संख्या सा०का०नि० 45/संवि०/अनु० 309/2019.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा इलैक्ट्रोनिक्स एवं सूचना प्रौद्योगिकी विभाग (गु्रप घ) सेवा नियम, 1998 को आगे संशोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. ये नियम हरियाणा इलैक्ट्रोनिक्स एवं सूचना प्रौद्योगिकी विभाग (गु्रप घ) सेवा (संशोधन) नियम, 2019 कहे जा सकते हैं। 2. हरियाणा इलैक्ट्रोनिक्स एवं सूचना प्रौद्योगिकी विभाग (गु्रप घ) सेवा नियम, 1998 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 5 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

"5. सेवा में सीधी भर्ती द्वारा नियुक्त कर्मचारियों की आयु सीमा ऐसी होगी जो हरियाणा ग्रुप घ कर्मचारी (भर्ती तथा सेवा की शर्तें) अधिनियम, 2018 (2018 का 5) की धारा 6 में विनिर्दिष्ट हैं।"।

3. उक्त नियमों में, नियम 13 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"13 हरियाणा ग्रुप घ कर्मचारी (भर्ती तथा सेवा की शर्तें) अधिनियम, 2018 (2018 का 5) की धारा 4 में यथा विनिर्दिष्ट ।"।

4. उक्त नियमों में, नियम 14 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"14(1) अनुशासन, शास्तियां तथा अपीलों से संबधित मामलों में, सेवा के सदस्य समय-समय पर यथा संशोधित हरियाणा सिविल सेवा ( दण्ड तथा अपील) नियम 2016 द्वारा शासित होंगेः

परन्तु ऐसी शास्तियों का स्वरूप जो लगाई जा सकती है; ऐसी शास्तिया लगाने के लिए सशक्त प्राधिकारी तथा अपील प्राधिकारी, भारत के संविधान के अनुच्छेद 309 के अधीन बनाई गई किसी विधि या नियमों के अधीन रहते हुए, वे होंगे जो इन नियमों के परिशिष्ट ग में विनिर्दिष्ट हैं ।

(2) हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 के नियम 9 के खण्ड (ग) या (घ) के अधीन आदेश पारित करने के लिये सक्षम प्राधिकारी तथा अपील प्राधिकारी भी वही होंगे जो इन नियमों के परिशिष्ट घ में यथा विनिर्दिष्ट हैं। 5. उक्त नियमों में, परिशिष्ट क,ख,ग तथा घ के स्थान पर, निम्नलिखित परिशिष्ट प्रतिस्थापित किये जाएंगे,अर्थात्‌ :-

Notification

The 6th September, 2019

No. G.S.R. 45/Const./Art.309/2019.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana, hereby makes the following rules to further amend the Haryana Electronics and Information Technology Department (Group D) Service Rules, 1998, namely;

1. These rules may be called the Haryana Electronics and Information Technology Department (Group D) Service (Amendment) Rules, 2019.

2. In the Haryana Electronics and Information Technology Department (Group D) Service Rules, 1998 (hereinafter called the said rules) in rule 5, the following rule shall be substituted, namely:-

"5. The age for direct recruitment to the service shall be such, as specified in section 6 of the Haryana Group D Employee (Recruitment and Conditions of Service) Act, 2018 (5 of 2018).".

3. In the said rules, for rule 13 the following rule shall be substituted, namely:-

"13. As specified in section 4 of the Haryana Group D Employees (Recruitment and conditions of Service) Act, 2018 (5 of 2018).".

4. In the said rules, for rule 14, the following rule shall be substituted, namely;

"14(1) In matters relating to discipline, penalties and appeals, members of the service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016, as amended from time to time:

Provided that the nature of penalties which may be imposed, the authority empowered to impose such penalties and appellate authority, shall subject to the provisions of any law or rules made under article 309 of the Constitution of India, be such as are specified in Appendix C to these rules.

(2) The competent authority to pass an order under clause (c) or clause (d) of rule 9 of the Haryana Civil Services (Punishment and Appeal) Rules, 2016, and the appellate authority shall be specified in Appendix D to these rules.

5. In the said rules, for Appendix A,B,C and D, the following Appendix shall be substituted, namely;-569 HARYANA GOVT. GAZ. (EXTRA.), SEPT. 6, 2019 (BHDR. 15, 1941 SAKA)
