श्रम विभाग, हरियाणा की वर्ष 2016 की वार्षिक प्रषासनिक रिपोर्ट की समीक्षा।

1. दिनांक 1 जनवरी, 2016 से 02 मई, 2016 तक श्री वजीर सिंह गोयत, आई.ए.एस., तथा 02 मई, 2016 से 31 दिसम्बर, 2016 तक श्री पंकज अग्रवाल, आई.ए.एस., श्रम आयुक्त, हरियाणा, चण्डीगढ में कार्यरत रहे।
2. विभाग का प्रषासनिक नियंत्रण दिनांक 1 जनवरी, 2016 से 25 अप्रैल, 2016 तक श्रीमति शषी गुलाटी, आई.ए.एस., अतिरिक्त मुख्य सचिव, हरियाणा सरकार, दिनांक 26.04.2016 से 18.05.2016 तक श्री अनुराग रस्तोगी, आई.ए.एस., प्रधान सचिव, हरियाणा सरकार, दिनांक 25.05.2016 से 10.06.2016 तक श्री ए0 के0 सिंह, आई.ए.एस. प्रधान सचिव, हरियाणा सरकार, दिनांक 11.06.2016 से 19.09.2016 तक डॉ0 महावीर सिंह, आई.ए.एस., प्रधान सचिव, हरियाणा सरकार तथा दिनांक 19.09.2016 से 31.12.2016 तक श्री विजय वर्धन, आई.ए.एस., अतिरिक्त मुख्य सचिव के पास रहा।
3. इस वर्ष की रिपोर्ट का वर्णन निम्न प्रकार हैः-
(क) वर्ष 2016 के दौरान हड़ताल/तालाबन्दी के 2 केस हुए, जिसमें से एक कार्यबन्दी/तालाबन्दी पर सरकार द्वारा रोक दी गई है और मामला औद्योगिक न्यायाधिकरण एवं श्रम न्यायलाय के अधीन है तथा एक कार्यबंदी/तालाबन्दी जारी है। इन कार्यबन्दियों/तालाबन्दियों के कारण 844 श्रमिकों पर प्रभाव पड़ा और 78098 श्रम दिवसों की क्षति हुई है। मजदूरी तथा उत्पादन क्षति क्रमशः 4.91 करोड़ रूपये तथा 15.14 करोड़ रुपये हुई है।
(ख) समझौता अधिकारियों ने 4358 केसों को डील किया, जिनमें से 1072 मामलों में समझौता करवाया गया। 388 मामले वापिस लिये गये, 206 मामले रद्द व फाईल किये गये तथा 2170 विवाद अदालती निर्णय के लिए भेजे गयेे। अतः वर्ष के अन्त में 522 मामले लम्बित रहे।

GAZ., NOV. 5, 2019 (KRTK. 14, 1941 SAKA) (ग) वर्ष के आरम्भ में 528 पंचाट तथा 25 समझौते परिपालना हेतु लम्बित थे वर्ष के दौरान 85 पंचाट/समझौते प्राप्त हुये। कुल 613 पंचाट तथा 25 समझौतों में से 48 पंचाट/समझौते लागू करवाये गये। इस प्रकार वर्ष के अन्त में 565 पंचाट तथा 25 समझौते परिपालना के लिए लम्बित रहे। पंचाट की परिपालना क्रमषः 7.83 प्रतिषत रही।
(घ) इसके अतिरिक्त विभाग के क्षेत्रीय स्टाफ ने श्रमिकों को देरी से वेतन देने, कम वेतन देने, नौकरी से हटाने तथा काम के घण्टों आदि से सम्बन्धित 2136 षिकायतों पर कार्यवाही की तथा 1881 षिकायतों का श्रमिकों की सन्तुष्टी अनुसार निपटारा करवाया गया। 255 षिकायते वर्ष के अन्त में लम्बित रही। इस प्रकार षिकायतों के निपटान का प्रतिषत 88.06 रहा।
(ड) वर्ष के आरम्भ में 6185 औद्योगिक संस्थायें आवर्णित थी, जहां 50 या इससे अधिक श्रमिक कार्य करते थे। वर्ष के आरम्भ में 1815 औद्योगिक संस्थांओं में स्थाई आदेष प्रमाणित थे। वर्ष के दौरान 43 स्थाई आदेष प्रमाणित किये गये। इस प्रकार रिपोर्ट की अवधि के अन्त में 1858 संस्थाओं के पास प्रमाणित स्थाई आदेष थे, जिनमें लगभग 286313 श्रमिक कार्य करते थे।
(च) वर्ष के आरम्भ में 1651 यूनियन पंजीकृत थी तथा 24 नई यूनियन पंजीकृत की गई तथा कोई यूनियन अपंजीकृत नहीं हुई। इस प्रकार वर्ष के अन्त में इनकी संख्या बढ़ कर 1675 हो गई।
