General Review
विधि तथा विधायी विभाग हरियाणा की वर्ष 2016-17 की वार्षिक प्रषासनिक रिपोर्ट की समीक्षा। दिनांक 12 जुलाई, 2019

वर्ष 2016-2017 के लिए विधि तथा विधायी विभाग, हरियाणा की प्रषासनिक रिपोर्ट पर समीक्षा। हरियाणा सरकार के विधिक कार्यों के प्रषासन की रिपोर्ट के निम्नलिखित दो भाग हैंः-
(i) भाग-क विधिक कार्यों की रिपोर्ट जिससे विधि परामर्षी एवं प्रषासकीय सचिव, हरियाणा सरकार सम्बद्ध है । (ii) भाग-ख विधिक कार्यों की रिपोर्ट जिससे महाधिवक्ता, हरियाणा सम्बद्ध है ।
भाग क
पावतियाें तथा प्रेषणों की कुल संख्या क्रमष : 17298 तथा 33708 थी।
रिपोर्टाधीन अवधि के दौरान, विधि परामर्षी एवं प्रषासकीय सचिव के कार्यालय में सरकार के विभिन्न विभागों से 523 निर्देष मंत्रणा के लिए प्राप्त हुए और उनका उक्त कार्यालय की मंत्रणा शाखा द्वारा निपटान किया गया ।
सिविल कार्य/मूल वाद
रिपोर्टाधीन अवधि के दौरान प्रथम अप्रैल, 2015 से 31 मार्च, 2016 तक की अवधि के दौरान संस्थित 934 वादों की तुलना में सरकार की ओर से 22 वाद दायर किए गए जिससे प्रतीत होता है कि दायर किए गए वादों की संख्या कम हुई है। रिपोर्टाधीन वर्ष के दौरान निपटाए गए वादों की कुल संख्या 42 थी जिनमें से 19 वादों का सरकार के पक्ष में तथा 23 वादों का सरकार के विरूद्ध निर्णय हुआ। पिछले वर्ष 29.33 प्रतिषतता की तुलना में सरकार के पक्ष में निर्णीत वादों की प्रतिषतता 45.33 बनती है। इसी प्रकार पिछले वर्ष अर्थात् 2015-2016 के दौरान 7631 वादों की तुलना में 8732 वादे सरकार के विरूद्ध दायर किए गए। वर्ष के दौरान निपटाए गए 7891 में से 7631 मामले सरकार के पक्ष में और 4434 मामले सरकार के विरूद्ध निर्णीत हुए। सरकार के पक्ष में निर्णीत मामलों की प्रतिषतता पूर्व वर्ष की 47.88 प्रतिषतता की तुलना में 43.80 बनती है।
अपीलें
रिपोर्टाधीन अवधि के दौरान प्रथम अप्रैल, 2015 से 31 मार्च, 2016 तक की अवधि के दौरान 292 अपीलों की तुलना में सरकार द्वारा 236 अपीलें दायर की गई। वर्ष के दौरान निर्णीत 244 अपीलों में से 103 सरकार के पक्ष में और 141 सरकार के विरूद्ध निर्णीत हुई। सरकार के पक्ष में निर्णीत अपीलों की प्रतिषतता पूर्व वर्ष की 42.21 प्रतिषतता की तुलना में 44.69 बनती है।
इसी प्रकार पिछले वर्ष के दौरान सरकार के विरूद्ध दायर की गई 1441 अपीलों की तुलना में इस वर्ष भी सरकार के विरूद्ध 1396 अपीलें ही दायर की गई। वर्ष के दौरान निर्णीत 1118 अपीलों में से 785 सरकार के पक्ष में और 333 सरकार के
(99)100 SUPPLT. TO HARYANA GOVT. GAZ., JULY 23, 2019 (SRVN. 1, 1941 SAKA) विरूद्ध निर्णित हुई, जिससे प्रथम अप्रैल, 2015 से 31 मार्च, 2016 तक की अवधि के दौरान 67.13 के मुकाबले में अपीलों की प्रतिषतता 70.21 बनती है।
वसूलियां
निम्नलिखित सारणी रिपोर्टाधीन वर्ष के दौरान सरकार को देय डिक्री राषि तथा वसूल की गई राषि को दर्षाती हैः- (i) 1.4.2016 को देय बकाया राषि
53,26,997.58 रूपए (ii) 1.4.2016 से 31.3.2017 तक की अवधि के दौरान डिक्री की गई राषि 2,83,700.00 रूपए जोड़

