संख्या 2/1/2019-आर-II.- हरियाणा नगरपालिका निर्वाचन नियम, 1978 को आगे संषोधित करने के लिए नियमों का निम्नलिखित प्रारूप, जिसे हरियाणा के राज्यपाल, राज्य निर्वाचन आयोग के परामर्ष से हरियाणा नगरपालिका अधिनियम, 1973 (1973 का 24), की धारा 257 की उप-धारा (1) के खण्ड (ग) से (छ), उप-धारा (2), (4) तथा (7) तथा धारा 276 द्वारा प्रदत्त षक्तियों का प्रयोग करते हुये, बनाने का प्रस्ताव करते हैं तथा उक्त अधिनियम की धारा 257 की उप-धारा(5) द्वारा यथापेक्षित ऐसे व्यक्तियों की जानकारी के लिए, इसके द्वारा, प्रकाषित किया जाता है, जिनके इससे प्रभावित होने की सम्भावना है।

इसके द्वारा नोटिस दिया जाता है कि इस अधिसूचना के राजपत्र में प्रकाषन की तिथि से दस दिन की अवधि की समाप्ति पर या उसके पश्चात्‌ सरकार, नियमों के प्रारूप पर, ऐसे आक्षेपों या सुझावों, यदि कोई हो, सहित जो प्रधान सचिव, हरियाणा सरकार, षहरी स्थानीय निकाय विभाग, चण्डीगढ़ द्वारा नियमों के प्रारूप के सम्बन्ध में किसी व्यक्ति से इस प्रकार विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त किये जायें, विचार करेगी।

प्रारूप नियम

1. ये नियम हरियाणा नगरपालिका निर्वाचन (संषोधन) नियम, 2019, कहे जा सकते हैं।

2. हरियाणा नगरपालिका निर्वाचन नियम, 1978 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 2 में, खण्ड (ज) में, ''सदस्य '' षब्द के स्थान पर, ''अध्यक्ष तथा सदस्य'' षब्द प्रतिस्थापित किये जाएंगे।

3. उक्त नियमों में, नियम 21 मेें,-

(i) विद्यमान उपान्तिक षीर्ष के स्थान पर, निम्नलिखित उपान्तिक षीर्ष प्रतिस्थापित किया जाएगा, अर्थात्‌ : - ''अध्यक्ष और सदस्यों के लिए अयोग्यताएं '' ;

(ख) खण्ड (घ) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाएगा, अर्थात्‌ः -

'' समिति और राज्य सरकार के अधीन लाभ का कोई भी पद धारण करे '' ;

(ग) खण्ड (त) के द्वितीय परन्तुक में, ''योग्यता पांचवी पास होगी'', षब्दों के स्थान पर, ''अध्यक्ष को छोड़कर सदस्यों के लिए योग्यता पांचवी पास होगी'' षब्द प्रतिस्थापित किये जाएंगे ;

(iii) उप-नियम (4) में, ''चाहे कोई सदस्य होे'' षब्दों के स्थान पर, ''चाहे अध्यक्ष या कोई सदस्य हो'' षब्द प्रतिस्थापित किये जाएंगे।

4. उक्त नियमों में, नियम 23 मेें,-

(i) उप-नियम (1) में, ''नगरपालिका की सदस्यता के लिये'' षब्दों के स्थान पर, ''अध्यक्ष या समिति की सदस्यता के लिये'' षब्द तथा चिह्‌न प्रतिस्थापित किये जाएंगे;

(ii) उप-नियम (4) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाएगा, अर्थात :-

''(4) इस नियम की कोई भी बात किसी भी उम्मीदवार को उसी निर्वाचन-क्षेत्र में अध्यक्ष या सदस्य के निर्वाचन के लिए एक से अधिक नामांकन पत्रों द्वारा नाम निर्देषित किए जाने से नही रोकेगी :

परन्तु उसी निर्वाचन क्षेत्र में अध्यक्ष या सदस्य के निर्वाचन हेतु किसी उम्मीदवार द्वारा या की ओर चार से अधिक नामांकन पत्र न तो प्रस्तुत किए जाएंगे या न ही रिटर्निग अधिकारी द्वारा स्वीकार किए जाएंगे। 5. उक्त नियमों में, नियम 24 मेें,-

(i) उप नियम (1) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''(1) किसी उम्मीदवार के नामांकन पत्र को तब तक विधिवत्‌ दिया गया नहीं समझा जायेगा, जब तक नियम 23 के अधीन उसे देते समय उम्मीदवार द्वारा नीचे दी गई तालिका में दर्षाई गई राषि या तो रिटर्निंग अधिकारी के पास नकद जमा नहीं करवा दी जाती अथवा जमा नहीं करवाता, अथवा नामांकन पत्र के साथ यह दर्षाते हुये रसीद संलग्न नहीं करता है कि उक्त राषि सरकारी खजाने में जमा करवा दी है या उस दिन के बाजार मूल्य के बराबर सरकारी प्रनोट संलग्न नहीं करता :-

परन्तु जहां किसी उम्मीदवार द्वारा उसी निर्वाचन-क्षेत्र में अध्यक्ष और सदस्य के लिये निर्वाचन के लिए एक से अधिक नामांकन पत्र भरे गये हैं, तो इस उपनियम के अधीन उससे एक से अधिक बार राषि जमा करवाने की अपेक्षा नहीं की जायेगी।'' ;श्