(छ) इस अवधि के दौरान 613 नये कारखाने कारखाना अधिनियम, 1948 के अन्तर्गत पंजीकृत किये गये तथा 192 कारखाने अपंजीकृत किये गये। इस प्रकार वर्ष के अन्त में पंजीकृत कारखानों की संख्या बढ़कर 11995 हो गई। इन पंजीकृत कारखानों में 898466 श्रमिकों को रोजगार मिला हुआ है। वर्ष के दौरान पंजीकृत कारखानों में 132 दुर्घटनाएं हुई, जिनमें 62 घातक तथा 70 गम्भीर थी।
(ज) पंजाब दुकानात तथा वाणिज्य संस्थापना अधिनियम, 1958 पूरे राज्य में लागू रहा। वर्ष 2016 तक दुकानों, वाणिज्यक संस्थापनाआेंं, सिनेमा एवं होटल आदि की सख्यां 4,13,146 रही। जिनमें 16,46,405 श्रमिकों को रोजगार प्रदान किया हुआ हैं।
(झ) समीक्षा अधीन वर्ष के दौरान विभिन्न श्रम अधिनियमों के अन्र्तगत 11314 निरीक्षण किये गये। 1937 मामलों में चालान दायर किये गए। 2574 मामले दोषपूर्ण सिद्ध हुए जिनके फलस्वरुप 6483696 लाख रुपये जुर्माने के रूप में वसूल किये गये तथा 2043 मामलाें में चेतावनियां दी गई।
(ण) हरियाणा श्रम कल्याण बोर्ड द्वारा वर्ष 2016 के दौरान श्रमिकों के कल्याण के लिए 22 कल्याणकारी योजनाओं के अन्तर्गत 2939.31 लाख रूपये की राशि खर्च की गई। जिसमें से 738.85 लाख रूपये उक्त श्रमिकों के आश्रितों एवं विधवाओं को वित्तीय सहायता के रूप में प्रदान किये गये तथा 558.87 लाख रूपये कन्यादान योजना के तहत महिला श्रमिकों की स्वयं की शादी या श्रमिकों की लड़कियों की शादी हेतू कन्यादान के रूप में प्रदान किये गये। कन्यादान योजना के तहत 1097 श्रमिकों को लाभान्वित किया गया।
(त़) हरियाणा भवन और अन्य संन्निर्माण कर्मकार कल्याण बोर्ड दिनांक 02.11.2006 से अस्तित्व में आया है। बोर्ड द्वारा राज्य में भवन एवं सन्निर्माण श्रमिकों के कल्याण हेतू विभिन्न कल्याणकारी योजनाएं चलाई जा रही है जैसे कि शिक्षा के लिए वित्तीय सहायता, मात्तृव, शादी (कन्यादान) सहायता, औजार, साईकिल, दुर्घटना एवं प्राकृतिक मृत्यु के लिए वित्तीय सहायता, बुढ़ापा पैशन, अपंगता पैंशन, अपंग बच्चों के लिए वित्तीय सहायता इत्यादि। पंजीकृत महिला निर्माण श्रमिकों के लिए मुख्यमंत्री महिला निर्माण श्रमिक सम्मान योजना के अन्तर्गत विशेष वित्तीय सहायता एवं सिलाई मशीन भी बोर्ड द्वारा उपलब्ध करवाई जा रही है। इसके अतिरिक्त स्वास्थ्य विभाग के माध्यम से पंजीकृत श्रमिकों के लिए कार्य स्थल पर स्वास्थ्य सेवाएं भी उपलब्ध करवाई जा रही है और राज्य के मुख्य कस्बों/शहरों में श्रमिको के लिए लेबर चौक पर लेबर शैड, मोबाईल क्रैच की सुविधा भी उपलब्ध करवाई जा रही है। सैस के रूप में एकत्रित की गई राशि प्रमुखतः भवन एवं सन्निर्माण में पंजीकृत श्रमिकों के कल्याण के लिए उपयोग की जाती है। बोर्ड द्वारा 1 जनवरी, 2016 से 31 दिसम्बर 2016 के दौरान कल्याणकारी योजनाओं के अन्तर्गत 54776 लाभार्थियोंं पर 65.97 करोड़ रूपये की राषि खर्च की गई है। बोर्ड द्वारा वर्ष 2016 में 223.56 करोड़ रूपये सैस एकत्रित किया गया है।

1. Sh. Wazir Singh Goyat, IAS remained posted as Labour Commissioner, Haryana from 01-01-2016 to 02-05-2016 and Sh. Pankaj Agarwal, IAS from 02-05-2016 to 31-12-2016.