वर्ष 2016-2017 में 36467/- रूपए वसूल किए गए। विधि परामर्षी एवं प्रषासकीय सचिव द्वारा उपायुक्तों को इस बात का निरन्तर स्मरण कराते रहने के बावजूद कि डिक्री राषि की वसूली के कार्य की ओर अधिक ध्यान दें, प्राप्त हुए परिणाम सन्तोषजनक नहीं है ।
भाग ख
पावतियों तथा प्रेषणों की कुल संख्या क्रमषः 43431 तथा 75489 थी।
सिविल मामले
रिपोर्टाधीन वर्ष के दौरान सरकार की ओर से पूर्व वर्ष के दौरान 1409 मामलों के मुकाबले में 1252 सिविल मामले अर्थात् रिट/ अपील इत्यादि पंजाब तथा हरियाणा उच्च न्यायालय, चण्डीगढ़ में दायर/संस्थित किए गए। वर्ष के दौरान कुल 314 मामलो,ं जिनमें सरकार अपीलार्थी थी, निर्णीत किए गए। इनमें से 95 सरकार के पक्ष में तथा 219 उसके विरूद्ध निर्णीत हुए। प्रथम अप्रैल, 2015 से 31 मार्च, 2016 तक की अवधि के दौरान सरकार के पक्ष में निर्णीत मामलों की प्रतिषतता 2.15 की तुलना में 30.25 बनती है। इसी प्रकार प्रथम अप्रैल, 2015 से 31 मार्च, 2016 तक की अवधि के दौरान 12482 मामलों के मुकाबले में सरकार के 12227 मामले दायर किए गए। रिपोर्टाधीन वर्ष के दौरान इस वर्ष के निर्णीत मामलों की कुल संख्या 6694 है। जिनमें से 1578 सरकार के पक्ष में तथा 5116 उसके विरूद्ध निर्णीत हुए। इस प्रकार प्रथम अप्रैल, 2015 से 31 मार्च, 2016 तक की अवधि के दौरान सरकार के पक्ष में निपटाए गए मामलों की प्रतिषतता 13.63 के मुकाबले में 23.57 प्रतिषत बनती है।
आपराधिक मामले
पावतियों तथा प्रेषणों की कुल संख्या क्रमषः 30930 तथा 85528 थी ।

No. 4(A.R.)/EA/LR/2016-17/Spl. 1.— The review of the Annual Administrative Report of the Law and Legislative Department, Haryana for the year 2016-2017. The report of Administration of Legal Affairs of the Haryana Government consists of the following two parts:-
Part-A- Report of the Legal Affairs with which the Legal Remembrancer and Administrative Secretary, to Government, Haryana is concerned.
Part-B- Report of the Legal Affairs with which the Advocate General,
Haryana is concerned.
PART-A
The total number of receipts and dispatches were 17298 and 33708 respectively.
During the period under report, 523 references for opinion were received from various departments of Government in the Legal Remembrancer and Administrative Secretary office and were disposed of by the opinion branch of the said office.
CIVIL BUSINESS
ORIGINAL SUITS
During the period under report, 22 suits were instituted by Government as against 934 suits instituted during the period from 1st April, 2015 to 31st March, 2016 which shows that there is decrease in the number of suits instituted. The total number of such cases disposed of during the year under report was 42 out of which 19 were decided in favour of Government and 23 cases against the Government. The percentage of cases decided in favour of Government works out to 45.23 as compared to 29.33 for the previous year. Similarly 8732 suits were filed against the Govt. as compared to 7631 during the previous year i.e. 2015-2016. Out of 7891 cases disposed of during the year, 3457 cases were decided in favour of Govt. and 4434 against the Government. The percentage of cases decided in favour of Govt. comes to 43.80 as compared to 47.88 for the previous year.
APPEALS
During the year under report, 236 appeals were filed by the Government as compared to 292 for the period from 1st April, 2015 to 31st March, 2016. Out of 244 appeals decided during the year, 103 were decided in favour of the Government and 141 against it. The percentage of appeals decided in favour of Government comes to 42.21 as compared to 44.69 for previous year.
Similarly, 1396 appeals were also instituted against the Govt. during the year as against 1441 instituted during the previous year. Out of 1118 appeals decided during the year, 785 were decided in favour of Government and 333 against it giving a percentage of 70.21 as against 67.13 during the period from 1st April, 2015 to 31st March, 2016.
RECOVERIES
The following table shows the decretal amount due to Govt. and the amount recovered during the year under report:-

The amount recovered during the year 2016-2017 is Rs. 36467/-. Inspite of Deputy Commissioners being continuously reminded by Legal Remembrancer and Administrative Secretary to pay greater attention to the work of recovering decretal amounts, the result obtained is not satisfactory.

The total number of receipts and dispatches were 43431 and 75489 respectively.
CIVIL CASES
During the year under report, 1252 Civil cases i.e. writs/ appeals etc. were filed/instituted in the Punjab and Haryana High Court at Chandigarh on behalf of the Government as compared to 1409 cases during the previous year. During the year, 314 cases in all, in which Govt. was appellant, were decided. Out of these, 95 cases were decided in favour of the Government while 219 against it. The percentage of cases decided in favour of Government comes to 30.25 as compared to 2.15 during the period from 1st April, 2015 to 31st March, 2016. Similarly, in this year, 12227 cases were filed against the Government as compared to 12482 during the period from Ist April, 2015 to 31st March, 2016. The total number of cases of this category decided during the year under report is 6694 out of which 1578 were decided in favour of Government and 5116 against it. Thus, the percentage of cases disposed of in favour of the Government comes to 23.57 as compared to 13.63 for the period from 1st April, 2015 to 31st March, 2016.
CRIMINAL CASES
The total number of receipts and dispatches were 30930 and 85528 respectively.
