संख्या 12/22/2018-6टी1.- मोटरयान अधिनियम, 1988 (1988 का केन्द्रीय अधिनियम 59), की धारा 28, 65, 96 और 213 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा हरियाणा सरकार, परिवहन विभाग, अधिसूचना संख्या 12/22/ 2018-6टी-I, दिनांक 24 जून, 2019 के प्रतिनिर्देष से, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा मोटरयान नियम, 1993 को आगे संषोधित करने के लिए निम्नलिखत नियम बनाते हैं, अर्थात्‌ :- 1. ये नियम हरियाणा मोटरयान (संषोधन) नियम, 2019, कहे जा सकते हैं।

2. हरियाणा मोटरयान नियम, 1993 में, नियम 3 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

''3. अनुज्ञापन प्राधिकारी। [धारा 28(2) (क)] (1) राज्य में प्रत्येक उपमण्डल अधिकारी (नागरिक), गैर-परिवहन वाहन के सम्बन्ध में अपनी क्षेत्रीय अधिकारिता के भीतर अध्याय II के अधीन अनुज्ञप्ति जारी करने के लिए अनुज्ञापन प्राधिकारी होगा।

(2) छात्रों को षिक्षार्थी अनुज्ञप्ति जारी करने के प्रयोजन हेतु, राज्य में विष्वविद्यालयों/संस्थानों के निम्नलिखित अधिकारी मोटर यान अधिनियम, 1988 (1988 का केन्द्रीय अधिनियम 59), की धारा 7 तथा 8 तथा केन्द्रीय मोटर वाहन नियम, 1989 के नियम 4, 10 तथा 11 के अधीन विहित शर्तों के अध्यधीन गैर-परिवहन वाहन के लिए उनके क्षेत्रीय क्षेत्राधिकार में अनुज्ञापन प्राधिकारी होंगे, अर्थात्‌ :-

(i) सभी विष्वविद्यालयों के रजिस्ट्रार;

(ii) निदेषक, चिकित्सा महाविद्यालय;

(iii) अखिल भारतीय तकनीकी परिषद्‌ (AICTE) द्वारा मान्यताप्राप्त इंजीनियरिंग और प्रौद्योगिकी संस्थानों के निदेषक/प्रधानाचार्य;

(iv) राजकीय महाविद्यालयों तथा राजकीय सहायता प्राप्त महाविद्यालयों के प्रधानाचार्य;

(v) राजकीय षिक्षा महाविद्यालयों के प्रधानाचार्य;

(vi) राजकीय सहायता-प्राप्त षिक्षा महाविद्यालयों के प्रधानाचार्य;

(vii) राजकीय पॉलीटैकनिक तथा औद्योगिक प्रषिक्षण संस्थानों के प्रधानाचार्य;

(viii) राजकीय नर्सिंग महाविद्यालयों के प्रधानाचार्य;

(3) प्रत्येक सचिव, क्षेत्रीय परिवहन प्राधिकरण और सहायक सचिव, क्षेत्रीय परिवहन प्राधिकरण, परिवहन वाहन के सम्बन्ध में अपनी क्षेत्रीय अधिकारिता के भीतर अध्याय II के अधीन अनुज्ञप्ति जारी करने के लिए अनुज्ञापन प्राधिकारी होगा :

परन्तु गैर-परिवहन तथा परिवहन वाहनों, दोनों के लिए चालन अनुज्ञप्तियों की अपेक्षा करने वाले व्यक्ति के संबंध में सचिव, क्षेत्रीय परिवहन प्राधिकरण और सहायक सचिव, क्षेत्रीय परिवहन प्राधिकरण अनुज्ञापन प्राधिकारी होगा। (4) प्रत्येक सचिव, क्षेत्रीय परिवहन प्राधिकरण और सहायक सचिव, क्षेत्रीय परिवहन प्राधिकरण अपनी क्षेत्रीय अधिकारिता के भीतर अध्याय III के अधीन अनुज्ञप्ति जारी करने के लिए अनुज्ञापन प्राधिकारी होगा।"।

Notification

No. 12/22/2018-6TI.— In exercise of the powers conferred by Sections 28, 65, 96 and 213 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) and with reference to Haryana Government, Transport Department, notification No. 12/22/2018-6TI, dated the 24th June, 2019, the Governor of Haryana hereby makes the following rules further to amend the Haryana Motor Vehicles Rules, 1993, namely:–

1. These rules may be called the Haryana Motor Vehicles (Amendment) Rules, 2019.

2. In the Haryana Motor Vehicles Rules, 1993, for rule 3, the following rule shall be substituted, namely:– ―3. Licensing Authority [section 28(2) (a)]– (1) Each Sub-Divisional Officer (Civil) in the State shall be the licensing authority to issue licence under Chapter II within the area of his territorial jurisdiction in respect of non-transport vehicle.

(2) For the purpose of issuance of learner licence to the students, the following officers of universities/ institutions in the State shall be the licensing authorities for non-transport vehicle subject to the conditions prescribed under sections 7 and 8 of Motor Vehicles Act, 1988 and rules 4, 10 and 11 of Central Motor Vehicles Rules, 1989 within the area of their territorial jurisdiction namely:-

(i) Registrars of all Universities;

(ii) Directors of Medical Colleges;

(iii) Directors/Principals of Engineers and Technology Institutions recognized by All India Council for Technical (AICTE);

(iv) Principals of Government Colleges and Government Aided Colleges;

(v) Principals of Government Colleges of Education;

(vi) Principals of Government Aided Colleges of Education;

(vii) Principals of Government Polytechnics and Industrial Training Institutes;

(viii) Principals of Government Nursing Colleges;

(ix) Principals of Government Pharmacy Colleges;

(x) Directors/Principals of Government Ayurvedic/Homeopathy/Unani Colleges.

(3) Each Secretary, Regional Transport Authority and Assistant Secretary, Regional Authority shall be the licensing authority to issue licences under Chapter II within the area of his territorial jurisdiction in respect of a transport vehicle:

Provided that the licensing authority, in respect of a person requiring driving licences for both non- transport and transport vehicles, shall be the Secretary, Regional Transport Authority and Assistant Secretary, Regional Transport Authority.

(4) Each Secretary, Regional Transport Authority and Assistant Secretary, Regional Transport Authority shall be the licensing authority to issue licences under Chapter III within the area of his territorial jurisdiction.‖.