(ii) ''उप-नियम (4) मेें, विद्यमान परन्तुक के स्थान पर, निम्नलिखित परन्तुक प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''परन्तु, यदि किसी उम्मीद्‌वार द्वारा एक से अधिक निर्वाचन क्षेत्र में अध्यक्ष अथवा सदस्य के चुनाव के लिए नामांकन पत्र भरे गये हैं, तो उस द्वारा या उसके निमित्त जमा करवाई गई राषियों में से एक से अधिक नहींं लौटाई जाएगी तथा षेष राषि राज्य सरकार द्वारा जब्त कर ली जायेगी।''।

6. उक्त नियमों में, नियम 31 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जायेगा; अर्थात्‌ :-

''31. उम्मीदवार निर्वाचित समझा जायेगा यदि संख्या एक है,- (1) यदि किसी निर्वाचन-क्षेत्र में अध्यक्ष या सदस्य के लिए केवल एक उम्मीदवार है, तो निर्वाचन अधिकारी रिक्ति को भरने के लिए ऐसे उम्मीदवार को विधिवत्‌ निर्वाचित घोषित करेगा ।1108 HARYANA GOVT. GAZ., DEC. 31, 2019 (PAUS. 10, 1941 SAKA) [PART I (2) यदि कोई उम्मीदवार निर्वाचित नहीं किया जाता है, तो राज्य निर्वाचन आयुक्त रिक्ति को भरने हेतु व्यक्तियों का चुनाव करवाने के लिए नियम 19 के अधीन नया निर्वाचन कार्यक्रम बनाएगा ।''।

7. उक्त नियमों में, नियम 32 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''32. मतदान करवाया जाना, यदि उम्मीदवारों की संख्या रिक्तियों की संख्या से अधिक है .- यदि किसी निर्वाचन-क्षेत्र में अध्यक्ष के लिए अथवा सदस्य के लिए निर्वाचन लड़ने वाले उम्मीदवारों की संख्या एक से अधिक है, तो मतदान करवाया जायेगा।''।श्

8. उक्त नियमों में, नियम 33 मेंं, ''सदस्य'' षब्द के स्थान पर, ''अध्यक्ष या सदस्य'' शब्द प्रतिस्थापित किये जाएंगे। 9. उक्त नियमों में, नियम 62 मेंं, ''यदि उस निर्वाचन-क्षेत्र में कोई भी मतदान नए सिरे से करवाया जाना आवष्यक न हो'' षब्दों के स्थान पर, ''यदि अध्यक्ष और सदस्य के लिए उस निर्वाचन-क्षेत्र में कोई भी मतदान नए सिरे से करवाया जाना आवष्यक न हो'' षब्द प्रतिस्थापित किये जाएंगे। 10. उक्त नियमों में, नियम 70 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''70. अध्यक्ष तथा सदस्यों के पद के लिए राजनिष्ठा की षपथ, और उप-अध्यक्ष के चुनाव के लिए समय सीमा- (1) जब तक राज्य सरकार अन्यथा निर्देष न करे, उपायुक्त या इस निमित्त उस द्वारा नियुक्त कोई राजपत्रित अधिकारी, समिति में चुने गये अध्यक्ष तथा सदस्यों के नामों की अधिसूचना के प्रकाषन के तीस दिन के भीतर, नव गठित समिति के निर्वाचित सदस्यों के सामान्य निवास स्थान पर अड़तालीस घण्टे का नोटिस भेजकर नियम 24 के अधीन राजनिष्ठा की षपथ हेतु प्रथम बैठक बुलायेगा। नोटिस में स्पष्ट रूप से उल्लेख किया जायेगा कि उपस्थित अध्यक्ष और सदस्यों को राजनिष्ठा की षपथ दिलाई जाएगी।

(2) उपायुक्त या इस निमित्त उस द्वारा नियुक्त कोई राजपत्रित अधिकारी, उप-नियम (1) में निर्दिष्ट बैठकों के लिए तीस दिन की अवधि के भीतर, अध्यक्ष और सदस्यों को उनके सामान्य निवास स्थान पर अड़तालीस घण्टे का नोटिस भेजकर बैठक बुलायेगा। नोटिस में स्पष्ट रूप से उल्लेख किया जायेगा कि बैठक में षेष बचे सदस्यों को राजनिष्ठा की षपथ दिलाई जाएगी और कि बैठक में उपाध्यक्ष का चुनाव किया जाएगा। संयोजक, प्रथमतः षेष बचे सदस्यों को राजनिष्ठा की षपथ दिलाएगा और उसके बाद उपाध्यक्ष के चुनाव की बैठक की अध्यक्षता करेगा ।

(3) यदि अध्यक्ष और सदस्य उप-नियम (2) के अधीन बुलाई गई बैठक में उपाध्यक्ष का चुनाव करने में असफल रहते हैं, तो उपायुक्त या इस निमित्त उस द्वारा नियुक्त कोई राजपत्रित अधिकारी, उप-नियम (2) में निर्दिष्ट तीस दिन की अवधि के भीतर उपाध्यक्ष का चुनाव उपरोक्त वर्णित प्रक्रिया अनुसार करवाने के लिए अध्यक्ष और सदस्यों की बैठक तब तक बुलाता रहेगा जब तक उपाध्यक्ष का चुनाव न हो जाये । (4) यदि अध्यक्ष और सदस्य उप-नियम (2) और (3) के अधीन बुलाई गई बैठकों में उपाध्यक्ष का चुनाव, अध्यक्ष और सदस्यों के नाम राज्य निर्वाचन आयोग की अधिसूचना के प्रकाषन के पांच मास की समाप्ति की अवधि तक करवाने में असफल रहते हैं, तो उपायुक्त या इस निमित्त उस द्वारा नियुक्त कोई राजपत्रित अधिकारी उपाध्यक्ष का चुनाव करवाने के लिए अध्यक्ष और सदस्यों को उनके सामान्य निवास स्थान पर अड़तालीस घण्टे का नोटिस भेजकर बैठक बुलायेगा। नोटिस में स्पष्ट रूप से उल्लेख किया जायेगा कि यदि अध्यक्ष और सदस्य चुनाव करने में असफल रहते हेैं, तो समिति बिना किसी आगामी नोटिस या आदेष के भंग कर दी गई समझी जाएगी।

