Notification

No. LAC(H)-NTLA-2018/603.— Whereas, Notification under Section 4 of the Land Acquisition Act, 1894 (hereinafter referred to as the "Act"), for acquisition of land for development of Sector-21, 22 Part, Sirsa was issued vide Haryana Government Urban Estates Department Notification No. LAC (H)-2008/NTLA/393 dated 15.01.2008 published in Haryana Government Gazette (Extraordinary) dated 15.01.2008 and declaration under Section-6 of the Act was made vide Haryana Government Urban Estates Department Notification No. LAC(H)-2009/NTLA/465 dated 14.01.2009 published in Haryana Government Gazette (Extraordinary) dated 14.01.2009. A corrigendum of the declaration under Section-6 dated 14.01.2009 was also issued vide no. LAC (H)-2010/508 dated 24.12.2010 and published in Haryana Government Gazette (Extraordinary) dated 24.12.2010. Award under Section-11 of the Act was announced on 12.01.2011 vide Award No. 7 of Village Vaidwala, Hadbast No. 76, Award No. 7 of Village Khairpur, Hadbast No. 79 and Award No.7 of Village Nejadela, Hadbast No. 154.
And whereas, the scheme of acquisition for the acquisition of land in question has become unviable due to enhancement of compensation in the references filed by the landowners under Section-18 of the Act;
And whereas, the land falling under both sectors has not been utilised by the Haryana Shehri Vikas Pradhikaran, Panchkula;
Now, therefore, in the exercise of powers conferred by section 101 A of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement, Act, 2013 read with the (Haryana Amendment) Act, 2017, the Governor of Haryana, hereby de-notifies the land as specified in table below with immediate effect and thus the land would now re-vest in the name of the landowners.

(EXTRA.), JAN. 10, 2019 (PAUS. 20, 1940 SAKA) Any person interested or land owner(s) shall file his/her claim in writing before the Land Acquisition Collector, Urban Estates Department Haryana, Hisar within a period of 30 days of publication of this notification in the official gazette, so as to enable him to complete the process of reversion of the land after deciding the claims as per law.
The landowner(s) or their legal heir, as the case may be, shall refund the compensation along with interest as per provisions of the Act to the Land Acquisition Officer, Hisar within 30 days from the date of demand, failing which the compensation along with interest up to date shall be recovered as an arrear of land revenue.
Note:- This de-notification is subject to quantification of damages and other legal compliances as per the notification issued by the Revenue and Disaster Management Department, Haryana vide No. 2178-R-5-2018/8500 dated 14.09.2018.
