) in sub-rule (1), for the words ―No election of memberǁ, the words ―No election of Mayor or memberǁ shall be substituted; and

(ii) in sub-rule (2), for the words ―Mayor orǁ shall be omitted.

16. In the said rules, for the existing Form Number 1, 1-C, 1-D, 2, 2 A, 2 B, 3, 4, 5, 6, 7, 8, 9, 10, 11, 13, 14, 15, 16 and 17, the following forms shall be substituted, namely :-

The person whose names are printed on the ballot paper sent herewith are candidates at the above election. If you desire to vote you shall record your vote in accordance with the directions given in Part-I below and then follow the instructions detailed in Part-II.

PART – I

DIRECTIONS TO ELECTORS

1. The number of members to be elected is one.

2. You have only one vote.

3. You must not vote for more than one candidate. If you do so your ballot paper shall b e rejected.

4. Record the vote by placing clearly a mark opposite the name of the candidate to whom you wish to give that vote.

5. The mark shall be so placed as to indicate clearly and beyond doubt to which candidate you are giving your vote. If the mark is so placed as to make it doubtful to which candidate you have given the vote, that vote shall be invalid.

6. Do not put your signature or write any word or make any mark, sign or writing whatsoever on the ballot paper other than the mark which you are required to make thereon in accordance with paragraph 4.

INSTRUCTIONS FOR ELECTORS

(a) After you have recorded your vote on the ballot, place the ballot paper in the smaller cover marked ―Aǁ sent herewith. Close the cover and secure it by seal or otherwise.

(b) You have then to sign the declaration in Form 13 also sent herewith in the presence of a Magistrate or any other Officer competent to attest your signature (see direction 7 a bove). Take the declaration to any such Officer and sign it in his presence after he has been satisfied about your identity. The Officer shall attest your signature and return the declaration to you. You must not show your ballot paper to the Attesting Officer nor tell him how you have voted.

(c) If you are unable to mark the ballot paper and sign the declaration yourself in the manner indicated above by reason of illiteracy, blindness or other infirmity you are entitled to have your vote marked and the declaration signed on your behalf by any Officer referred to in item (b). Such an Officer shall at your request mark the ballot paper in your presence and in accordance with your wishes. He shall also complete the necessary certificate in this behalf.

(d) After your declaration has been signed and your signature has been attested in accordance with item (b) or item (c) place the declaration in Form 13 as also the smaller cover marked ―Aǁ containing ballot paper, in the larger cover marked ―Bǁ. After closing the larger cover, sent it to the Returning Officer by post or by messenger.