(5) अधिनियम या नियमों के प्रतिकूल किसी बात के होते हुये भी, यदि अध्यक्ष और सदस्य, अध्यक्ष तथा सदस्यों के चुनाव अधिसूचना की तिथि से छः मास की अवधि की समाप्ति तक उपरोक्त उपबन्धों के अधीन दी गई प्रक्रिया अपनाने के बाद बुलाई गई बैठक में उपाध्यक्ष का चुनाव करवाने में असफल रहते हैं, तो समिति अधिनियम या इसके अधीन बनाए गए नियमों में किसी भी प्रक्रिया का अनुपालन किये बिना तुरन्त प्रभाव से भंग समझी जाएगी :

परन्तु ऐसी बैठकों को समिति की वेैध रूप से बुलाई गई बैठकें समझा जाएगा।

(6) धारा 31 के अधीन किसी भी उप-नियम में दी गई किसी भी बात के होते हुये भी, राजनिष्ठा की षपथ दिलाए जाने और उपाध्यक्ष के चुनाव को बैठकों में कार्यवृतों में कार्यवाहियों के भाग के रूप में अभिलिखित किया जाएगा।''।

11. उक्त नियमों में, नियम 70 के बाद, निम्नलिखित नियम रखा जायेगा, अर्थात्‌ :-

'' 70 क. अध्यक्ष के पद का आरक्षण.- नगरपालिकाओं में अध्यक्ष का पद सामान्य श्रेणी, अनुसूचित जातियों, पिछड़े वर्गों से सम्बन्धित व्यक्तियों तथा महिलाओं में से निर्वाचकों द्वारा प्रत्यक्ष चुनाव द्वारा चक्रानुक्रम द्वारा भरा जाएगा जो निम्नलिखित रीति में अवधारित किया जाएगा, अर्थात्‌ :- (i) राज्य में अनुसूचित जातियों और पिछडे़ वर्गों के लिए आरक्षित अध्यक्ष के पदाें की संख्या, ऐसे अनुपात में होगी जो राज्य की कुल जनसंख्या में राज्य में अनुसूचित जातियों और पिछडे़ वर्गों की जनसंख्या के समान नगरपालिकाओं के ऐसे पदों की कुल संख्या के समान अनुपात में हो ;

(ii) नगरपालिकाओं मेंं अध्यक्ष के पदों की कुल संख्या का कम से कम एक तिहाई, अनुसूचित जातियों और पिछडे़ वर्गों की महिलाओं के लिए आरक्षित पदाें सहित महिलाओं के लिए आरक्षित होगी। महिलाओं के लिए पदों का आरक्षण अलग-अलग नगरपालिकाओं में बारी-बारी से होगा, जो निदेषक, शहरी स्थानीय निकाय विभाग और सम्बन्धित जिलों के उपायुक्तों या उनके नाम निर्देषितियों से मिलकर बनने वाली समिति द्वारा ड्रा ऑफ लॉटस द्वारा अवधारित किया जायेगा, तथा

