दिनांक 17 फरवरी, 2020

संख्या 14.- हरियाणा विधान सभा (सदस्य वेतन, भता तथा पेंषन) अधिनियम, 1975, (1975 का 2), की धारा 9 की उपधारा (2) के साथ पठित उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अध्यक्ष, हरियाणा विधान सभा, इसके द्वारा, हरियाणा विधान सभा सदस्य (पेंषन) नियम, 1978, को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. (1) ये नियम हरियाणा विधान सभा सदस्य (पेंषन) संषोधन नियम, 2019, कहे जा सकते हैं।

(2) ये नियम प्रथम जनवरी, 2016 से लागू समझे जायेंगे।

2. हरियाणा विधान सभा सदस्य (पेंषन) नियम, 1978 में, नियम 7-क में, उप-नियम (2) के स्थान पर निम्नलिखित उप-नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

"(2) पति-पत्नी अथवा बच्चे, जैसी भी स्थिति हो, राज्य सरकार के 2016 के बाद के पेंषनरों के लिए विहित विद्यमान दर पर मंहगाई राहत सहित, पूर्व-संषोधित पारिवारिक पेंषन, मंहगाई पारिवारिक पेंषन तथा 245 प्रतिषत मंहगाई राहत को विलय करते हुए, प्रतिमास पन्द्रह हजार रूपये या मृतक सदस्य द्वारा ली जा रही अन्तिम पेंषन (पेंषनमंहगाई पेंषन, यदि कोई हो) का पचास प्रतिषत की पारिवारिक पेंषन, जो भी अधिक हो, लेने के हकदार होंगेः परन्तु यदि, पारिवारिक पेंषनर पुनरीक्षण के पशचात्‌ समेकित पेंषन से अधिक पेंषन पहले ही ले रहा है, तो राषि का अन्तर, नियम मंहगाई राहत के रूप में समझाा जाएगा तथा उस दषा में, वह या तो नियत मंहगाई राहत अथवा राज्य सरकार के 2016 के बाद के पेंषनरों के लिए विहित विद्यमान दर पर मंहगाई राहत, जो भी अधिक हो, लेने के हकदार होंगे।"

The 17th February, 2020

No. 14.— In exercise of the power conferred by sub-section (1) read with sub-section (2) of section 9 of the Haryana Legislative Assembly (Salary, Allowances and Pension of Members) Act, 1975 (2 of 1975), the Speaker, Haryana Legislative Assembly hereby makes the following rules to further amend the Haryana Legislative Assembly Members (Pension) Rules, 1978, namely:-

1. (1) These rules may be called the Haryana Legislative Assembly Members (Pension) Amendment Rules, 2019.

(2) They shall be deemed to have come into force with effect from the 1st January, 2016.

2. In the Haryana Legislative Assembly Members (pension) Rules, 1978, in rule 7-A for sub-rule (2), the following sub-rule shall be substituted, namely:-

"(2) The spouse or the children, as the case may be, shall be entitled to draw family pension of rupees fifteen thousand or fifty percent of the last pension (pension+dearness pension, if any) drawn by the deceased member, whichever is higher, per mensem, by merging therein the pre-revised family pension, dearness family pension and dearness relief @245%, with dearness relief at prevailing rate prescribed for post 2016 pensioners of the State Government.

Provided that in case, the family pensioner is already drawing more pension than the consolidated pension after revision, the difference of amount shall be treated as fixed dearness relief and in that case, he/she shall be entitled to draw either fixed dearness relief or dearness relief at prevailing for post 2016 pensioners of the State Government, which is more".
