क्रमांक 46/13/2019-5एच0बी0-II.- चूंकि, हरियाणा के राज्यपाल संतुष्ट हैं कि हरियाणा राज्य में भयानक महामारी रोग अर्थात् इन्फ्लुएंजा ए० एच०1 एन०1 के फैलने का खतरा है और इस प्रयोजन के लिए इस समय लागू विधि के साधारण प्रावधान अपर्याप्त है। इसलिए अब महामारी अधिनियम, 1897 की धारा 2.1, 3 और 4 द्वारा प्रदान की गयी शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल द्वारा तीन वर्ष के लिए (यानि वित्तीय वर्ष 2019-20, 2020-21, 2021-2022) निम्नलिखित विनियम बनाते हैंः-
1. ये विनियम हरियाणा महामारी रोग इन्फ्लुएंजा ए० एच०1 एन०1 नियम, 2019 कहे जा सकते हैं और ये प्रकाषन की तिथि से तीन साल के लिए वैध रहेेंगे।
2. इन नियमों में, जब तक संदर्भ में अन्यथा अपेक्षित न हो ''महामारी रोग'' का अर्थ इन्फ्लुएंजा ए० एच०1 एन०1 रहेगा।
3. सभी अस्पताल (सरकारी/निजि) इन्फ्लुएंजा ए० एच०1 एन०1 का वर्गीकरण जो कि भारत सरकार द्वारा जारी किया गया है तथा एन०सी०डी०सी० (राष्ट्रीय रोग नियंत्रण केंन्द्र, नई दिल्ली) की वेबसाइट पर उपलब्ध है, का पालन करेंगे।
4. आईसोलेसन वार्ड, वह एकान्त स्थान है जहां सम्बन्धित सिविल सर्जन द्वारा इन्फ्लुएंजा ए० एच०1 एन०1 के संदिग्ध/जांच में स्पष्ट मामले इलाज हेतू तथा जांच के नमूना एकत्र करने के लिए घोषित किया गया है। 5. सभी अस्पताल (सरकारी/निजि), स्वास्थ्य विभाग, हरियाणा को सम्बन्धित सिविल सर्जन के माध्यम से तुरंत ऐसे सभी मामलों, जैसे आई०एल०आई० (इन्फ्लुएंजा जैसी बिमारी) की सूचना उपलब्ध करवाऐंगे जो कि इन्फ्लुएंजा ए० एच०1 एन०1 की श्रेणी- बी में होगी तथा इन्फ्लुएंजा ए० एच०1 एन०1 के जांच में सही पाया गया मामला, जोकि उनके सस्ंथान में रिपोर्ट किया जाता है तोे भारत सरकार द्वारा जारी प्रोटोकॉल तथा दिषानिर्देषों के तहत बिना प्रयोगषाला प्रमाण का इंतजार किए ईलाज के लिए रखा जाएगा।
(क) मामलों की जानकारी की सूचना देने हेतु राज्य व जिलों में तैनात नोडल अधिकारियाें का विवरण, उनके सम्पर्क नम्बर व ई-मेल पत्ते सहित स्वास्थ्य विभाग, हरियाणा की वैबसाइट (haryanahealth.nic.in) पर अपलोड किये गये हैं।
6. इन्फ्लुएंजा ए० एच०1 एन०1 के सभी मामले, चाहे संदिग्ध हों या जांच में स्पष्ट, बिमारी को फैलने से बचाने के लिए अलग से रखे जाऐंगे।
7. सभी अस्पताल/मेडीकल कॉलेजों में स्क्रीनिंग सेंटर (फ्लू कॉर्नर) स्थापित होने चाहिए ताकि ए०आई०आर०/ आई०एल०आई० के रोगियों की जल्द से जल्द स्क्रीनिंग हो सके।
(4311)4312 HARYANA GOVT. GAZ. (EXTRA.), NOV. 19, 2019 (KRTK 28, 1941 SAKA) 8. इन्फ्लुएंजा ए० एच०1 एन०1 के प्रमाणित निदान का अनुषंसित परीक्षण आर०टी० पी०सी०आर० विधि द्वारा केवल सरकार द्वारा मान्यता प्राप्त लैब में ही करवाए गए मान्य होंगे।
9. स्वास्थ्य विभाग, हरियाणा की अनुमति के बिना कोई भी व्यक्ति/संस्था या संगठन ऐसी कोई भी सूचना या इन्फ्लुएंजा ए० एच०1 एन०1 की प्रबन्धन सामग्री का प्रचार प्रसार नहीं करेगा।
10. स्वाथ्य विभाग, हरियाणा की अनुमति के बिना कोई भी व्यक्ति/संस्था या संगठन इन्फ्लुएंजा ए० एच०1 एन०1 के प्रकाषन या मीडिया का इस्तेमाल नहीं करेगा।
11. अधिसूचना की अवहेलना करने संबंधी नोटिसः प्रत्येक जिले में सिविल सर्जन की अध्यक्षता में एक समिति का गठन किया जायेगा, जो चिकित्सा विषेषज्ञ, बाल रोग विषेषज्ञ, अनेस्थिटिस्ट और जिला महामारी विषेषज्ञ को बतौर सदस्य रखेगी ताकि किसी भी व्यक्ति/संस्थान या संगठन द्वारा इस अधिनियम के तहत विनियम या आदेष की अवहेलना/अलगाव का पुनरीक्षण करेंगे। यदि अवहेलना साबित होती है तो, संबंधित जिले के सिविल सर्जन द्वारा उस व्यक्ति/संस्था के खिलाफ, इस अधिनियम के अन्तर्गत अपराध/अनियमितता दर्षाते हुए, नोटिस जारी किया जाऐगा। उस नोटिस की एक प्रति संबंधित जिला के सिविल सर्जन को भी भेजी जाएगी।
12. उस व्यक्ति/संस्था या संगठन से प्राप्त हुए नोटिस के उत्तर को जिला कमेटी द्वारा पुनर्विचार किया जायेगा। यदि नोटिस के प्राप्त होने पर उसका उत्तर निर्धारित समयावधि के बीच प्राप्त न हुआ या कमेटी सदस्यों द्वारा उत्तर सन्तोषजनक न पाया गया और यह प्रमाणित हो जाए कि व्यक्ति/संस्था या संगठन ने इस अधिसूचना के विनियमों की अवहेलना की है तो जिला के सिविल सर्जन एपीडेमिक डिजीज एक्ट तथा इन विनियमों की धारा 11 के अन्तर्गत संबंधित व्यक्ति/संस्था या संगठन के विरूद्ध कार्यवाही करेगा।
13. दण्डः कोई भी व्यक्ति/संस्था या संगठन इस बनाये गये अधिनियम के किसी नियम या आदेष की उलंघना करता है, वह भारतीय दण्ड संहिता (45 आफ 1860) की धारा 188 के अन्तर्गत दण्ड का भागी समझा जाएगा। इस अधिनियम के तहत नियमों या आदेषों का उल्लंघन करते पाए जाने वाले व्यक्ति/संस्था या संगठन को जिला प्रषासन दण्डित कर सकता है।
14. इस अधिनियम के अन्तर्गत कार्यवाही करने वाले व्यक्ति की सुरक्षाः इस अधिनियम के अन्तर्गत किसी भी व्यक्ति द्वारा किये गये कार्य या नेक नियति से किये गये कार्य करने के विरूद्ध कोई भी न्यायिक या कानूनी कार्यवाही नहीं की जा सकेगी।
15. यह नियम तुरन्त प्रभाव से लागू होगेंं और इनके प्रकाषन की तिथि से तीन साल तक वैध रहेंगे।

Notification