(iii) अनुसूचित जातियों और पिछडे़ वर्गों के लिये अध्यक्ष के पदों की संख्या उनकी जनसंख्या के आधार पर अवधारित की जायेगी और प्रथमतः अनुसूचित जातियों की अधिकतम जनसंख्या वाली विभिन्न नगरपालिकाओं, द्वितीयतः पिछड़े वर्गों की अधिकतम जनसंख्या वाली शेष नगरपालिकाओं में बारी-बारी से होगी तथा इस तरह उनकी अगली अधिकतम जनसंख्या वाली नगरपालिकाओं के पदाें की पष्चात्‌वर्ती अवधि में बारी-बारी से होगी। यदि दो नगरपालिकाओं या नगर परिषदों की जनसंख्या की प्रतिषतता पिछड़े वर्गों तथा अनुसूचित जातियों के सम्बन्ध में एक समान है, तो आरक्षण, उपरोक्त खण्ड (ii) में निर्दिष्ट समिति द्वारा संचालित किए जाने वाले ड्रा ऑफ लॉटस द्वारा अवधारित किया जाएगा।'' 12. उक्त नियमों में, नियम 71 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''मतपत्र का लिया जाना और उसके बाद परिणाम .- (1) यदि उपाध्यक्ष के पद के लिए केवल एक उम्मीदवार का प्रस्ताव किया जाता है, तो ऐसे उम्मीदवार को विधिवत्‌ निर्वाचित घोषित किया जाएगा। यदि प्रस्तावित उम्मीदवारों की संख्या एक से अधिक है, तो मतदान, बैलेट पेपर या इलेक्ट्रोनिक वोंिंंटंग मषीन द्वारा होगा। अध्यक्ष सहित सभी सदस्यों को जैसा राज्य निर्वाचन आयोग द्वारा निर्देषित किया जाए या तो बैलेट पेपर में तीर क्रास मार्क रबर मोहर लगाकर या इलेक्ट्रोनिक वोंिंंटंग मषीन के माध्यम से मतदान करना अपेक्षित होगा। अधिकतम मत प्राप्त करने वाले उम्मीदवार को निर्वाचित घोषित किया जायेगा। ऐसे मतदान के लिए विषेष मतपत्र का प्रयोग किया जाएगा और उसमें उपायुक्त द्वारा उस पर लगाया हुआ अधिकारिक चिह्‌न होगा। (2) ऐसे मतदान के लिए प्रयुक्त सभी बैलेट पेपर मतगणना के पूरा होने के तुरंत बाद स्टाउट लिफाफे में बंद किये जायेंगे और अधिकारी जो अध्यक्ष सहित मौजूदा सदस्यों को ध्यान में रखते हुये बैठक की अध्यक्षता करता है द्वारा सीलबद्ध किया जाएगा तथा चुनाव का विवरण सम्बन्धित मतपत्रों को अंकित किया जाएगा और ऐसे लिफाफे को एक अन्य बडे़ लिफाफे में बंद किया जाएगा और उपायुक्त को दिया जाएगा। उपायुक्त चुनाव की तिथि से एक वर्ष की समाप्ति तक आंतरिक लिफाफे को बरकरार रखेगा और उसके बाद राज्य सरकार, सक्षम न्यायालय या इन नियमों के भाग V के अधीन किसी चुनाव की जांच के लिएश्नियुक्त किये गये व्यक्ति या व्यक्तियों के प्रतिकुल निर्देषों के अधीन रहते हुये इसके विषय वस्तु को नष्ट करवाएगा।''

13. उक्त नियमों में, नियम 72 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''72. मतों की समानता की दषा में प्रक्रिया.- यदि दो या अधिक उम्मीदवार मतों की समान संख्या प्राप्त करते हैं तथा यह कि मतों का परिवर्धन उपाध्यक्ष के रूप में चुने जाने के लिए किसी भी उम्मीदवार को अधिकृत करेगा, तब बैठक की अध्यक्षता करने वाला अधिकारी उम्मीदवारों की उपस्थिति में किए जाने वाले ड्रा ऑफ लाटस द्वारा लड़ने वाले उम्मीदवारों के मध्य विनिष्चय करेगा, तथा उम्मीदवार, जिसके पक्ष में ड्रॉ ऑफ लाट्‌स होगा, को चुना गया समझा जाएगा। ''।

14. उक्त नियमों में, नियम 72 क के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जायेगा, अर्थात्‌ :-

''72 क. उपाध्यक्ष के विरूद्ध अविष्वास प्रस्ताव.-(1) समिति के उपाध्यक्ष के विरूद्ध अविष्वास प्रस्ताव, उपायुक्त को सम्बोधित लिखित माँग जो समिति के अध्यक्ष सहित सदस्यों की कुल संख्या के कम से कम एक तिहाई सदस्यों से हस्ताक्षरित हो, के माध्यम से लाया जा सकता है : परन्तु अध्यक्ष सहित सदस्य जिनके द्वारा ऐसा प्रस्ताव लाया गया है, प्रयोजन हेतु बुलाई गई बैठक से पूर्व इस प्रस्ताव को वापिस ले सकते हैं। व्याख्या :- इस नियम के अधीन किसी भी अंष को पूर्ण रूप में लिया जाएगा । (2) उपायुक्त या उपायुक्त द्वारा प्राधिकृत ऐसा कोई अधिकारी जो सहायक आयुक्त की पदवी से नीचे का न हो, अध्यक्ष सहित प्रत्येक सदस्य को उनके उपयोग के लिए माँग की प्रति वितरित करेगा । (3) उपायुक्त या उपायुक्त द्वारा प्राधिकृत ऐसा कोई अधिकारी जो अतिरिक्त सहायक आयुक्त की पदवी से नीचे का न हो, ऐसा नोटिस जो पंद्रह दिन से कम का न हो, देकर उपनियम (1) में निर्दिष्ट अविष्वास प्रस्ताव में विचारण के लिए विषेष बैठक बुलाएगा, और ऐसी बैठक की अध्यक्षता करेगा : ''परन्तु प्रयोजन के लिए कोई भी ऐसी बैठक ऐसी तिथि जिसको उपाध्यक्ष का निर्वाचन अधिसूचित किया गया था, से एक वर्ष की समाप्ति से पूर्व नहीं बुलाई जायेगी, तथा ऐसी अवधि की समाप्ति के बाद जब भी ऐसी बैठक उसकी पदावधि के दौरान बुलाई जाती है तथा पद खाली करने के लिए प्रस्ताव असफल हो जाता है, तो उसके बाद कोई भी बैठक किसी भी समय उपाध्यक्ष के विरूद्ध समरूप प्रस्ताव विचारने के लिए तब तक नहीं बुलाई जाएगी जब तक अन्तिम असफलता तथा तिथि जिसको ऐसी आगामी बैठक बुलाई गई है, के बीच कम से कम छः मास की अवधि का अन्तराल न हो''।1110 HARYANA GOVT. GAZ., DEC. 31, 2019 (PAUS. 10, 1941 SAKA) [PART I (4) यदि समिति के अध्यक्ष सहित सदस्य के कम से कम दो तिहाई सदस्य के समर्थन से अविष्वास प्रस्ताव लाया जाता हैं, तो उपाध्यक्ष, द्वारा उसके पद को रिक्त कर दिया गया समझा जाएगा । 15. उक्त नियमों में, नियम 72 ख मेंं, ''अध्यक्ष अथवा'', षब्दों का लोप कर दिया जाएगा।

