General Review
विधि तथा विधायी विभाग हरियाणा की वर्ष 2017-18 की वार्षिक प्रषासनिक रिपोर्ट की समीक्षा। दिनांक 12 जुलाई, 2019
संख्या 4(ए० आर०)/एल०आर०/2017-2018/स्पेषल 1.—
वर्ष 2017-2018 के लिए विधि तथा विधायी विभाग, हरियाणा की प्रषासनिक रिपोर्ट पर समीक्षा । हरियाणा सरकार के विधिक कार्यो के प्रषासन की रिपोर्ट के निम्नलिखित दो भाग हैंः-
(i) भाग-क विधिक कार्यो की रिपोर्ट जिससे विधि परामर्षी एंव प्रषासकीय सचिव, हरियाणा सरकार सम्बद्व है । (ii) भाग-ख विधिक कार्यों की रिपोर्ट जिससे महाधिवक्ता, हरियाणा सम्बद्व है ।
भाग क
पावतियों तथा प्रेषणों की कुल संख्या क्रमष : 18908 तथा 27069 थी।
रिपोर्टाधीन अवधि के दौरान, विधि परामर्षी एंव प्रषासकीय सचिव के कार्यालय में सरकार के विभिन्न विभागों से 515 निर्देष मंत्रणा के लिए प्राप्त हुए और उनका उक्त कार्यालय की मंत्रणा शाखा द्वारा निपटान किया गया ।
सिविल कार्य/मूल वाद
रिपोर्टाधीन अवधि के दौरान प्रथम अप्रैल, 2016 से 31 मार्च, 2017 तक की अवधि के दौरान संस्थित 22 वादों की तुलना में सरकार की ओर से 28 वाद दायर किए गए जिससे प्रतीत होता है कि दायर किए गए वादों की संख्या में वृद्धि हुई है। रिपोर्टाधीन वर्ष के दौरान निपटाए गए वादों की कुल संख्या 42 थी जिनमें से 27 वादों का सरकार के पक्ष में तथा 15 वादों का सरकार के विरूद्ध निर्णय हुआ। पिछले वर्ष 45.23 प्रतिषतता की तुलना में सरकार के पक्ष में निर्णीत वादों की प्रतिषतता 64.28 बनती है। इसी प्रकार पिछले वर्ष अर्थात् 2016-2017 के दौरान 8732 वादों की तुलना में 7113 वादे सरकार के विरूद्ध दायर किए गए। वर्ष के दौरान निपटाए गए 6868 में से 3779 मामले सरकार के पक्ष में और 4434 मामले सरकार के विरूद्ध निर्णीत हुए। सरकार के पक्ष में निर्णीत मामलों की प्रतिषतता पूर्व वर्ष की 43.80 प्रतिषतता की तुलना में 55.02 बनती है।
अपीलें
रिपोर्टाधीन अवधि के दौरान प्रथम अप्रैल, 2016 से 31 मार्च, 2017 तक की अवधि के दौरान 236 अपीलों की तुलना में सरकार द्वारा 253 अपीलें दायर की गई। वर्ष के दौरान निर्णीत 219 अपीलों में से 93 सरकार के पक्ष में और 126 सरकार के विरूद्ध निर्णीत हुई। सरकार के पक्ष में निर्णीत अपीलों की प्रतिषतता पूर्व वर्ष की 42.21 प्रतिषतता की तुलना में 42.46 बनती है ।.़

GAZ., JULY 23, 2019 (SRVN. 1, 1941 SAKA) 105 इसी प्रकार पिछले वर्ष के दौरान सरकार के विरूद्ध दायर की गई 1396 अपीलों की तुलना में इस वर्ष भी सरकार के विरूद्ध 991 अपीलें ही दायर की गई। वर्ष के दौरान निर्णीत 1028 अपीलों में से 787 सरकार के पक्ष में और 241 सरकार के विरूद्ध निर्णित हुई, जिससे प्रथम अप्रैल, 2016 से 31 मार्च, 2017 तक की अवधि के दौरान 70.21 के मुकाबले में अपीलों की प्रतिषतता 76.55 बनती है।
वसूलियां
निम्नलिखित सारणी रिपोर्टाधीन वर्ष के दौरान सरकार को देय डिक्री राषि तथा वसूल की गई राषि को दर्षाती हैः- (i) 1.4.2017 को देय बकाया राषि
55,74,230.58 रूपए (ii) 1.4.2017 से 31.3.2018 तक की अवधि के दौरान डिक्री की गई राषि 9,82,981.00 रूपए जोड़

