अभियोजन विभाग, हरियाणा की वर्ष 2017-18 की वार्षिक प्रषासनिक रिपोर्ट पर समीक्षा।

क्रमांक ए०पी० (3)-2018/24601.— अभियजन विभाग जिला न्यायवादियों, उप जिला न्यायवादियो और सहायक जिला न्यायवादियों के काडर को नियंत्रित करता है। जिला न्यायवादी, उप जिला न्यायवादी और सहायक जिला न्यायवादी वर्ग के अधिकारी दण्ड प्रक्रिया संहिता और सिविल प्रोसिजर कोड की विभिन्न धाराओं के अन्तर्गत राज्य सरकार की ओर से कोर्टस में केसों की पैरवी करने के लिए लोक अभियोजक, सहायक लोक अभियोजक और गवर्नमैंट प्लीडरस घोषित होेते हैं। इसके साथ-साथ उन द्वारा जिन-जिन केसों की विभिन्न न्यायालयों में सरकार की ओर से पैरवी की होती है, उनसे सम्बन्धित निर्णयों का निरीक्षण करके उस पर अपनी मंत्रणा देते हैं कि क्या दिए गए निर्णय पर अपील दायर की जाए या नहीं। इसके अतिरिक्त काफी संख्या में जिला न्यायवादी, उप जिला न्यायवादी और सहायक जिला न्यायवादी वर्ग के अधिकारी राज्य सरकार के विभिन्न विभागों/निगमों और बोर्डों में उन्हें कानूनी सलाह देने और उनके कानूनी केसों को निपटाने के लिए नियुक्त है ताकि विवाद कम हो सके।
वर्ष के आरम्भ में राज्य में कार्य कर रही सैषन कोर्टस 11615 फौजदारी केस लम्बित थे और वर्ष के दौरान 11301 ये केसिज कोर्टस में दायर हुए। इन केसों में से वर्ष के दौरान 7643 केसों का निपटान करवाया गया तथा विभिन्न लोअर कोर्टस में वर्ष के आरम्भ में 119505 केस लम्बित थे और वर्ष के दौरान 68682 नये केसिज कोर्टस में दायर हुए। इन केसों में से वर्ष के दौरान 50684 केसो का निपटान करवाया गया है। एन०डी०पी०एस० एक्ट और विभिन्न स्थानीय एक्टस के अन्तर्गत दायर/दर्ज किये गये केसों में सजा होने की प्रतिषतता काफी संतोषजनक रही है। इसके अतिरिक्त इस वर्ष के दौरान सजा हुए केसों की समस्त प्रतिषतता सैषन कोर्टस में 38 प्रतिषत तथा लोअर कोर्टस में 51 प्रतिषत रही है।
विधि अधिकारियों के कार्य एवं सामथ्र्य में सुधार लाने के लिए कई पग उठाये गए हैं। इन अधिकारियों को फौरेंसिक साईंस लैबोरट्री, मधुबन और राष्ट्रीय संस्थान क्रिमिनोलोजी एवं फौरेंसिंक साईंस, गृह मंत्रालय दिल्ली में फौरेंसिंक विज्ञान से सम्बन्धित केसों की पैरवी करने के लिए प्रषिक्षण भी दिया जा रहा है। लम्बित केसों की संख्या कम करने और केसों के शीघ्र निपटान के लिए प्रषासन को प्रभावषाली बनाने हेतू उनके नियमित निरीक्षण द्वारा हर सम्भव प्रयत्न किए जा रहे हैं। रिपोर्टाधीन अवधि के दौरन निदेषक अभियोजन के कार्यालय का कार्यभार श्री नरषेर सिंह के पास रहा।े चण्डीगढ़ः दिनाक 21 अक्तूबर, 2018.

Review of the Annual Administrative Report of the Prosecution Department, Haryana
for the Year 2017-2018

No. AP.(3)-2018/24601.— The Directorate of Prosecution controls the cadres of District Attorneys, Deputy District Attorneys and Assistant Attorneys. The District Attorneys Deputy District Attorneys and the Assistant District Attorney are further designated as Public Prosecutors, Assistant Public Prosecutors and Government pleaders under the provisions of the Criminal Procedure Code and Civil-Procedure Code respectively for the purpose of conducting criminal and civil cases on behalf of the State. In addition, they scrutinize the judgments passed by the various courts and tender their opinion as to whether the judgment passed is fit for filing futher appeal or not. Beside, there is a considerable number of District Attorneys, Deputy District Attorneys and the Assistant District Attorneys posted in various Department/Corporations/Boards of the State to tender legal opinion and handle the legal matters arising out in the respective Departments/Boards/Corporations with a view to minimize the litigation.
2. At the outset of the year under report 11615 cases were pending before the various Sessions Courts for disposal. As many as 11301 cases were added during the year. Out of these cases 7643 cases were got disposed off during the year. 119505 cases were pending before the various Lower Courts for disposal and 68682 cases were added during the year. Out of these cases 50684 cases were got disposed off during the year. The percentage of conviction in cases registered under the NDPS Act and various Local Acts was quite satisfactory. The over all reate of conviction in Sessions Courts is 38% and in Lower Courts 51%.
3. Various steps to improve the working and efficiency of the Law Officers have been initiated. Officers have been sent for training in the fields of Forensic Science and Forensic Science Laboratory, Madhuban, Karnal as well as National Institute of the Criminology and Forensic Science, Ministry of Home Affairs at Dephi. Their knowledge to tackle the cases relating to Cyble Crime has also been updated. All out efforts have been made to tone up the administration by making regular monitoring and review of the pendency of the cases on regular intervals with a view to reduce the back log and ensure quick disposal of the cases.
4. The charge of the office of the Director of Prosecution, Haryana during the period under report was held by Sh. Narsher Singh.