No. 46/13/2019-5HBII.— Whereas, the Governor of Haryana is satisfied that the State of Haryana is threatened with a possible outbreak of a dangerous epidemic disease namely Influenza A H1N1, and the ordinary provisions of law for the time being in force are insufficient for the purpose. Now, therefore, in exercise of the powers conferred by Section 2.1, 3 &4 of the epidemic diseases Act 1897, the Governor of Haryana is pleased to make the following regulations for the 3 Years (i.e. F.Y. 2019-20, 2020-21 & 2021-2022).
1. These regulations may be called the Haryana Epidemic Diseases, Influenza A H1N1 Regulation, 2019 and shall remain valid for three years from the date of publication.
2. In these regulation, unless the context otherwise requires, "Epidemic Disease means Influenza A H1N1.
3. All Hospitals (Government /Private) will follow the categorization of Influenza A H1N1 issued by the Government of India and available at the website of NCDC (National Centre for Disease Control, New Delhi).
HARYANA GOVT. GAZ. (EXTRA.), NOV. 19, 2019 (KRTK. 28, 1941 SAKA) 43134. Isolation Centre means any place which may be declared by concerned Civil Surgeon where Influenza A H1N1 Suspected/Confirmed cases may be admitted for Treatment and Sample Collection for Influenza A H1N1.
5. All Hospitals (Government and Private) to inform the Health Department of Haryana through respective Civil Surgeons immediately about all cases of ILI (Influenza like illness) in category –B of Influenza H1N1 and about a Confirmed Case of Influenza A H1N1 being reported in their institution should be put on treatment as per Protocol and Guidelines of Government of India without waiting for the laboratory results of such cases.
(a) The detail of the Nodal Officers of State and District with their contact numbers and e-mail address for reporting has been uploaded on website of Health Department Haryana (haryanahealth.nic.in)
6. All cases of Influenza A H1N1whether Suspected or Confirmed should be kept in isolation to avoid any spread of the disease.
7. All Hospital/Medical Colleges should have Screening Centers (Flu corner) so that the ARI/ILI patient is screened at the earliest.
8. The recommended test for confirmed diagnosis of Influenza A H1N1 by RT PCR method will only be accepted to be done by Government designated Labs.
9. No Person/Institution or Organization will spread any information or material for management of Influenza A H1N1 without prior permission from Health Department Haryana.
10. No Person/Institution or Organization will use any print or media in any form for Influenza A H1N1 without prior permission from Health Department Haryana.
11. Notice for disobeying the notification: A committee under the Chairmanship of Civil Surgeon will be constituted in each District, which will have Medical Specialist, Paediatrician, Anaesthetist and District Epidemiologist as member to review any disobeying/deviation done by any Person/Institution or Organization against regulation or order made under this act. If disobeying is proved, a notice will be issued by the Civil Surgeon of the concerned District against the Person/Institution or Organization indicating the offence/irregularity conducted as per this notification, a copy of the notice will be sent to Civil Surgeon of the concerned District.
12. The reply of the Person/Institution or Organization received against the notice will be reviewed by the above said District Committee. If reply is not received within stipulated time of receipt of the notice or if the reply found unsatisfactory by the committee members and it is confirmed that the Person/Institution or Organization has disobeyed the regulations under this notification, The Civil Surgeon of the District is to take action against the concerned Person/Institution or Organization as per section 3 of Epidemic Disease Act and section 11 of these regulations.
13. Penalty: Any person/institution or organization disobeying any regulation or order made under this act shall be deemed to have committed an offence punishable under section 188 of Indian Penal Code (45 of 1860). District Administration can Penalize Person/ Institution or Organization found disobeying the regulations or orders made under this act.
14. Protection to person acting under Act: No suit or legal proceeding shall lie against any person for anything done or in good faith intended to be done under this Act.
15. This regulation shall come into force at once and shall remain valid for three years from the date of publication.
