क्रमांक एल.ए.सी (फ)-एन.टी.एल.ए/2018/5.— यह कि, भूमि अधिग्रहण अधिनियम 1894 (बाद में "अधिनियम" के रूप में संदर्भित) की धारा 4 के तहत अधिसूचना सैक्टर-3, फरीदाबाद के विकास हेतु भूमि अर्जन के लिए हरियाणा सरकार, शहरी सम्पदा विभाग द्वारा अधिसूचना क्रमांक एल.ए.सी-76-एन.टी.एल.ए/6433 दिनांक 10.11.1976 को हरियाणा राज पत्र (असाधारण) दिनांक 10.11.1976 में प्रकाषित की गई तथा हरियाणा सरकार, शहरी सम्पदा विभाग की अधिसूचना क्रमांक एल.ए. सी-79/एन.टी.एल.ए/5396 दिनांक 09.11.1979 द्वारा धारा 6 की अधिसूचना हरियाणा सरकार राज पत्र (असाधारण) 09.11.1979 को प्रकाषित की गई है तथा अवार्ड नं0 9, गांव सिही, हदबस्त नं0 80 दिनांक 30.11.1981 को घोषित किया गया। तथा यह कि, इस अर्जित भूमि पर विभिन्न निर्माण के साथ घनी आबादी वाली कालोनियां बनी हुई हैं। तथा यह कि, इस कालोनी के अन्र्तगत आने वाली भूमि का उपयोग मुख्य प्रषासक, हरियाणा शहरी विकास प्राधिकरण द्वारा सम्बन्धित सैक्टर के लिए ले-आउट प्लान के अनुसार नहीं किया गया है।

अब, इसलिए, भूमि अर्जन पुनर्वास और पुनःस्थापन में निष्पक्ष मुआवजा और पारदर्षिता अधिनियम 2013 की धारा 101ए (हरियाणा संषोधन) अधिनियम 2017 के अन्तर्गत अधिकारों का प्रयोग करते हुए राज्यपाल हरियाणा नीचे दी गई तालिका में, दी गई भूमि को तत्काल प्रभाव से डी-नोटिफाईड करते हैं तथा इस प्रकार यह भूमि पुनः भू-मालिकों के नाम हो जाएगी। यहां पर यह भी सूचित किया जाता है कि भू-मालिकों को भूमि के लिए, लिए गए मुआवजे की राषि को भूमि अर्जन अधिकारी, फरीदाबाद को ब्याज सहित भूमि अर्जन अधिनियम 1894 के प्रावधानों के तहत इस अधिसूचना के प्रकाषित होने के 30 दिन के भीतर वापिस करनी होगी। ऐसा न करने पर मुआवजे की राषि अब तक के ब्याज सहित बतौर भू-राजस्व के बकाया के रूप में वसूल की जाएगी।

No. LAC (F)-NTLA/2018/5.—Whereas, Notification under Section 4 of the Land Acquisition Act, 1894 (hereinafter referred to as the "Act"), for acquisition of land for development of Sector-3, Faridabad was issued vide Haryana Government Urban Estates Department Notification No. LAC-76-NTLA/6433 dated 10.11.1976 published in Haryana Government Gazette (Extraordinary) dated 10.11.1976 and declaration under Section-6 of the Act was made vide Haryana Government Urban Estates Department Notification No. LAC-79-NTLA/5396 dated 09.11.1979 published in Haryana Government Gazette (Extraordinary) dated 09.11.1979 and Award No. 9 of Village Sihi, Hadbast No. 80 was announced on 30.11.1981.

And whereas there are thickly populated colonies with various constructions on the acquired land;

And whereas the Chief Administrator, Haryana Shehri Vikas Pradhikaran has stated that the land falling under these colonies have not been utilised as per Layout Plan of respective sector;

Now, therefore, in the exercise of powers conferred by Section 101-A of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement, Act, 2013 read with the (Haryana Amendment) Act, 2017, the Governor of Haryana, hereby de-notifies the land as specified in table below with immediate effect and thus the land would now re-vest in the name of the landowners. It is further mentioned that the landowners shall have to refund the compensation to LAO, Faridabad along with interest as per provisions of the Act of 1894 within 30 days from the date of publication of the de-notification, failing which the compensation along with interest up to date shall be recovered as an arrear of land revenue.