वर्ष 2017-2018 में 110585/- रूपए वसूल किए गए। विधि परामर्षी एवं प्रषासकीय सचिव द्वारा उपायुक्तों को इस बात का निरन्तर स्मरण कराते रहने के बावजूद कि डिक्री राषि की वसूली के कार्य की ओर अधिक ध्यान दें, प्राप्त हुए परिणाम सन्तोषजनक नहीं है ।
भाग ख
पावतियों तथा प्रेषणों की कुल संख्या क्रमषः 44385 तथा 80307 थी।
सिविल मामले
रिपोर्टाधीन वर्ष के दौरान सरकार की ओर से पूर्व वर्ष के दौरान 1252 मामलों के मुकाबले में 1896 सिविल मामले अर्थात रिट/ अपील इत्यादि पंजाब तथा हरियाणा उच्च न्यायालय, चण्डीगढ़ में दायर/संस्थित किए गए। वर्ष के दौरान कुल 364 मामलों, जिनमें सरकार अपीलार्थी थी, निर्णीत किए गए। इनमें से 103 सरकार के पक्ष में तथा 261 उसके विरूद्ध निर्णीत हुए। प्रथम अप्रैल, 2016 से 31 मार्च, 2017 तक की अवधि के दौरान सरकार के पक्ष में निर्णीत मामलों की प्रतिषतता 30.25 की तुलना में 28.29 बनती है। इसी प्रकार प्रथम अप्रैल, 2016 से 31 मार्च, 2017 तक की अवधि के दौरान 12227 मामलों के मुकाबले में सरकार के 11877 मामले दायर किए गए। रिपोर्टाधीन वर्ष के दौरान इस वर्ष के निर्णीत मामलों की कुल संख्या 4402 है। जिनमें से 917 सरकार के पक्ष में तथा 3485 उसके विरूद्ध निर्णीत हुए। इस प्रकार प्रथम अप्रैल, 2016 से 31 मार्च, 2017 तक की अवधि के दौरान सरकार के पक्ष में निपटाए गए मामलों की प्रतिषतता 23.57 के मुकाबले में 20.87 प्रतिषत बनती है।
आपराधिक मामले
पावतियों तथा प्रेषणों की कुल संख्या क्रमषः 35915 तथा 100921 थी ।

No. 4(A.R.)/EA/LR/2017-18/Spl. 1.— The review of the Annual Administrative Report of the Law and Legislative Department, Haryana for the year 2017-2018.
Part-A- Report of the Legal Affairs with which the Legal Remembrancer and Administrative Secretary, to Government, Haryana is concerned.
Part-B- Report of the Legal Affairs with which the Advocate General, Haryana is concerned.
PART-A
The total number of receipts and dispatches were 18908 and 27069 respectively.
During the period under report, 515 references for opinion were received from various departments of Government in the Legal Remembrancer and Administrative Secretary office and were disposed of by the opinion branch of the said office.
CIVIL BUSINESS
ORIGINAL SUITS
During the period under report, 28 suits were instituted by Government as against 22 suits instituted during the period from 1st April, 2016 to 31st March, 2017 which shows that there is increase in the number of suits instituted. The total number of such cases disposed of during the year under report was 42 out of which 27 were decided in favour of Government and 15 cases against the Government. The percentage of cases decided in favour of Government works out to 64.28 as compared to 45.23 for the previous year. Similarly 7113 suits were filed against the Govt. as compared to 8732 during the previous year i.e. 2016-2017. Out of 6868 cases disposed of during the year, 3779 cases were decided in favour of Govt. and 4434 against the Government. The percentage of cases decided in favour of Govt. comes to 55.02 as compared to 43.80 for the previous year.
APPEALS
During the year under report, 253 appeals were filed by the Government as compared to 236 for the period from 1st April,2016 to 31st March, 2017. Out of 219 appeals decided during the year, 93 were decided in favour of the Government and 126 against it. The percentage of appeals decided in favour of Government comes to 42.46 as compared to 42.21 for previous year.
Similarly, 991 appeals were also instituted against the Govt. during the year as against 1396 instituted during the previous year. Out of 1028 appeals decided during the year, 787 were decided in favour of Government and 241 against it giving a percentage of 76.55 as against 70.21 during the period from 1st April, 2016 to 31st March, 2017.
RECOVERIES
The following table shows the decretal amount due to Govt. and the amount recovered during the year under report:-

Rs. 64,46,626.58 The amount recovered during the year 2017-2018 is Rs. 1,10,585/-. Inspite of Deputy Commissioners being continuously reminded by Legal Remembrancer and Administrative Secretary to pay greater attention to the work of recovering decretal amounts, the result obtained is not satisfactory.

The total number of receipts and dispatches were 44385 and 80307 respectively.
CIVIL CASES
During the year under report, 1896 Civil cases i.e. writs/ appeals etc. were filed/instituted in the Punjab and Haryana High Court at Chandigarh on behalf of the Government as compared to 1252 cases during the previous year.
During the year, 364 cases in all, in which Govt. was appellant, were decided. Out of these, 103 cases were decided in favour of the Government while 261 against it. The percentage of cases decided in favour of Government comes to 28.29 as compared to 30.25 during the period from 1st April, 2016 to 31st March, 2017. Similarly, in this year, 11877 cases were filed against the Government as compared to 12227 during the period from Ist April, 2016 to 31st March, 2017. The total number of cases of this category decided during the year under report is 4402 out of which 917 were decided in favour of Government and 3485 against it. Thus, the percentage of cases disposed of in favour of the Government comes to 20.83 as compared to 23.57 for the period from 1st April, 2016 to 31st March, 2017.
CRIMINAL CASES
The total number of receipts and dispatches were 35915 and 100921 respectively.