16. उक्त नियमों में, नियम 74 के स्थान पर निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

'' 74 अध्यक्ष या सदस्य का कोई भी निर्वाचन, इन नियमों के अनुसरण में प्रस्तुत की गई किसी निर्वाचन याचिका के सिवाय प्रष्नगत नही होगा। ''।

17. उक्त नियमों में, नियम 75 में, ''अध्यक्ष या'', षब्दों का लोप कर दिया जाएगा।

18. उक्त नियमों में, विद्यमान प्ररूप 1, 1-ग, 1-घ, 2, 2क, 2ख, 3, 4, 5, 6, 7, 8, 10, 11, 12, 13, 14, 15, 16, 17 और 18 के स्थान पर, क्रमषः निम्नलिखित प्ररूप प्रतिस्थापित किए जाएंगे, अर्थात्‌ :-

धारा 275-(1) प्रत्येक प्रत्येक कर्मचारी, अभिकर्ता अथवा कोई अन्य व्यक्ति जो किसी चुनाव में मतों की रिकार्डिंग अथवा गणना करने के सम्बन्ध में किसी कर्तव्य का पालन करता है, मतदान की गोपनीयता को बनाए रखेगा और बनाए रखने में सहायता करेगा और किसी व्यक्ति को ऐसी गोपनीयता का उल्लंघन करने के लिए संगणित कोई सूचना (किसी विधि द्वारा अथवा के अधीन प्राधिकृृत कुछ प्रयोजनों के सिवाय) नहीं भेजेगा। (1क) इस अधिनियम या इसके अधीन बनाए गए नियमों में दी गई किसी बात के होते हुए भी, वोटिंग मषीन के माध्यम से वोट डालना और उसकी रिकार्डिंग ऐसी रीति में की जा सकती है जैसी राज्य निर्वाचन आयोग नगरपालिका या नगरपालिकाओं में प्रत्येक मामले की परिस्थितियों के मध्यनजर विनिर्दिष्ट करें । व्याख्या .- इस उप-धारा के प्रयोजन के लिए ''वोटिंग मषीन'' से अभिप्राय है, कोई मषीन या उपकरण चाहे इलेक्ट्रोनिक या अन्य किसी माध्यम से वोट डालने और उसकी रिकार्डिंग के लिए प्रयुक्त की जाती हो और इस अधिनियम या इसके अधीन बनाए गए नियमों में बैलेट बाक्स या बैलेट पेपर के किसी सन्दर्भ का अन्यथा उपबन्धित के सिवाय, ऐसी वोटिंग मषीन के सन्दर्भ जहां किसी भी चुनाव में ऐसी वोटिंग मषीन का उपयोग किया गया है, अर्थ लगाया जाएगा।

व्यक्ति जिन के नाम इसके साथ भेजे गये मतपत्र पर मुद्रित हैं वे उपरोक्त निर्वाचन में उम्मीदवार हैं। यदि आप मत देना चाहते हो तो आप नीचे भाग-I में दिये गये निदेषों के अनुसार अपना मत अभिलिखित करेंगे तथा तब भाग- II में विस्तृत हिदायतों का अनुसरण करेंगे।

भाग- I

निर्वाचकों के लिए हिदायतें

1. निर्वाचित किए जाने वाले सदस्यों की संख्या एक है।

2. आपका केवल एक मत है।

3. आपको एक से अधिक उम्मीदवार के लिए मत नहीं देना चाहिए। यदि आप ऐसा करेंगे तो आपका मतपत्र अस्वीकृत कर दिया जायेगा।

4. उम्मीदवार जिसको आप अपना मत देना चाहते हैं उसके नाम के सामने स्पष्ट रूप से चिह्‌न लगाते हुये मत अभिलिखित करें।

5. चिह्‌न इस प्रकार लगाया जाएगा जो उम्मीदवार जिसको आप अपना मत दे रहे हैं को स्पष्ट रूप से सूचित करें तथा सन्देह के परे हो। यदि चिह्‌न इस प्रकार लगया गया है जो उम्मीदवार जिसको आपने अपना मत दिया है को सन्देहपूर्ण बनाता है तो आपका मत अवैध हो जाएगा।

6. चिह्‌न जो मतपत्र पर आपको पैरा 4 के अनुसार उस पर करने अपेक्षित हैं, के सिवाय अपने हस्ताक्षर न करें या कोई शब्द न लिखें या कोई चिह्‌न न लगाएं, हस्ताक्षर या लिखित में कुछ भी ना करें।

7. निर्वाचक प्ररूप-14 में घोषणा पर अपने हस्ताक्षरों का सत्यापन मजिस्ट्रेट या राजपत्रित अधिकारी से करवाएगा, यदि वह निर्वचान डयूटी पर है तो किसी राजपत्रित अधिकारी से या मतदान केन्द्र के पीठासीन अधिकारी से जिस में वह निर्वाचन डयूटी पर है।