2. The Administrative Control of the Department remained under Smt. Shashi Gulati, IAS, Additional Chief Secretary to Government of Haryana from 01-01-2016 to 25-04-2016, Sh. Anurag Rashtogi, IAS, Principal Secretary to Government of Haryana from 26-04-2016 to 18-05-2016, Sh A.K. Singh, IAS, Principal Secretary, to Government of Haryana from 25-05-2016 to 10-06-2016, Dr. Mahavir Singh, IAS, Principal Sectretary to Government of Haryana from 11.06.2016 to 19.09.2016 and Sh. Vijai Vardhan, IAS, Additional Chief Secretary to Government of Haryana from 19.09.2016 to 31.12.2016.
3. During the year under report:-
a. There were 2 work Stoppages/Lockouts during the year 2016. One work Stoppages/Lockout was prohibited by the state government and matter under dispute was refer to Industrial Tribunal-cum- Labour Court and one work stoppage/lockout continued. These work-stoppages affected 844 workers and resulted in a loss of 78098 mandays. The loss of wages and production was Rs. 4.91 Crore and 15.14 crore respectively.
b. The conciliation officers of the department handled 4358 disputes. Out of these settlements were brought out in 1072 cases. 388 cases were withdrawn, 206 were filed/ rejected and 2170 were sent for adjudication and 522 disputes remained pending at the end of the year.
c. 528 awards and 25 agreements were pending for implementation at the beginning of the year. 85 awards/ agreements were added during the year under review. Out of these 613 awards and 25 agreements, 48 awards/agreements were got implemented. Thus 565 awards and 25 agreements remained pending for implementation at the end of the Year. As such the percentage of implementation of awards and agreements comes to 7.83%.
d. 2136 complaints of the workers regarding delayed payment of wages, less payment of wages, termination of services, leave and hours of work etc. were handled by the field staff of the department, of which 1881 were settled to the satisfaction of the workers leaving a balance of 255 complaints pending at the close of the year. As Such 88.06 percentages of complaints have been settled.
e. There were 6185 establishments employing 50 or more worker. Out of it 1815 industrial establishments had certified Standing Orders. 43 Standing Orders were certified during the year. Thus the number of certified Standing Orders at the end of the year rose to 1858 giving employment to about 286313 workers.
f. At the beginning of the year there were 1651 registered Trade Unions in the State. During the year 24 new unions were registered and no union was de-registered thus at the end of the year the number increased to 1675.
g. 613 new factories were registered and 192 Factories de-registered under the Factories Act, 1948. Thus the total number of registered factories rose to 11995 at the end of the year giving employment to 898466 workers. There occurred 132 accidents in registered factories during the year of which 62 were fatal and 70 were serious in nature.
h. The Punjab shops and Commercial Establishments Act, 1958 remained applicable in whole of the State. The number of shops, commercial establishments, cinemas and hotels etc. were 413146 employing 16,46,405 workers.
i. During the year under review 11314 inspections were conducted under various labour laws. 1937 prosecutions were launched and convictions were obtained in 2574 cases. As a result of it a sum of Rs. 64,83,696 lacs was realised as fine. Warnings after compliance of violations were issued in 2043 cases to employer.
j. An amount of Rs. 2939.31 lac has been disbursed to the workers under 22 Welfare Schemes of Haryana Labour Welfare Board during the year 2015 out of which an amount of Rs. 738.85 Lac was disbursed to the dependents/widows of deceased industrial workers and an amount of Rs. 558.87 lac has been spent under 'Kanyadaan Scheme' as Kanyadaan for self marriage in case of female workers and for the marriage of daughters of industrial workers. 1097 workers have been benefitted under Kanyadaan scheme.
178 SUPPLT. TO HARYANA GOVT. GAZ., NOV. 5, 2019 (KRTK. 14, 1941 SAKA)k. The Haryana Building and Other Construction Workers Welfare Board has come into force w.e.f. 02.11.2006. The Board is running various schemes for the welfare of building and other construction workers in the State like Finanacial Assistance for Education, Maternity, Marriage Assistance (Kanyadaan), Tools, Cycle, Financial Assistance in case of Accidental and Natural Death, Old age pension, Disability pension, Financial Assistance for Disabled Children etc., Special Financial Assistance for Women Construction Worker under the scheme Mukhya Mantri Mahila Sharmik Samman Yojna and Sewing machine is also being provided by the Board. In addition to these schemes the registered construction wor kers are also being provided health facilities at the work site through the Health Department, facilities of Mobile Toilets, Mobile Creche and Labour shed at Labour Chowks of the important towns of the State. The funds collected as cess is primarily utilized for the welfare of registered Building and Other Construction Workers. An amount of Rs. 65.97/- Crore have been spent for extending benefits to 54776 beneficiaries on welfare schemes during the period 1st January to 31st December, 2016. However the cess amount of Rs. 223.56/- crore was collected during the calendar year 2016.
