संख्या 32/16/2013-4आई०बी०-1.- चूंकि हरियाणा के राज्यपाल की सन्तुष्टि हो गई है कि नीचेे विनिर्दिष्ट भूमि सरकार द्वारा, सरकारी खर्च पर, सार्वजनिक प्रयोजन अर्थात्‌ गांव घाटल महानीयावास, महेशवरी, गढ़ी अलावलपुर, मालपुरा, धारुहेड़ा, तहसील धारुहेड़ा, तथा गांव खरखड़ा, डूंगरवास, कालियावास, रसगाव, तहसील तथा जिला रेवाड़ी, में हरियाणा राज्य औद्योगिक अवसंरचना विकास निगम लिमिटिड द्वारा मास रैपिड ट्रांसपोेर्ट सिस्टम और सहबद्ध उपयोगों, दिल्ली-मुंबई औद्योगिक कॉरिडोर परियोजना के अधीन एक अरली बर्ड परियोजना है, के विकास के लिए अपेक्षित है। जिसके लिए भूमि अर्जन अधिनियम, 1894 (1894 का अधिनियम 1), की धारा 4 के अधीन हरियाणा सरकार, उद्योग तथा वाणिज्य विभाग, अधिसूचना संख्या 32/16/2013-4आई०बी०-1, दिनांक 31 दिसम्बर, 2013 को प्रकाषित की गई है, इसके द्वारा, यह घोषित किया जाता है कि नीचे विषिष्टियों में वर्णित भूमि उपर्युक्त प्रयोजन के लिए अपेक्षित है;

श्री विजयपाल तथा अन्य ने याचिका संख्या 7874 ऑफ 2014 द्वारा उक्त अधिसूचना दिनांक 31 दिसम्बर, 2013 को चुनौती दी तथा माननीय पंजाब तथा हरियाणा उच्च न्यायालय ने अपने आदेष दिनांक 28 अप्रैल, 2014 द्वारा विवादित अधिसूचना की प्रक्रिया पर स्थगन आदेष पारित कर दिए। माननीय उच्च न्यायालय ने अपने आदेष दिनांक 05 सितम्बर, 2017 द्वारा इस याचिका तथा अन्य सम्बन्धित याचिकाओं (कुल 12 सी.डब्ल्यू.पी.) का निर्णय करते हुए, अधिसूचना दिनांक 31 दिसम्बर, 2013 को याचिकाकर्ताओं की भूमि के अनुरूप खारिज कर दिया। माननीय पंजाब तथा हरियाणा उच्च न्यायालय के आदेष दिनांक 05 सितम्बर, 2017 को हरियाणा राज्य औद्योगिक अवसंरचना विकास निगम लिमिटिड ने एकल एस.एल.पी. संख्या 23433-23444 ऑफ 2018 - हरियाणा राज्य औद्योगिक अवसंरचना विकास निगम लिमिटिड तथा अन्य बनाम श्री विजयपाल यादव तथा अन्य के द्वारा चुनौती दी गई। माननीय सर्वाेच्च न्यायालय ने आदेष दिनांक 24 अगस्त, 2018 को माननीय पंजाब तथा हरियाणा उच्च न्यायालय द्वारा पारित विवादित निर्णय दिनांक 05 सितम्बर, 2017 पर अभ्यंतर में कारवाई पर रोक लगा दी। माननीय सर्वाेच्च न्यायालय के उक्त कथित आदेषों की अनुपालना में तथा भूमि अर्जन अधिनियम, 1894 (1894 का अधिनियम 1), के उपबन्धों में इसके द्वारा, तत्काल घोषणा जारी की गई है।

यह घोषणा भूमि अर्जन अधिनियम, 1894 (1894 का अधिनियम 1), की धारा 6 के साथ पठित भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्षिता अधिकार अधिनियम, 2013, (2013 का अधिनियम 30), की धारा 24 की उप-धारा (1) के खण्ड (क) के उपबन्धों के अधीन उन सभी व्यक्तियों की जानकारी के लिए की जाती है, जिनका इससे सम्बन्ध है।

भूमि के नक्शों का निरीक्षण जिला राजस्व अधिकारी-एवं-भूमि अर्जन कलक्टर, रेवाड़ी के कार्यालय में किया जा सकता है।

Notification

The 16th November, 2018

No. 32/16/2013-4IB-I.— Whereas, the Governor of Haryana is satisfied that the land specified below, is needed by the Government, at public expense, for a public purpose, namely, for development of Mass Rapid Transport System and allied uses, an early bird project under the Delhi-Mumbai Industrial Corridor project, in villages Ghatal Mahaniwas, Maheshwari, Garhi Alawalpur, Malpura, Dharuhera, tahsil Dharuhera, and villages Kharkhada, Dungarwas, Kaliyawas and Rasgaon, tahsil and district Rewari, by Haryana State Industrial Infrastructure Development Corporation Limited, for which Haryana Government, Industries and Commerce Department, Notification No. 32/16/2013-4IB-I, dated 31st December, 2013 under section 4 of Land Acquisition Act, 1894 (Act 1 of 1894), has been published. It is hereby declared that the land described in the specifications below is needed for the above purpose;

Sh. Vijay Pal and others challenged the aforesaid notification dated the 31st December, 2013 vide CWP No. 7874 of 2014 and the Hon'ble Punjab and Haryana High Court was pleased to order that the operation of the impugned notification shall remain stayed vide order dated the 28th April, 2014.This writ petition alongwith other connected cases (total 12 CWPs) were decided by the Hon'ble High Court vide order dated the 5th September, 2017 and the notification dated the 31st December, 2013 was ordered to be quashed qua the petitioners. Order dated the 05th September, 2017 of the Hon'ble High Court was challenged by Haryana State Industrial and Infrastructure Development Corporation Limited by way of filing single SLP No. 23433-23444 of 2018- Haryana State Industrial and Infrastructure Development Corporation Limited and others v. Vijay Pal Yadav and others. The Hon'ble Supreme Court vide order dated the 24th August, 2018 ordered that in the meanwhile there shall be stay of operation of the impugned judgment and order dated the 05th September, 2017 passed by the Hon'ble High Court. In pursuance to the aforesaid order of the Hon'ble Supreme Court and provisions of the Land Acquisition Act, 1894 (Act 1 of 1894), the instant declaration is hereby issued.

This declaration is made under the provisions of section 6 of the Land Acquisition Act, 1894 (Act 1 of 1894), read with clause (a) of sub-section (1) of section 24 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, for the information of all to whom it may concern.

Plans of the land may be inspected in the office of the District Revenue Officer-cum-Land Acquisition Collector, Rewari.