भाग- II

निर्वाचकों के लिए हिदायतें

(क) आपको मतपत्र पर अपना मत अभिलिखित करने के पष्चात मतपत्र को इसके साथ भेजे गये ''क'' चिहि्‌नत छोटे लिफाफे में रखे। लिफाफे को बन्द कर दें और उसे मोहर लगाकर या अन्यथा सुरक्षित कर दें।

(ख) इसके उपरान्त आप इसके साथ भेजी गई प्ररूप-14 मेें घोषणा भी मजिस्ट्रेट या किसी अन्य अधिकारी जो आपके हस्ताक्षर सत्यापन करने में सक्षम हो (देखिए उपरोक्त हिदायतें 7) की उपस्थिति में हस्ताक्षर करने हैं। घोषणा ऐसे अधिकारी के पास ले जाएं और उसकी आपकी पहचान के बारे में सन्तुष्टि होने के बाद उसकी उपस्थिति में इसे हस्ताक्षर करें। अधिकारी घोषणा पर आपके हस्ताक्षर सत्यापित करेगा तथा आपको लौटाएगा। आपको अपना मतपत्र तसदीक अधिकारी को ना तो दिखाना है और न ही उसे बताना है कि आपने किस प्रकार मत दिया है। (ग) यदि आप निक्षरता, अन्धेपन या अन्य अषक्तता के कारण उपरोक्त सूचित रीति में स्वयं मतपत्र चिहि्‌नत करने और अपनी घोषणा हस्ताक्षर करने में असमर्थ हैं तो आप मद (ख) में निर्दिष्ट किसी अधिकारी द्वारा आपकी ओर से आपका मत चिहि्‌नत करने और घोषणा हस्ताक्षरित करने के लिये हकदार हैं। ऐसा अधिकारी आपकी प्रार्थना पर आपकी उपस्थित में और आपकी इच्छा के अनुसार मतपत्र को चिहि्‌नत करेगा। वह इस निमित आवष्यक प्रमाण-पत्र भी पूरा करेगा।1142 HARYANA GOVT. (ङ) आप सुनिष्चित कर लें कि लिफाफा चुनाव अधिकारी के पास......................................** को................बजे से पूर्व पहुंच जाए। (च) कृपया यह भी ध्यान रखें कि :-

Notification

The 17th December, 2019

No. 2/1/2019-R-II.— The following draft of rules further to amend the Haryana Municipal Election Rules, 1978, which the Governor of Haryana in consultation with the State Election Commission proposes to make in exercise of the powers conferred by clauses (c) to (g) of sub-section (1) sub-sections (2), (4) and (7) of section 257 and section 276 of the Haryana Municipal Act, 1973 (24 of 1973), is hereby published as required by sub-section (5) of section 257 of the said Act, for the information of persons likely to be affected thereby.

Notice is hereby given that the draft of rules shall be taken into consideration by the Government on or after the expiry of a period of ten days from the date of publication of this notification in the Official Gazette together with objections or suggestions, if any, which may be received by the Principal Secretary to Government, Haryana, Urban Local Bodies Department, Chandigarh from any person in respect of the draft rules before the expiry of the period so specified.

DRAFT RULES

1. These rules may be called the Haryana Municipal Elections (Amendment) Rules, 2019.

2. In the Haryana Municipal Election Rules, 1978 (hereinafter called the said rules), in rule 2, in clause (h) for the words "the members", the words "the president and members" shall be substituted.

3. In the said rules, in rule 21,-

(i) For the existing marginal heading, the following marginal heading shall be substituted, namely:-

"Disqualifications for president and members";

(ii) In sub rule (i),-

(a) for the words "as a member", the words "as president or a member" shall be substituted;

(b) for clause (d), the following clause shall be substituted, namely:-

"hold any office of profit under the committee and the State Government";

(c) in the second proviso to clause (p), for the words "qualification shall be 5th pass", the words "qualification for members excluding president shall be 5th pass" shall be substituted;

(iii) In sub-rule (4), for the words "whether a member", the words "whether the president or a member" shall be substituted.

4. In the said rules, in rule 23-,

(i) in sub-rule (1), for the words "for membership of the committee", the words "for president or member of the committee" shall be substituted;

(ii) for sub rule (4), the following sub-rule shall be substituted namely:-

"(4) Nothing in this rule shall prevent any candidate from being nominated by more than one nomination paper for election of president or member in the same constituency:

Provided that not more than four nomination papers shall be presented by or on behalf of any candidate or accepted by the Returning Officer for election of president or member in the same constituency.

5. In the said rules, in rule 24,-

(i) for sub-rule (1), the following sub-rule shall be substituted, namely:-

"(1) The nomination paper of a candidate shall not be deemed to have been duly delivered unless at the time of delivery of the same under rule 23, the candidate has either deposited or causes to be deposited a sum shown in the table below with the Returning Officer in cash or enclose with the nomination paper a receipt showing that the said sum has been deposited in the Government treasury, or Government promissory notes of equal value at the market rate of the day:-

Provided that where a candidate has been nominated by more than one nomination papers for election of president or member in the same constituency, not more than one deposit shall be required of him under this sub-rule."

(ii) in sub-rule (4), for the existing proviso, the following proviso shall be substituted, namely:-

"Provided that, if a candidate has filed a nomination paper at an election of president or member in more than one constituency, not more than one of the deposits made by him or on his behalf, shall be returned and the remainder shall be forfeited by the State Government.".

