संख्या सा०का०नि० 3/संवि०/अनु० 309/2019.— भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा सिविल सेवा (कार्यकारी शाखा) नियम, 2008, को आगे संशोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्् :-
1. ये नियम हरियाणा सिविल सेवा (कार्यकारी शाखा) संशोधन नियम, 2019, कहे जा सकते हैं।
2. हरियाणा सिविल सेवा (कार्यकारी शाखा) नियम, 2008 में, नियम 10 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात््ः-
''10. पंजिका क-ाा के लिए उम्मीदवारों का चयन .- (1) आयोग ग्रुप ग सेवा के पात्र सदस्यों से प्रार्थना पत्र आमंत्रित करेगा जो हरियाणा के विभागाध्यक्षों द्वारा उनके प्रशासकीय सचिवों के माध्यम से विहित प्ररूप-1 में, वार्षिक गोपनीय रिपोर्टाें के सांराश के मूल्यांकन तथा सत्यनिष्ठा प्रमाण पत्रों सहित अनुशंसित प्राधिकारियों द्वारा सम्यक रूप से हस्ताक्षरित, आयोग के समक्ष प्रस्तुत किये जाएंगे ।
(2) ग्रुप ग सेवा के केवल ऐसे सदस्य का नाम उप-नियम (1) के उपबन्धों के अधीन प्रस्तुत किये जाएंगे जिन्होंने -
(क) (i) लगाातार सरकारी सेवा के आठ वर्ष पूरे कर लिए हाें;
(ii) सम्बद्व प्राधिकारियों द्वारा नामों के प्रस्तुतिकरण की तिथि से ठीक पहले नवम्बर के प्रथम
दिन को पचास वर्ष की आयु पूरी न की हो;
(iii) अनुशासनिक कार्यवाहियों का सामना न कर रहा हो तथा उसके विरुद्ध कार्यवाही करनी
अपेक्षित न हो; तथा
(iv) सतर्कता के दृृष्टिकोण से निर्दोष है।
(ख) किसी मान्यताप्राप्त विश्वविद्यालय से स्नातक हो।
(3) आयोग उप-नियम (1) के अधीन सभी ऐसे सिफारिश किए गए उम्मीदवारों को सभी पात्रता शर्तों को पूरा करने के अधीन रहते हुए अस्थाई रूप से लिखित परीक्षा में उपस्थित होने की अनुमति देगा और लिखित परीक्षा आयोजित करने के बाद, आयोग उम्मीदवारों की सूची तैयार करेगा जो कि रिक्तियों की संख्या का तीन गुणा जमा कोष्ठक उम्मीदवारों सहित यदि कोई हो। उसके बाद, सभी उम्मीदवारों जिनके नाम उक्त सूची में हैं, के मूल रिकॉर्ड को, आयोग द्वारा उनके विभागाध्यक्षों से लिया जाएगा। मूल रिकॉर्ड की संवीक्षा के बाद, पात्र उम्मीदवारों का साक्षात्कार, आयोग द्वारा आयोजित किया जाएगा।
(4) उप-नियम (3) के अधीन तैयार सूची से उम्मीदवारों के अंतिम चयन के लिए, आयोग उम्मीदवारों की उपयुक्तता वार्षिक गोपनीय रिपोर्ट, अनुभव और साक्षात्कार में प्रदर्शन के आधार पर निर्धारित करेगाः
परन्तु अंतिम चयन में शामिल आयोग के सदस्य प्रत्येक उम्मीदवार के सम्बन्ध में प्रमाणित करेंगे कि उनके साथ उनका कोई संबंध नहीं है।
(5) आयोग इसके बाद, योग्यता क्रम में तथा रिक्तियों की संख्या के बराबर, अति उपयुक्त व्यक्तियों को स्वीकृत उम्मीदवारों के रूप में पंजिका क-ाा में उनके नाम दर्ज करने के लिए सिफारिश की जाएगी और इस पंजिका में उनके नाम दर्ज किए जायेंगे, जिस क्रम में वे आयोग द्वारा सिफारिश किए गए हैं।''

Notification
The 4th January, 2019
No. G.S.R. 3/Const./Art.309/2019.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Civil Service (Executive Branch) Rules, 2008, namely:-
1. These rules may be called the Haryana Civil Service (Executive Branch) Amendment Rules, 2019.
2. In the Haryana Civil Service (Executive Branch) Rules, 2008, for rule 10, the following rule shall be substituted, namely:-
"10. Selection of Candidates for Register A-II.- (1) The Commission shall invite applications from amongst the eligible members of Group-C Service, which shall be submitted to the Commission by the Heads of Departments of Haryana through their Administrative Secretaries in the prescribed Form-I, alongwith summary of Annual Confidential Reports grading and integrity certificates duly signed by the recommending authorities.
(2) The name of only such a member of Group-C Service shall be submitted under the provisions of sub-rule (1) who-
(a) (i) has completed eight years continuous Government Service;
(ii) has not attained the age of fifty years on the first day of November immediately preceding the date of submission of names by the concerned authorities;
(iii) is not facing disciplinary proceedings and against whom action is not being contemplated; and
(iv) is clear from vigilance angle;
(b) is a Graduate from a recognized University.
(3) The Commission shall allow all such candidates recommended under the provisions of sub-rule (1) to appear in the written examination provisionally subject to the fulfillment of all eligibility conditions and after conducting a written test, the Commission shall prepare a list of candidates, three times the number of vacancies plus bracketed candidates, if any. Thereafter, the original record of all candidates whose names appear in the said list shall be summoned by the Commission from their Heads of Departments. After scrutiny of original record, interview of eligible candidates shall be conducted by the Commission.
(4) For final selection of the candidates from the list prepared under sub-rule (3), the Commission shall determine the suitability of candidates on the basis of Annual Confidential Reports, experience and performance in the interview:
Provided that the members of the Commission involved in the final selection, shall certify in respect of each candidate that they have no relation with them.
(5) The Commission, thereafter, shall recommend, in order of merit and equal to the number of vacancies, the most suitable persons for entering their names in Register A-II, as accepted candidates and these names shall be entered in this register, in the order in which they are recommended by the Commission."
