संख्या सा०का०नि० 12/संवि०/अनु० 309/2019.— भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा राजस्व (ग्रुप-क) सेवा नियम, 1997, को आगे संशोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. ये नियम हरियाणा राजस्व (ग्रुप-क) सेवा (संशोधन) नियम, 2019, कहे जा सकते हैं।

2. हरियाणा राजस्व (ग्रुप-क) सेवा नियम, 1997 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) मेें, नियम 2 में, (i) खण्ड (ख) के स्थान पर, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थात्‌ :—

'(ख) "वित्तायुक्त राजस्व" से अभिप्राय है, अपर मुख्य सचिव एवं वित्तायुक्त राजस्व ;

(ii) खंड (घ) मेेें, उप-खंड (ii) का लोप कर दिया जाएगा।

3. उक्त नियमों में, नियम 5 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ ;

"5 अर्हताएं तथा अनुभव.- कोई भी व्यक्ति, सेवा में किसी भी पद पर तब तक नियुक्त नहीं किया जाएगा जब तक वह इन नियमों के परिषिष्ट ख के खाना 4 में विनिर्दिष्ट अर्हताएं तथा अनुभव न रखता हो।"।

4. उक्त नियमों में, नियम 7 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ :—

"7 भर्ती का ढंग.-(1) सेवा में भर्ती निम्नलिखित ढंग से की जाएगी,-

(क) उप सचिव (प्रोजेक्ट इन्चार्ज) (असेट मैनेजमैन्ट सैल) की दषा में ,-

(i) जिला राजस्व अधिकारियों में से पदोन्नति द्वारा ; या

(ii) किसी राज्य सरकार या भारत सरकार की सेवा में पहले से ही लगे किसी अधिकारी के स्थानान्तरण या प्रतिनियुक्ति द्वारा ;

(ख) जिला राजस्व अधिकारी की दषा में ,-

(i) तहसीलदारों में से पदोन्नति द्वारा ; या

(ii) किसी राज्य सरकार या भारत सरकार की सेवा में पहले से ही लगे किसी अधिकारी के स्थानान्तरण या प्रतिनियुक्ति द्वारा ;

(2) पदोन्नति द्वारा नियुक्ति ज्येष्ठता एवं योग्यता के आधार पर की जाएंगी और केवल ज्येष्ठता ही ऐसी पदोन्नतियों के लिए कोई अधिकार प्रदान नहीं करेगी।"।

5. उक्त नियमों में, नियम 12 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

"12 अनुषासन, शास्तियां तथा अपीलें.- (1) अनुषासन, शास्तियों तथा अपीलों से सम्बन्धित मामलों में, सेवा के सदस्य समय-समय पर यथा संषोधित हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016, द्वारा शासित होंगे :

परन्तु ऐसी शास्तियों का स्वरूप, जो लगाई जा सकती हैं, ऐसी शास्तियां लगाने के लिए सषक्त प्राधिकारी तथा अपील प्राधिकारी भारत के संविधान के अनुच्छेद 309 के अधीन बनाई गई किसी विधि या नियमों के उपबन्धों के अधीन रहते हुए वे होंगे, जो इन नियमों के परिषिष्ट ग में विनिर्दिष्ट हैं।

(2) हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016, के नियम 9 के अधीन आदेष करने के लिए सक्षम प्राधिकारी तथा अपील प्राधिकारी भी वही होंगें जो इन नियमों के परिषिष्ट घ में विनिर्दिष्ट हैं।"।94 HARYANA GOVT. The 22nd February, 2019

No. G.S.R.-12/Const./Art. 309/2019.― In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further amend the Haryana Revenue (Group-A) Service Rules, 1997, namely :-

1. These rules may be called the Haryana Revenue (Group-A) Service (Amendment) Rules, 2019.

2. In the Haryana Revenue (Group-A) Service Rules, 1997 (herein after called the said rules), in rule 2,- (i) clause (b), the following clause shall be substituted, namely :-

'(b) "Financial Commissioner Revenue" means the Additional Chief Secretary and Financial Commissioner Revenue ;';

(ii) In clause (d), sub clause (ii) shall be omitted.

3. In the said rules, for rule 5, the following rule shall be substituted, namely :-

"5. Qualification and experience.- No person shall be appointed to the Service unless he is in possession of qualification and experience specified in column 4 of Appendix B to these rules.".

4. In the said rules, for rule 7, the following rule shall be substituted, namely :-

"7. Method of recruitment.-(1) Recruitment to the Service shall be made,-

(a) in the case of Deputy Secretary [(Project In charge) (Asset Management Cell] -

(i) by promotion from amongst the District Revenue Officers; or

(ii) by transfer or deputation of an officer already in the service of the Government of India or a State Government ;

(b) in the case of District Revenue Officer-

(i) by promotion from amongst Tehsildars ; or

(ii) by transfer or deputation of an officer already in the service of the Government of India or a State Government ;

(2) Appointment by promotion shall be made on seniority-cum-merit basis and seniority alone shall not confer any right to such promotions .".

5. In the said rules, for rule 12, the following rule shall be substituted, namely:-

"12 Discipline, penalties and appeals.- (1) In the matter relating to discipline, penalties and appeals, members of the Service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016, as amended from time to time :

Provided that the nature of penalties which may be imposed, the authority empowered to impose such penalties and appellate authority shall, subject to the provisions of any law of rules made under article 309 of the Constitution of India, be such as are specified in Appendix C to these rules.

(2) The Authority competent to pass an order under rule 9 of the Haryana Civil Services (Punishment and Appeal) Rules, 2016, shall be as is specified in Appendix D to these rules.".