6. In the said rules, for rule 31, the following rule shall be substituted, namely:-

"31. Candidate deemed to be elected if the number is one.- (1) If there is only one candidate for President or member in any constituency, the Returning Officer shall declare such candidate to be duly elected to fill the vacancy.

(2) If there is no candidate to be elected, the State Election Commissioner shall frame fresh election programme under rule 19 to elect person to fill the vacancy." .

7. In the said rules, for rule 32, the following rule shall be substituted, namely:-

"32. Poll to be taken if number of candidates is more than number of vacancies.- If the number of contesting candidates for president or member in any constituency is more than one, a poll shall be taken.".

8. In the said rules, in rule 33, for the words "a member", the words "President or member" shall be substituted.

9. In the said rules, in rule 62, for the words "if no fresh poll is required to be held in that constituency", the words "if no fresh poll is required to be held for president and member in that constituency" shall be substituted.

10. In the said rules, for rule 70, the following rule shall be substituted, namely:-

"70. Time line for Oath of allegiance and election of vice-president.- (1) Unless the State Government otherwise directs, the Deputy Commissioner or any gazetted officer appointed by him in this behalf shall, within thirty days of the publication of the notification of the names of the president and members elected to a committee, convene the first meeting of the newly constituted committee at forty-eight hours' notice to be delivered at their ordinary place of residence to administer an oath of allegiance under section 24. The notice shall clearly state that the oath of allegiance shall be administered to the president and members present.

(2) The Deputy Commissioner or any gazetted officer appointed by him in this behalf shall, within a period of thirty days of the meeting referred to in sub-rule (1), convene a meeting of the president and members at forty-eight hours notice to be delivered at their ordinary place of residence. The notice shall clearly state that the oath of allegiance shall be administered to the left over members and that the election of the vice-president shall be held in the meeting. The convener shall firstly administer the oath of allegiance to the left over members and thereafter shall preside over the meeting of the election of vice-president.

(3) If the president and members fail to elect the vice-president in the meeting convened under sub- rule (2), the Deputy Commissioner or any gazetted officer appointed by him in this behalf shall, within a period of thirty days of the meeting referred to in sub-rule (2), convene meeting of the president and members for the election of the vice-president as per the procedure mentioned above until the vice-president are elected.

(4) If the president and members fail to elect the vice-president in the meetings convened under sub-rule (2) or (3) till the expiry of five months from the date of notification of elected president and members by the State Election Commission, the Deputy Commissioner or any gazetted officer appointed by him in this behalf shall, convene a meeting of the president and members for the election of vice-president at forty-eight hours' notice to be delivered at their ordinary place of residence. The notice shall clearly state that if the members fail to elect the vice-president in the meeting, the committee shall be deemed to have been dissolved without any further notice or order.

(5) Notwithstanding anything contrary to the Act or rules, if the president and members fail to elect the vice-president in the meetings convened after following the procedure provided under aforesaid provisions till the expiry of six months from the date of notification of the elected president and members, the committee shall be deemed to be dissolved with immediate effect without following any procedure provided under the Act or rules made there under:

Provided that such meetings shall be deemed to be validly convened meetings of the committee.

(6) Notwithstanding anything contained in any bye-laws made under section 31, the administration of the oath of allegiance and the election of the vice-president shall be recorded as part of the proceedings in the minutes of the meetings.".

11. In the said rules, after rule 70, the following rule shall be inserted, namely:-

"70 A. Reservation of office of president.- The office of the president in the municipalities shall be filled through direct election by the electors from amongst the persons belonging to the general category, Scheduled Castes, Backward Classes and women by rotation which shall be determined in the following manner, namely:-

(i) the number of offices of the president reserved for the Scheduled Castes and Backward Classes in the State shall bear as may be the same proportion to the total number of such offices of the municipalities as the population of the Scheduled Castes and Backward Classes in the State bears to the total population of the State;

(ii) not less than one third of the total number of offices of the president in the municipalities shall be reserved for women including the offices reserved for Scheduled Castes and Backward Classes women. The reservation of offices for women shall rotate to different municipalities which shall be determined by draw of lots by a committee consisting of the Director, Local Bodies and Deputy Commissioners of the districts concerned or their nominee; and

(iii) the number of offices of the president for Scheduled Castes and Backward Classes shall be determined on the basis of their population and shall rotate to different municipalities firstly, having largest population of Scheduled Castes, secondly, from the remaining municipalities having largest population of Backward Classes and they rotate in the subsequent terms of offices of the municipalities having their next largest population and so on. In case percentage of population of two Municipal Committees or Municipal Councils as regards Backward Classes and Scheduled Castes is the same, the reservation shall be determined by draw of lots to be conducted by a committee referred clause (ii) above.".

12. In the said rules, for rule 71, the following rule shall be substituted, namely:-

"71. Ballot to be taken and result thereof.- (1) If only one candidate for the office of vice-President is proposed, such candidate shall be declared to have been duly elected. If the number of proposed candidates is more than one, the voting shall be by ballot paper or electronic voting machine. The members including president present shall be required to vote by ballot paper by marking with arrow cross mark rubber stamp or by electronic voting machine, as may be directed by the State Election Commission. The candidate getting the maximum number of votes shall be declared to have been elected. Special ballot paper shall be used for such voting and it shall bear an official mark to be placed thereon by the Deputy Commissioner.

