No. Leg.36/2019.— The following Ordinance of the Governor of Haryana promulgated under clause (1) of article 213 of the Constitution of India, on the 17th September, 2019 is hereby published for general information:–

THE HARYANA SERVICE OF ENGINEERS, GROUP A, PUBLIC WORKS (BUILDINGS
AND ROADS) DEPARTMENT (AMENDMENT) ORDINANCE, 2019
AN
ORDINANCE
further to amend the Haryana Service of Engineers, Group A, Public Works (Buildings and
Roads) Department Act, 2010.
Promulgated by the Governor of Haryana in the Seventieth Year of the Republic of India.
Whereas the Legislature of the State of Haryana is not in session and the Governor is
satisfied that circumstances exist which render it necessary for him to take immediate action;
Now, therefore, in exercise of the powers conferred by clause (1) of article 213 of the
Constitution of India, the Governor of Haryana hereby promulgates the following Ordinance:-
Short title.
1. This Ordinance may be called the Haryana Service of Engineers, Group A, Public Works (Buildings and Roads) Department (Amendment) Ordinance, 2019.
2. For sub–sections (2) and (3) of section 1 of the Haryana Service of Engineers, Group A, Public Works (Buildings and Roads) Department Act, 2010 (hereinafter called the principal Act), the following sub-sections shall be substituted, namely:–
Amendment of section 1 of Haryana Act 30 of 2010.
"(2) It shall be deemed to have come into force on the 4th November, 2010.
(3) It shall apply to the persons who are members of the Service and have been
appointed on or after the 4th November, 2010.".
3. For the second and third proviso to sub-section (1) of section 9 of the principal Act, the following provisos shall be substituted, namely:–
"Provided further that there shall be a common cadre for promotion to the post of
Amendment of section 9 of Haryana Act 30 of 2010.
Engineer-in-Chief:
Provided further that there shall be separate post of Chief Engineer (Electrical) for Electrical cadre and Chief Engineer (Mechanical) for Mechanical cadre and same shall be filled up by the Committee constituted under section 8 on the basis of seniority-cum- merit. The seniority shall be determined by the length of Service on the post of Superintending Engineer in their respective cadre.".
4. For clause (f) of proviso to section 25 of the principal Act, the following clause shall be substituted, namely:–
Amendment of section 25 of Haryana Act 30 of 2010.
"(f) the officers promoted, recruited or appointed, in the Buildings and Roads Branch now called Public Works (Buildings and Roads) Department, prior to the notification of this Ordinance shall continue to be governed and regulated by the Haryana Service of Engineer, Class I, Public Works Department (Buildings and Roads Branch), (Public Health Branch) and (Irrigation Branch) respectively Act, 1995 (20 of 1995),".