(2) All ballot papers used for such voting shall, immediately after the counting of votes has been completed, be enclosed in the stout envelope and sealed by the officer who presided at the meeting in the view of the members including president present there at and the description of the election to which the ballot papers relate shall be inscribed thereon and such envelope shall be enclosed in another large envelope which shall be addressed and delivered to the Deputy Commissioner. The Deputy Commissioner shall preserve the inner envelope intact until the expiry of one year from the date of the election and shall then, subject to any direction to the contrary made by the State Government or a competent court or a person or persons appointed to hold an enquiry into an election under Part V of these rules, cause it to be destroyed with its contents.".

13. In the said rules, for rule 72, the following rule shall be substituted, namely:-

"72. Procedure in case of the equality of votes.- If two or more candidates obtain an equal number of votes and that the addition of a vote would entitle any of the candidates to be elected as vice-president, then the officer presiding over the meeting shall decide, between the contesting candidates by draw of lots to be drawn in the presence of the candidates, and the candidate on whose favour the draw of lot falls shall be deemed to have been elected.".

14. In the said rules, for rule 72 A, the following rule shall be substituted, namely:-

"72 A. No confidence motion against vice-president.- (1) A motion of no confidence against the vice- president of a committee may be made through a requisition given in writing addressed to the Deputy Commissioner, signed by not less than one-third of the total number of members including president of a committee:

Provided that the members including president who have made such a motion may withdraw the same before the meeting is convened for the purpose.

Explanation:- Any fraction under this rule shall be taken as a whole.

(2) The Deputy Commissioner or such other officer not below the rank of an Extra Assistant Commissioner, as the Deputy Commissioner may authorise, shall circulate to each member including president a copy of the requisition for their use.

(3) The Deputy Commissioner or such other officer not below the rank of Extra Assistant Commissioner, as the Deputy Commissioner may authorise, shall convene a special meeting by giving a notice of not less than fifteen days for the consideration of the motion referred to in sub-rule (1), and shall preside over at such meeting:

Provided that no such meeting for the purpose shall be convened before the expiry of one year from the date on which the election of the vice president was notified, and after the expiry of such period, whenever any such meeting is convened during his term of office and the proposal for vacating the office fails, no further meeting shall at any time thereafter be convened for considering a similar proposal, against the vice president unless a period of at least six months intervenes between the last failure and the date on which such further meeting is convened.

(4) If the motion is carried out with the support of not less than two-third of the members including president of the committee, the vice-president shall be deemed to have vacated his office."

15. In the said rules, in rule 72 B, the words "President or", shall be omitted.

16. In the said rules, for rule 74, the following rule shall be substituted, namely:-

"74. No election of the president or member shall be called in question except by an election petition presented in accordance with these rules.".

17. In the said rules, in rule 75, the words "President or", shall be omitted.

18. In the said rules, for the existing Form number 1, 1 C, 1 D, 2, 2 A, 2 B, 3, 4, 5, 6, 7, 8, 10, 11, 12, 13, 14, 15, 16, 17 and 18, the following forms shall be substituted, namely :-

Section 275 – (1) Every employee, agent or other person who performs any duties in connection with the recording or counting votes at an election shall maintain an aid in maintaining the secrecy of the voting and shall not (except for some purpose authorized by or under any law) communicate to any person any information calculated to violate such secrecy.

1(A) Notwithstanding anything contained in this Act or the rules made there under, the casting and recording of votes by voting machines may be adopted in such manner as may be prescribed, in such municipality or municipalities as the State Election Commission may, having regard to the circumstances of each case, specify.

Explanation.- For the purpose of this sub-section "voting machine" means any machine or apparatus whether operated electronically or otherwise used for casting or recording of votes and any reference to a ballot box or ballot paper in this Act or the rules made there under shall, save as otherwise provided, be construed as including a reference to such voting machine wherever such voting machine is used at any election.

(2) Any person who willfully acts in contravention of the provisions of this section shall be punished with imprisonment of either description for a term not exceeding three months, or with fine, or with both.

PART I

DIRECTIONS TO ELECTORS

1. The number of members to be elected is one.

2. You have only one vote.

3. You must not vote for more than one candidate. If you do so your ballot paper shall be rejected.

4. Record the vote by placing clearly a mark opposite the name of the candidate to whom you wish to give that vote.

5. The mark shall be so placed as to indicate clearly and beyond doubt to which candidate you are giving your vote. If the mark is so placed as to make it doubtful to which candidate you have given the vote, that vote shall be invalid.

(a) After you have recorded your vote on the ballot, place the ballot paper in the smaller cover marked "A" sent herewith. Close the cover and secure it by seal or otherwise.

(b) You have then to sign the declaration in Form 14 also sent herewith in the presence of a Magistrate or any other Officer competent to attest your signature (see direction 7 above). Take the declaration to any such Officer and sign it in his presence after he has been satisfied about your identity. The Officer shall attest your signature and return the declaration to you. You must not show your ballot paper to the Attesting Officer nor tell him how you have voted.

(c) If you are unable to mark the ballot paper and sign the declaration your self in the manner indicated above by reason of illiteracy, blindness or other infirmity you are entitled to have your vote marked and the declaration signed on your behalf by any Officer referred to in item (b). Such an Officer shall at your request mark the ballot paper in your presence and in accordance with your wishes. He shall also complete the necessary certificate in this behalf.

(d) After your declaration has been signed and your signature has been attested in accordance with item (b) or item (c) place the declaration in Form 14 as also the smaller cover marked "A" containing ballot paper, in the larger cover marked "B". After closing the larger cover, sent it to the Returning Officer by post or by messenger.
